About this file

This is an Amendment to Solicitation for the U.S. Government Publishing Office (GPO) contract opportunity 040ADV-26-R-0036, issued on August 24, 2026. The amendment extends the offer due date to Friday, September 4, 2026 at 5:00 PM EST and provides responses to questions posed by potential offerors. The solicitation is governed by Materials Management Acquisition Regulations (MMAR) rather than the Federal Acquisition Regulation (FAR), as GPO is a legislative branch entity. The contract incorporates numerous MMAR clauses by reference, including provisions related to independent pricing, equal opportunity, labor standards, payment procedures, and disputes resolution.

The evaluation criteria focus on technical acceptability across four factors: technical capability and understanding of the Statement of Work, management and staffing plan with defined roles and responsibilities, key personnel qualifications and experience, and past performance on recent and relevant projects within the past six years. Price evaluation will assess whether the proposed price is complete, fair, and reasonable compared to market competition and historical pricing. Offerors must submit a cost-loaded Network Analysis Schedule with detailed price breakdowns including quantities, unit prices by work category, and total contract price. The contract includes options to extend services up to six months and to extend the contract term up to 60 months total duration. Key personnel must possess required education, minimum years of experience, and technical skills to perform assigned duties with minimal supervision.

DISPUTES DISPUTES (GPO Clause June 2008) 08 29 25

(a) This contract is subject to the Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613, and as modified by Section 1501 of Title I of Division H of the Consolidated Appropriations Act, 2008, Public Law No. 110-161).

(b) Except as provided in the Act, all disputes arising under or relating to this contract shall be resolved under this clause.

(c) "Claim," as used in this clause, means a written demand or written assertion by one of the contracting parties seeking, as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of contract terms, or other relief arising under or relating to this contract. However, a written demand or written assertion by the Contractor seeking the payment of money exceeding $50,000 is not a claim under the Act until certified. A voucher, invoice, or other routine request for payment that is not in dispute when submitted is not a claim under the Act. The submission may be converted to a claim under the Act, by complying with the submission and certification requirements of this clause, if it is disputed either as to liability or amount or is not acted upon in a reasonable time.

(d) (1) A claim by the Contractor shall be made in writing and, unless otherwise stated in this contract, submitted within 6 years after accrual of the claim to the Contracting Officer for a written decision. A claim by the Government against the Contractor shall be subject to a written decision by the Contracting Officer.

(2)(i) The Contractor shall provide the certification specified in paragraph (d)(2)(iii) of this clause when submitting any claim exceeding $50,000.

(ii) The certification requirement does not apply to issues in controversy that have not been submitted as all or part of a claim.

(iii) The certification shall state as follows: "I certify that the claim is made in good faith; that the supporting data are accurate and complete to the best of my knowledge and belief; that the amount requested accurately reflects the contract adjustment for which the Contractor believes the Government is liable; and that I am duly authorized to certify the claim on behalf of the Contractor."

(3) The certification may be executed by any person duly authorized to bind the Contractor with respect to the claim.

(e) For Contractor claims of $50,000 or less, the Contracting Officer must, if requested in writing by the Contractor, render a decision within 60 days of the request. For Contractor-certified claims over $50,000, the Contracting Officer must, within 60 days, decide the claim or notify the Contractor of the date by which the decision will be made.

(f) The Contracting Officer's decision shall be final unless the Contractor appeals, within ninety (90) days of receipt of a ContractingOfficer's decision, to the U.S. Government Accountability Office Contract Appeals Board (GAO CAB), 441 G Street, NW, Room 7182, Washington, DC, 20548; Facsimile: 202-512-9749; E- Mail: CAB@gao.gov.

(g) If the claim by the Contractor is submitted to the Contracting Officer or a claim by the Government is presented to the Contractor, the parties, by mutual consent, may agree to use alternative dispute resolution (ADR). If the Contractor refuses an offer for ADR, the Contractor shall inform the Contracting Officer, in writing, of the Contractor's specific reasons for rejecting the offer.

(h) The Government shall pay interest on the amount found due and unpaid from (1) the date that the Contracting Officer receives the claim (certified, if required); or (2) the date that payment otherwise would be due, if that date is later, until the date of payment. With regard to claims having defective certifications, interest shall be paid from the date that the Contracting Officer initially receives the claim. [A defective certification means a certificate which alters or otherwise deviates from the language in(d)(2)(iii) above, or which is not executed by a person duly authorized to bind the contractor with respect to the claim. Failure to certify shall not be deemed to be a defective certification.] Simple interest on claims shall be paid at the rate, fixed by the Secretary of the Treasury as provided in the Act, which is applicable to the period during which the Contracting Officer receives the claim and then at the rate applicable for each 6- month period as fixed by the Treasury Secretary during the pendency of the claim.

(i) The Contractor shall proceed diligently with performance of this contract, pending final resolution of any request for relief, claim, appeal, or action arising under the contract, and comply with any decision of the Contracting Officer.

This contract clause also cancels and supersedes any other disputes language currently included in existing contractual actions.

