LIMITED SOURCE JUSTIFICATION
FEDERAL ACQUISITION REGULATION (FAR) PART 8 ACQUISITIONS
BRAND NAME
Multiple Award Schedule (MAS)/Multiple Award Contract
Orders under MAS/General Services Administration Schedules (GSA)/Federal Supply Schedules
(FSS) FAR 8.405-6
Purchase Request Number: HC108920EMSS558 Contract Number: TBD Task/Delivery Order Number: TBD Procurement Title: FY20 GW Trane Building Automation System (BAS) Annual Maintenance Estimated Value: $332,512.50 (including options) Statutory and Regulatory Authority: 41 U.S.C. 152(3) and FAR 8.405-6(b)(1)
J&A Number: N/A.
Upon the basis of the following justification, I, as _Contracting Officer__, hereby approve this limited source justification in accordance with FAR 8.405-6(b)(1) as the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. The acquisition referenced herein is conducted under the Statutory Authority of the Multiple Award Schedule Program, 41 U.S.C. 152(3) and the Regulatory Authority of 8.405-6(b)(1).
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requesting Agency:
EMSS Capabilities Office (ECO) Building 108 Saipan Drive JBPHH Wahiawa Annex Wahiawa, HI 96786
Contracting Activity:
DISA/Defense Information Technology Contracting Organization (DITCO) PL72
477 Essex Street, Building 77, Suite 180 Pearl Harbor, HI 96860-5815
2. NATURE/DESCRIPTION OF ACTION(S) BEING APPROVED: Approval is requested for a new Task Order off of a GSA Contract. The Task Order will be firm fixed price. Funds are Fiscal Year (FY) 2020 Other Procurement, Navy (OPN). Period of Performance will be one 12-month base period and four 12-month option periods.
3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S
NEEDS: The EMSS Capabilities Office (ECO) needs preventive maintenance services on their Tracer Building Automation System (BAS) to ensure the system is performing optimally. The BAS controls and monitors status on air conditioning units (ACU), lighting, generators, fuel, Page 2 of 5 Pages uninterruptable power supply (UPS), flood sensors, fire dampers, and fire suppression deployment systems. It supplies environmental controls that is paramount in keeping high value electronic, and computer systems operating as well as provides operational insight to remote locations in and around the ECO facilities. The system notifies EMSS operator if there is an alarm in a system that requires action. Trane Inc. is the manufacturer of the Tracer product currently providing ECO Operations the ability to control and monitor status. ECO’s existing Tracer BAS is proprietary to Trane requiring factory certified trained technicians to work on the software and hardware in order to continue support from the manufacturer
To meet this need, the Government must acquire preventive maintenance services for the Tracer BAS from a contractor who will not jeopardize support from the manufacturer. The estimated value of this acquisition is $332,512.50 for the base period and four option years.
4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND SUPPORTING
RATIONALE:
(a) Preventive maintenance services provided by Trane USA, Inc. meets the Government’s needs because their certified trained technicians who work on the software and hardware will continue support with the manufacturer.
(b) After conducting market research (described in greater detail in Section 6, below), the Government did not identify any other preventive maintenance services provided by any other company that is compatible with the Government’s existing Tracer BAS because there no other preventive maintenance services provided by another company that will continue support from the manufacturer.
(c) This service was previously acquired as a sole source award through Task Order HC1019-
15-F-2028 off of GSA Contract GS-06F-0079R and previously before that through Task Order HC1019-10-F-2000 off of the same GSA contract. Preventive maintenance service is required to be compatible with the previously purchased Tracer BAS software.
(d) If another vendor, other than Trane, provided the annual maintenance, this would risk voiding warranties and jeopardize developer’s higher level support on the system. Loss of this systems would be detrimental to the ECO mission and risk personnel safety. It supplies environmental controls that is paramount in keeping high value electronic, and computer systems operating as well as provides operational insight to remote locations in and around the ECO facilities.
5. BEST VALUE DETERMINATION:
(a) Prior to award, a review of all pricing options will be examined and the order will represent the best value in accordance with FAR 8.404(d) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

(b) Prior to award, the Contracting Officer will make a determination of fair and reasonable pricing, using the proposal analysis techniques at FAR 15.404-1.
6. MARKET RESEARCH: Based on the market research beginning on April 8, 2020, Trane was identified as the sole factory certified provider of support for ECO’s existing BAS system. I spoke with RJ Ritter of Trane and researched small local businesses for a comparable vendor to support our existing Tracer BAS. I also used the DISA Market Research Repository, but failed to find other local support vendors. Finally, I looked at other contracts of similar services and found we used Johnson Controls for other systems, but those systems are only those from their product line. Preventive maintenance services from Johnson Controls, or any other company, will not meet the agency’s needs. I compared services provided and cost differences between the Johnson Control’s contract with our previous Trane contract and quotes. I found the cost to be competitive when comparing their maintenance and support services with their product line and Trane’s proposal.
Based on current market research, dated 22 July 2020, it has been determined that only the aforementioned service to ECO Tracer BAS system be provided by Trane Inc. Hawaii. The research reflects this would be the most advantageous method in supporting this request and fulfills the Governments need. No competitor preventive maintenance service exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, e.g. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.
7. ANY OTHER SUPPORTING FACTS: N/A.
8. ACTIONS THE AGENCY MAY TAKE TO REMOVE BARRIERS THAT LED TO THE
RESTRICTED CONSIDERATION:
(a) Lifecycle of the current architecture.
i. The lifecycle of the current system is expected to take place within the next 5 years. Other manufactures will be considered.
(b) Actions to remove barriers.
i. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.
ii. When it is time to replace the Building Automation System, competition will be a deciding factor in the award.
iii. If the current Building Automation System is meeting the agency’s needs and is not outdated, the brand-name requirement is expected to continue beyond the end of this J&A period of performance to maximize the cost

(c) Previous awards for this service, as mentioned in 4(c) above, were accomplished as a sole source to Trane USA, Inc.
