About this file
This is a FAR Part 6 Justification and Approval document for other than full and open competition (Control Number: G-26-007, dated June 2025).
The document approves a six-month extension of an existing Indefinite Delivery Indefinite Quantity (IDIQ) contract for repair and installation of various electrical systems at USAG Bavaria, Grafenwoehr Military Community. The original contract (W912PB23D8001) was competitively awarded with a three-year ordering period from April 1, 2023 through March 31, 2026, with an unspecified ceiling value. The modification extends the ordering period through September 30, 2026 at no increase to the contract ceiling, utilizing existing competitively established rates. The Directorate of Public Works (DPW) Engineering Division at Grafenwoehr is the requiring activity, with the Regional Contracting Officer (RCO) Bavaria executing the contract action.
The justification cites Title 10 U.S.C. §3204 and FAR 6.103-1 (only one responsible source) as authority for sole-source extension. The contracting officer identified critical safety, logistics, and cost rationales: the FY2026 Annual Work Plan contains 13 prioritized electrical projects including fire and evacuation systems replacements; service gaps would create hazardous conditions and operational readiness risks; and emergency standalone contracts would be substantially more costly than pre-priced IDIQ services. Analyzed alternatives (Blanket Purchase Agreement, standalone contracts, and task orders prior to expiration) were determined inadequate. Market research included an RFI posted March 25, 2026 on SAM.gov, which closed March 30, 2026 with one capability statement response. The RCO maintains a comprehensive vendor list of qualified electrical contractors expected to compete in follow-on procurement efforts. The existing pricing was determined fair and reasonable at original award and remains valid for the extension.

JUSTIFICATION REVIEW DOCUMENT
FAR Part 6 Justification and Approval for Other than Full and Open Competition
Program/Equipment: Indefinite Delivery Indefinite Quantity (IDIQ) for Repair and Installation of Various Electrical Systems, USAG Bavaria, Grafenwoehr Military Community
Authority: Title 10 United States Code (U.S.C.) §3204 as implemented in Federal Acquisition Regulation (FAR) 6.103-1, Only one response source and no other supplies or services will satisfy agency requirements.
Amount: This modification will extend the original period of performance (1 April 2023 – 31 March 2026) by six (6) months (30 September 2026).
Reviews: I have reviewed this justification and find it adequate to support other than full and open competition.

Legal Counsel:
11. Technical Certification: I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
12. Requirements Certification: I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Fair and Reasonable Cost Determination: The pricing for this contract was determined fair and reasonable via full and open competition at the time of award. This modification only extends the ordering period, and all work will be priced using the existing, competitively established rates. As the pricing structure remains unchanged, the original determination of reasonableness is still valid. Additionally, the electrical industry in Germany has endured among the most volatile economic imbalances triggered by recent global and regional events, most notably the COVID-19 pandemic and unrest in Ukraine and the Middle East. This volatility led to RCO Bavaria shortening IDIQ ordering periods from five down to three years at the request of several electrical contractors due to reluctance of longer-term commitments. As of 2026, the German Government has begun intervention measures to return economic balance and increase the industry’s competitiveness; however, local contractors remain reluctant to long-term commitments. Therefore, the Government assumes less risk when sheltered from drastic fluctuations. Based on this information, I consider the already established pricing to be fair and reasonable.
14. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief.
