About this file

This document is a justification for a sole source award of a purchase order. The U.S. Coast Guard requires testing of an experimental oil skimmer system owned by Elastec to better understand its effectiveness in recovering dielectric fluids, which are present in hundreds of thousands of gallons in potential worst case spills from offshore wind energy facilities. Elastec's Kvichak vessel and skimmer system offers flexibility in recovering this type of hazardous substance spill using either a belt skimmer or disc skimmer. As the purpose is to test the system's performance under real-world conditions and publish results to guide oil spill removal organizations, it is critical the tests are conducted by the original equipment manufacturer to ensure reliable results. No future acquisitions of this technology by the Coast Guard are anticipated once testing is complete. The award is for $35,000 to Elastec as the only responsible source able to meet the requirement.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.

STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE

INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. A recent review of proposed Oil Spill Response Plans (OSRPs) submitted to the Bureau of Safety and Environmental Enforcement (BSEE) shows that offshore wind energy facilities with worst case discharge potentials of hundreds of thousands of gallons predominately consisting of diesel fuel and dielectric insulating fluids. The clean-up of diesel fluids has been studied extensively and is well understood. However, little is known about the effectiveness of current response technologies, techniques, and response methodologies when recovering dielectric fluids. USCG is partnering with BSEE to better understand the skimmers’ performance with recovering dielectric fluids in the event of a large-scale spill from a wind energy facility. The Kvichak vessel and skimmer system by Elastec offers flexibility in recovering this type of hazardous substance spill. Test data about this vessel and skimmer system is needed.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: There is a limited set of skimmers available for dielectric fluids and the Kvichak vessel and skimmer system can use either a belt skimmer or a disc skimmer, which gives them greater flexibility in cleaning up a real-world dielectric fluid spill. Note: the disc skimmer is experimental.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). The technical staff researched the internet for products meeting the requirement after investigating the requirement with Oil Spill Removal Organizations (OSROs) and BSEE subject matter experts. The technical staff also reviewed strategic sources and GSA for the items.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES. Elastec is the manufacturer of the Kvichak vessel and skimmer system and is also the developer of the experimental disc system. As the purpose of this requirement is to allow BSEE to test the Kvichak vessel and skimmer system under controlled but real-world situations, having the OEM provide and operate the experimental features will ensure that the test results are as realistic as possible. Furthermore, as these test results are published to guide Oil Spill Removal Organizations (OSROs) on which equipment is most effective in a real spill response, it is critical that test results are reliable.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. An accurate purchase description exists; however, this is not the constraint necessitating the sole source. This requirement is to test experimental technologies and publish the results of those tests. Therefore, severely limited new technologies entering the market for dielectric fluid spills is the constraint.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. This purchase satisfies a requirement to test new technologies in the market and publicly publish results which inform OSROs on the effectiveness of equipment on the market for dielectric fluid spills. USCG does not purchase this type of equipment but instead provides regulatory advice so no future acquisition of this technology by USCG is anticipated.
