About this file

This document is a Justification for Other Than Full and Open Competition for a 12-month bridge contract with Chenega Healthcare Services, LLC (CHS) for Medical Support Services for the National Nuclear Security Administration's (NNSA) Office of Secure Transportation (OST) Human Reliability Program (HRP). The contract, valued at approximately $5,093,553.84, will run from August 28, 2025, through August 27, 2026, and was originally awarded as a Sole Source 8(a) Alaska Native Corporation contract under Contract Number 89233120CNA000130.

The OST Medical Support Services Contract supports the HRP by providing specialized medical and psychological evaluations for Federal Pilots, Federal Agents, and other critical staff who may have access to nuclear explosive duties. CHS is deemed the only responsible contractor capable of providing these services due to their established relationships with OST personnel, comprehensive understanding of medical histories, and intricate integration with OST's security and operational systems. NNSA intends to pursue a competitive 8(a) follow-on contract and is conducting market research, with a Sources Sought Notice released on February 27, 2024, to identify qualified vendors for the future solicitation.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN

COMPETITION

MEDICAL SUPPORT SERVICES

I. AGENCY IDENTITY AND CONTRACTING ACTIVITY

The United States Department of Energy/National Nuclear Security Administration’s (DOE/NNSA) Office of Secure Transportation (OST) plans to extend Contract No.

89233120CNA000130, which was awarded to Chenega Healthcare Services, LLC (CHS) for continued medical support services of the OST Human Reliability Program (HRP) by means of other than full and open competition. The contracting activity is the NNSA Office of Partnership and Acquisition Services Contracting Operations Division, Program Support Acquisition Branch (NA-PAS-315).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

This document sets forth the justification and approval for the use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984, Pub. La. No. 98-369. The total anticipated value of this 12-month contract extension, if exercised in its entirety, is approximately $5,093,553.84.

III. DESCRIPTION OF REQUIRED SUPPLIES AND/OR SERVICES

NNSA is a separately organized agency within DOE wherein its primary mission is enhancing national security through the military application of nuclear energy.

DOE/NNSA oversees the operation of a number of facilities in the Continental United States that produce, store, or handle nuclear material. In particular, NNSA’s Office of Defense Programs (DP) is responsible for ensuring that the nuclear weapons stockpile continues to meet national security requirements under NNSA’s Life Extension Program (LEP) while serving as an effective and vital deterrent under NNSA’s FY23 Stockpile Stewardship and Management Program (SSMP). Consequently, to maintain the safety, security, and effectiveness of the Nation’s nuclear deterrent without nuclear testing, NNSA must refurbish existing warheads, reuse nuclear weapon components, and/or replace nuclear components while continuing to modernize its infrastructure and move ahead with its plans for plutonium pit production.

Within DP, OST is responsible for the safe and secure transport of nuclear weapons, special nuclear materials (SNM), and weapons components between DOE/NNSA production facilities and Department of Defense (DOD) facilities via ground and air modes of transportation. The nuclear materials and components are entrusted to the custody of the OST Federal Agents (FAs) who are highly trained to counter and defeat any threat utilizing a combination of highly specialized tractor-trailer rigs and cadre of light to heavy duty escort vehicles engineered to deliver a rapid response in the event of an emergency or attack. The FAs operate tractors, escort vehicles, network communications, and other equipment to assure the safe and secure movement of parts, assemblies, weapons, and

The OST Medical Support Services Contract supports the OST’s HRP. The HRP establishes specific criteria to ensure that OST Federal Pilots, FA applicants, and other critical OST staff who are or may be assigned or afforded access to nuclear explosive duties meet the highest standards of reliability, trustworthiness, and physical and mental suitability. This is accomplished through a comprehensive system of continuous evaluation, monitoring, and self-reporting 24/7/365 that identifies individuals whose judgment and reliability may come into question if such individuals were impaired by some physical and/or mental personality disorder, including those individuals that suffer from alcohol dependence/abuse or individuals who choose to use illegal drugs or other illegal substances or demonstrate any other condition that may be of a security and safety concern.0F

A bridge contract to continue the critical OST Medical Support Services Contract is necessitated for up to 12 months beginning August 28, 2025 through August 27, 2026.

IV. AUTHORITY

The statutory authority permitting other than full and open competition is 41 USC 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.

V. APPLICATION OF AUTHORITY

The scope of this action is to extend CHS’s medical support services by an additional twelve (12) months beginning August 28, 2025, through August 27, 2026. CHS was awarded the Medical Support Services as a Sole Source 8(a) Alaska Native Corporation under Contract Number 89233120CNA000130 on January 28, 2020. The competitive 8(a) solicitation for follow-on contract is still under development, and as a result, the contract award will be delayed beyond the current contract’s end date.

The HRP requires a highly specialized skillset that goes far beyond standard medical or psychological recommendations, including in-depth knowledge of NNSA/OST HRP requirements. CHS is the only responsible contractor capable of providing uninterrupted support for these essential requirements during the twelve-month extension period because of their expertise and extensive understanding of the specific medical and psychological standards, protocols, and procedures outlined in the NNSA/OST HRP. This expertise is critical for ensuring consistent and compliant evaluation.

1 HRP certification is required for individuals who are assigned to, or applying for, a position that: (1) affords access to Category 1 SNM or has responsibility for transportation or protection of Category I quantities of SNM; (2) involves nuclear explosives duties or has responsibilities explosives; or (3) affords access to information concerning vulnerabilities in protective systems when transporting nuclear explosives, nuclear devices, selected components, or Category I quantities of SNM. See 10 CFR §712.10(a)(1)-(3).
