About this file

This document appears to be a question and answer packet related to a pre-bid conference for a cell tower contract opportunity issued by the Town of Harvard, Massachusetts. The Town is seeking bids from qualified providers of personal wireless services licensed by the FCC and qualified wireless infrastructure providers to lease land and develop/operate a wireless facilities tower with up to 2,500 square feet of ground-level infrastructure. The packet provides details on utility infrastructure, height restrictions, site access, and the proposed lease area on the Hildreth House parcel. Respondents are advised that the Town does not warrant the proposed tower location as being constructable or permittable, and they may negotiate the final tower position with the successful bidder. The winning bidder's lease is expected to commence on January 1, 2025, though the Town indicates there is flexibility on the start date.

The packet also includes a GIS map of the Hildreth House parcel and related utility information. The Town has indicated a maximum tower height restriction of 135 feet, which may impact the attractiveness of the lower portions of the tower to potential bidders. Respondents are not expected to propose a specific tower location at this time, but are advised that the Town may be willing to consider variances to obtain a better visual impact or constructability.

Cell Tower 03/28/24 Pre-bid conference Qs:

1. Requesting map detailing utility infrastructure serving the parcel/proposed leased site

(fiber, gas, water, electricity)

Please see attached excerpt (Hildreth parcel and ledge demarcation.pdf); there is a fiber loop on Ayer Road (which is Town-owned), a fiber line of unknown ownership on Ayer

Road, and a separate secured Public Safety connection at the Fire Station.

2. Is utility access restricted to below-ground per the bylaw?

It is, but the distance below-ground is unspecified.

3. Does the Town have a preferential location for the access driveway/route to the leased space?

No fixed preference; ideally the access driveway would be the ideal balance between unobtrusive, not impacting the operations of the Land Use and Building Departments at

Hildreth House, and functional (for the tower owner).

4. Can the leased area of the parcel be detailed (or staked)? The topography is variable, ledge appears abundant.

See attached pdf Hildreth Tower area. Additionally, the GIS data on the lines in the image in the document Hildreth Tower area are attached as a kmz file.

5. Is the maximum height restriction 135’? Please confirm, as the height coupled with the 10’ spacing between carriers limits the attractiveness of renting the lower portions of the tower.

Please see attached response from the Director of Planning (Bylaw height restriction resp)

6. Is there flexibility in the date for lease commencement? Documents state ‘winning bidder’s lease commences January 1, 2025?

Yes.

Harvard Massachusetts Hildreth House Site Tower Area to Locate

A conceptual area to locate the proposed tower is marked with a green box in the image below. It is nominally more than 135 feet from property lines. An example location is given.

42°30'11.70"N 71°35'11.56"W

Respondents are advised that the Town does not warrant this area to locate as being constructable or permittable.

If a better result in terms of visual impact or constructability can be obtained by moving farther west on the parcel, the Town may negotiate with the successful bidder on the final position of the Tower in consideration of balancing the requirements for setbacks versus seeking variances to obtain a better location.

Respondents are not expected to propose a specific location at this time.
