B.2 LC52.216-3 CONTRACT TYPE (JUN 2016)
This is a competitive solicitation following the procedures of FAR 13.5, allowing for the use of simplified acquisition procedures above the simplified acquisition threshold (SAT) for commercial items. The Library anticipates issuing a single-award Indefinite-Delivery/Indefinite-Quantity (IDIQ) contract. The Government will place Firm-Fixed-Price (FFP), Time-and-Material (T&M), and Labor-Hour (LH) orders with fixed hourly rates, or a combination of these types, for individual requirements. Task/Delivery Orders (orders placed by a Contracting Officer), QB Orders (orders placed by an authorized Ordering Agent as defined in this contract), and P-Card (credit card) Orders may be issued under this IDIQ.

These categories and rates may be used to establish firm-fixed pricing for orders issued unilaterally for specific work associated with section C.3.4.
B.2.4 Evaluation Fee
The evaluation fee covers the cost of a thorough evaluation. An order will be issued for each evaluation. Upon completion of an evaluation, the contractor will send the Library a written estimate with projected pricing, including required replacement parts and services for each piece of equipment. If the Library chooses to proceed with the repair, the cost of the repair shall be issued as a new order. If the Library declines to proceed with repairs after review of the contractor estimate, only the evaluation fee will be charged. If the contractor deems a piece of equipment to be non-repairable, the contractor shall not charge the evaluation fee.

030ADV24R0061 Section C
SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 STATEMENT OF WORK
C.1 Background Within the National Audio-Visual Conservation Center (NAVCC) in Culpeper, Virginia, the Library of Congress (Library) operates a videotape laboratory for the digitization of historic video collections. The video collections encompass dozens of historic and obsolete videotape formats, and therefore a large range of videotape players and supporting equipment are needed to achieve the digitization mandate. NAVCC requires specialized contractor support to service and repair the historic video equipment of the laboratory on an ongoing basis.
C.2 Scope The contractor shall diagnose, repair (including sourcing and installing replacement parts), replace, and ship video equipment or machines, as well as support equipment, on an as-needed basis. The Library will issue task orders or make purchase-card payments for this work.
C.3 Requirements The contractor shall receive shipments of video equipment from the Library. The contractor shall examine the equipment, diagnose the problems, and produce a written repair proposal/estimate for each machine for the Library’s review. Following Contracting Officer Representative (COR) approval of the proposal/estimate, the contractor shall perform the approved repairs, test the repaired equipment, and ship all Library equipment back to NAVCC. The contractor shall provide a 90-day warranty of work and parts that begins upon receipt of equipment. Finally, the contractor shall submit detailed invoice(s) for payment. In the event that a cost-effective repair cannot be performed, either due to a lack of available parts or the equipment is considered damaged beyond the point of repair, the contractor shall propose a functionally equivalent replacement item. The purpose of this would be to replace the item entirely in the event of a situation where parts cannot be located, or when it is more cost-effective to replace the item entirely than with a repair. In this situation, the contractor shall provide several quotes to justify price reasonableness of the replacement item and the Government shall determine the fair-and-reasonable pricing for such situational item replacements on a per-order and per-machine basis.
C.3.1 Receiving Equipment from the Library The Library will ship equipment to the contractor to be serviced at the contractor’s facility. The contractor shall contact the COR to confirm receipt of each shipment.
C.3.2. Initial Examination/Diagnostics The contractor shall examine each piece of equipment individually and diagnose the problem(s). The contractor shall determine the best course of action regarding replacement parts, repairs, and services required to return the equipment to optimal working condition at NAVCC.
C.3.3 Written Proposal/Estimates – COR Approval Required The contractor shall produce a written report for each piece of equipment to be serviced. This report shall include steps the contractor will take for service and repair, and an itemized breakdown of costs. Both replacement parts and services shall be included in the proposal/estimate. The contractor shall send the written proposal/estimate to the COR for their review and approval prior to conducting any repair work on the equipment. The COR will provide an approval decision to the contractor within 10 business days of receiving this proposal/estimate.
C.3.4 Repairs The contractor shall ensure that all repairs approved by the COR are completed according to the written proposal/estimate as expeditiously as possible. Repairs may be performed by a sub-contractor. Responsibility for the cost, quality of repairs, delays, etc.
shall, however, rest with the prime contractor.
C.3.5 Quality-Assurance Testing After repair and servicing, the contractor shall perform quality-assurance testing of each repaired piece of equipment. Testing shall occur prior to returning equipment to the Library. The contractor shall only ship equipment back to the Library after it has been repaired and the equipment is in optimal working condition. Any work performed by, or parts provided by, a subcontractor shall also undergo quality-assurance testing before being returned to the Library.
C.3.6 Invoice The contractor shall provide an itemized invoice, including parts, shipping, labor, complete descriptions of repairs performed, and any further recommendations. The contractor shall accept credit-card payments for approved invoices. The Library will approve payment within 30 days after receipt of invoice, unless the invoice contains different payment terms.
C.3.7 Warranty The contractor shall provide a 90-day warranty on repair and parts. The warranty shall provide coverage for the work performed on the equipment for 90 days following receipt of the equipment by the Library. This warranty shall cover all replaced parts, shipping, and labor for the repaired equipment. If the repairs were limited to a specific aspect of the machine or system, warranty shall cover the repaired system only and not the entire device.
C.3.8 Return Shipment Following the COR’s review of the contractor's initial evaluation findings, the contractor shall pack and ship all Library equipment, including the repaired equipment and/or unrepaired equipment, back to NAVCC using packing materials which shall ensure that the Library will receive the equipment in undamaged condition. The packing materials used by the Library in the original shipment of equipment to the contractor constitute acceptable standards for packing the equipment.

I.7 LC52.216-1A ORDER PLACEMENT - ALTERNATIVE ORDERING PROCEDURES (FEB
2015)
Orders placed under this contract may be placed in any of the following three ways:
Method 1). The Government may place Task Orders by a warranted Contracting Officer (CO). Orders placed in this manner will obligate funding up front to cover the evaluation fee(s) as well as the initial shipping costs. Such Orders will later require modification(s) executed by the CO to add funding to cover any subsequent approved costs (including repair parts, repair labor, and return shipping price) after the Contractor’s written repair estimate is provided to the Government and accepted by the COR. The contractor shall submit invoices via IPP for orders placed in this manner per the Library of Congress payment clause LC52.232-1, and all payments will be processed via IPP.
Method 2). The Government may place QB Orders by a warranted Contracting Officer or an Ordering Officer specified in this contract in LC52.201-2 Ordering Officers. Orders placed in this manner will obligate funding up front to cover the evaluation fee(s) as well as the initial shipping costs. QB orders will not be modified later to add the repair costs if the total price of the order exceeds the micro-purchase threshold for supplies and labor.
