THIS IS NOT A REQUEST FOR QUOTE. THIS IS A NOTICE OF THE

GOVERNMENT’S INTENT TO ISSUE A SOLE SOURCE AWARD TO CHARTER

COMMUNICATIONS OPERATING, LLC FOR WIRELESS INTERNET (WI-FI) AND

CABLE TELEVISION SERVICES FOR THE ICE/ERO/BUFFALO FIELD OFFICE

AND ALBANY (MALTA), NY SUB-OFFICE.

The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of the Enforcement & Removal Operations (ERO), intends to award a firm-fixed price purchase order on a sole source basis to Charter Communications Operating, LLC (UEI Number: MX16CA896HK5) (Address: 12405 Powerscourt Drive, Saint Louis, Missouri 63131-3673) for wireless internet (Wi-Fi) and cable television services for its Field Office location in Buffalo, NY (Address: ICE/ERO/Buffalo Field Office, 250 Delaware Avenue, 7th Floor, Buffalo, NY 14202) and its sub-office location in Albany (Malta), NY. (Address: ICE/ERO Suboffice, 11 Stonebreak Road, Malta, NY 12020).

ICE/ERO/Buffalo Field Office requires Wi-Fi service with bandwidth at 500 MBPS (minimum) and basic cable television service for 24 televisions in its Buffalo, NY Field Office and 10 at its sub-office in Albany (Malta), NY. Internet and cable television services delivered via satellite are not feasible, as the building owners (from whom ICE leases its offices) will not permit satellite dish(es) to be mounted on the building rooftop or on any other location on the building.

Charter Communications Operating, LLC (dba Spectrum Enterprise) is the only known vendor that provides Wi-Fi and cable television service meeting the requirements stated in the preceding paragraph, in both of the locations where these services are required.

There is only one responsible source and no other supplies or services will satisfy agency requirements as the Wi-Fi and cable television services described in the preceding paragraph is only available from Charter Communications Operating, LLC (dba Spectrum Enterprise).

Services that will be acquired using FAR Part 13 procedures and the anticipated award will be made under the authority of FAR 13.106-1(b)(1)(i), Soliciting from a single source. Market Research conducted by OAQ and ERO revealed that while there are other vendors that offer Wi- Fi and cable television services in the metropolitan Buffalo, NY and Albany, NY areas, the services that they that offer do not meet the requirements due to reliance upon delivery of these services via satellite, or do not offer the required bandwidth (for Wi-Fi service). Based on the findings obtained through Market Research, it was determined that there were no other sources available to provide the cable and wi-fi high speed internet services that meet the agency’s requirements.
