1. Agency and Contracting Activity.
The Department of Homeland Security, U.S. Immigration and Customs Enforcement, Homeland Security Investigations, proposes to enter into a contract on behalf of HSI Division 6 TechOps on a basis of other than full and open competition.
2. Nature and/or description of the item/service being procured and anticipated cost.
(a) Type of action: Firm fixed price purchase order
(b) Amount of the current J&A: $155,022.73
Brief Description: OAQ intends to procure network threat services. This is continued support and threat updates for the RuleGate Network Threat equipment that is installed on the stand-alone Communications Law Enforcement Act (CALEA) network. The Advanced Cyber Threat subscription the vendor offers is critical to maintaining the security of the CALEA network. This is the last year the hardware will be supported. Next year, Fiscal Year (FY) 2021, the hardware will be upgraded with the intention of including option periods in the award. This requirement has a period of performance of one (1) year, August 1, 2020 – July 31, 2021. The vendor listed below is the sole company that can provide the required services.

Rationale: FAR Part 6.302-5 Authorized or Required by Statute and 41 U.S.C. 3304(a)(5) and 15 U.S.C. 638(r)(4). The manufacturer, Centripetal Networks, is part of the Small
Business Administration’s (SBA) Small Business Innovative Research Program / Small Business Technology Transfer program (SBIR/STTR) Phase III award that is derived from, extends, or completes efforts made under prior SBIR/STTR Funding Agreements and is authorized pursuant to 15 U.S.C. 638(r)(4) Phase III Agreements, Competitive Procedures, and Justification for Awards. Centripetal Networks won the SBIR award under Phase I (DHS Contract D10PC20038) and Phase II (DHS Contract D11PC20215), which was competed and satisfies the competition requirement for the pre-competed SBIR Phase III contract vehicle.
Centripetal Networks holds all copyright and patents for the system. Centripetal Networks also provides warranty repair and real-time assistance. The vendor does not license any other source to provide training or conduct maintenance on the system. There are no authorized resellers of Centripetal products. There is no other known source for the maintenance components of the system. Any work/maintenance performed on the system which is not performed by Centripetal Networks would adversely affect the warranty.
While Other sources for this service were sought, no sources were found that could provide the support for RuleGate hardware and the Advance Cyber Threat subscription service. Homeland Security Investigations (HSI) Technical Operations will continue to monitor the marketplace for suitable replacements however, at this time, no other company can provide a solution that meets the mission requirements.
2. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)

Short description of action taken: The contracting officer determines that the anticipated price(s) will be fair and reasonable based on historical pricing from previous awards. Award 70CTD019P00000022 was awarded with a period of performance (POP) of one (1) year for $157,000.00. Award HSCETC-17-J-00026 was awarded with a base year and one (1) option year at $143,378.99 each. The anticipated cost to the Government is $155,022.73.