SECTION M

M.4 The following evaluation criteria will be used to determine technical acceptability:

Ratings Technical Evaluation Definitions Acceptable An Acceptable proposal demonstrates a thorough understanding of the Statement of

Work (SOW), objectives, required resources, schedule, and all other requirements essential to successful performance.

Factor 1 – Technical Capability An acceptable proposal demonstrates a thorough understanding of the SOW objectives, required resources, schedule, and other requirements essential to successful performance.

The Offeror’s experience is identical to, similar to, or related to the requirement. The Offeror’s references clearly describe the relevancy of experience in a manner that helps the evaluation team recognize the similarities or parallels to the proposed contract.

Factor 2 - Management and Staffing Plan Offeror provides a technically sound management approach that clearly defines the roles and responsibilities of key personnel, support staff, and subcontractors, along with strategies for effective coordination, quality assurance, and oversight. The plan satisfactorily describes methods for organizing, staffing, and managing the contract with qualified personnel while ensuring full cooperation during Government inspections.

Factor 3 - Key Personnel Offeror provides Key Personnel who clearly possess the education requirements, minimum years of experience, and technical skills to perform the assigned duties with minimal supervision and are qualified to manage and execute the project successfully.

Factor 4 – Past Performance GPO will evaluate the recency, relevancy, and quality of the Offeror’s past performance as predictors of probable success under this requirement.

Acceptable proposals present a high probability of satisfying all requirements. Any minor weaknesses identified can be readily corrected without significant Government oversight or risk to performance.

Unacceptable An Unacceptable proposal fails to demonstrate a sufficient understanding of the SOW, objectives, required resources, schedule, or other essential elements necessary for successful contract performance.

Factor 1 - Technical Capability Offeror’s technical capability is incomplete, unrealistic, or demonstrates significant misunderstanding of the SOW or schedule requirements. The Offeror fails to demonstrate the technical capability to satisfy all requirements.

Factor 2 – Management and Staffing Plan The Plan lacks sufficient detail, accountability, or compliance measures and does not clearly define roles, responsibilities, or coordination methods.

Factor 3 - Key Personnel Offeror’s Key Personnel lack the qualifications, experience, or technical expertise required to perform effectively under this contract.

Factor 4 – Past Performance The Offeror lacks relevant performance history or performance information is unavailable. Unacceptable proposals present a low probability of successful performance and contain deficiencies or weaknesses that cannot be readily corrected without major revisions.

M.5 Past Performance The offeror’s past performance will be evaluated in accordance with MMAR 15.305(a)(2). Performance information will be used for both responsibility determination and a best value decision. GPO may use performance information obtained from sources other than those identified by the Offeror and utilize existing databases of contractor performance information. Any past performance information that is determined to be relevant based on the below definition will be evaluated in accordance with the elements listed in the Past Performance Questionnaire items, each of which will be of equal importance.

Adverse past performance information to which the offeror has not previously had an opportunity to respond will be addressed in accordance with the policies and procedures set forth in the MMAR 15.3.

GPO will initially determine the recency and relevancy of past performance information as a predictor of probable performance under this contract.

• Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 6 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

• Relevancy Assessment: An evaluation of all recent performance information obtained to determine whether the provided work performed under those contracts relate to a similar size and scope as those required by this solicitation. In determining the relevancy of effort performed under individual past performance contracts, the Government will consider the specific effort or portion consistent with that proposed by the prime contractor and/or subcontractors. The past performance information obtained from sources will be used to establish the relevancy of past performance.

In accordance with MMAR 15.305(a)(2)(iv), an Offeror's past performance will not be evaluated favorably or unfavorably when:

1) The Offeror lacks relevant performance history; or

2) Information on performance is not available.

When this occurs, an offeror lacking relevant performance history is assigned a neutral rating. Prior to assigning a neutral past performance rating, the contracting officer may consider a broad range of information related to an offeror's performance.

M.6 Cost/Price Evaluation

Price evaluation will be performed to determine whether the proposed price is complete for the work to be performed, reflects a clear understanding of the requirements, and is consistent with the approaches set forth in the Offeror’s technical proposal and budget narrative, and to determine if the proposed profit and total price are fair and reasonable.

a. This evaluation is conducted with the expectation of adequate price competition and will rely heavily on market forces to determine whether the proposed price is fair and reasonable. The comparison of proposed price in response to this solicitation is the preferred technique for this evaluation. GPO will also compare the proposed price to historical price paid for the same or similar services and the independent government cost estimate. Other techniques and procedures set forth in MMAR 15.404 1(b), if deemed necessary, may be used to ensure proposed price is fair and reasonable.

b. No price evaluation will be performed on proposals determined to be non-responsive or technically unacceptable.

c. This contract requires a cost-loaded Network Analysis Schedule (NAS). The schedule of prices shall be included as part of the NAS and submitted with the proposal. Offerors shall provide a detailed price breakdown, including:

• Quantities and unit prices for each category of work

• Total contract price.
