About this file

This is a Justification and Approval (J&A) document for a firm fixed-price contract award on a brand name basis issued by the Naval Surface Warfare Center, Dahlgren Division (NSWCDD), a component of the Department of the Navy.

The contract covers the procurement of ninety (90) 2000VA/1400W Ruggedized Uninterruptible Power Supplies (UPS), part number UPS1-2K-1G-SRNDT1-2E, manufactured by Nova Power Solutions, Inc. These units are required for shipboard applications in support of the Dam Neck Activity. The delivery timeline is 22 weeks after receipt of the order, sooner if available. The procurement is justified under 41 USC 1901 as implemented by the streamlined FAR 12.102 model deviation text, restricting competition. The rationale for sole-source procurement centers on the Nova Power UPS1-2K-1G-SRNDT1-2E being the only manufacturer providing the exact combination of sponsor qualification, ruggedization specifications, fleet compatibility, physical dimensions, and thermal management required to meet strict defense specifications including Military Standards 1399 and 901D. Market research confirmed no alternative sources meet these non-negotiable technical requirements. Procuring an alternative would necessitate additional hardware redesign, integration, requalification testing, and approximately 16 months of program deployment delay. The estimated contract cost is redacted, with funding allocated across RDT&E and OPN accounts for fiscal years 2025 and 2026. The contracting point of contact is James Embrey at james.d.embrey3.civ@us.navy.mil, 540-498-5241.
