SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1. OVERVIEW / BACKGROUND.

This Request for Proposal (RFP) is for a multispectral scanning system capable of advancing the high quality, high quantity digitization program of Cultural Heritage materials held by the Library of Congress (Library). The Library seeks to harness cutting edge technological advances in multispectral digital scanning technology to improve its Cultural Heritage digitization capabilities for historic photographic collections.

“Multispectral Scanning System” is used in this RFP to designate any system that is capable of capturing a digital image employing spectral imaging techniques, regardless of the technology and engineering approach employed, as long as it meets the requirements of the Library.

The Library’s collection materials include millions of items in wide-ranging physical formats such as monographs, serials, bound newspapers, pamphlets, manuscripts, sound recordings, films, videos, sheet music, photographs, posters, microfilm, and maps.

Since the 1990’s, the Library has been digitizing its collections for preservation and to make them accessible on the web. Given improvements in technology, there is increasing interest on the part of the Library in producing very high quality digital duplicates of rare and/or deteriorating materials that can help reduce wear and tear on originals, as well as provide surrogates of sufficient quality to serve as substitutes for the originals if necessary.

For the majority of these materials, traditional digitization technology is able to capture a faithful representation of the original, when properly calibrated. However, many collection materials, especially those in the Prints and Photographs Division, do not reproduce with a high degree of accuracy using traditional digitization technology. This issue is well known in imaging science, and relates to the limitations of Red Green and Blue (RGB) image capture technology, which is universal to virtually all digital capture devices used in cultural heritage. The solution involves a technique called narrow band spectral imaging. This technology has been successfully used for many years in scientific imaging, and is now available for use in more mainstream digitization applications, including cultural heritage.

In this solicitation, the Library is seeking new ideas in scanning technology as applied to the problem of capturing very high quality, faithful reproductions of historic still photographic images via the use of multispectral imaging technology.

C.2. SCOPE.

The contractor shall provide a complete scanning system, including illumination, capture device and related accessories, carriers, appropriate workflow, color conversion, analysis software and hardware, training for Library staff, training manuals and other aids, remote support, and a system warranty.

C.3. REQUIREMENTS

The contractor shall provide a spectral scanning system capable of efficiently and accurately capturing digital images from materials that do not image accurately when using traditional digitization technique. The ideal system shall provide high levels of throughput, and shall lend itself to incremental updates over time to take advantage of improved technologies.

C.3.1. SCANNING SYSTEM REQUIRMENTS

1. Project Goal: The Contractor shall provide a Multispectral Scanning System that advances the Library’s capabilities in the digital scanning of photographic images. The Multispectral Scanning System shall reproduce photographic images with a high degree of accuracy beyond what is currently available when traditional digitization technology is used.

2. Technical Approach: The contractor shall offer an advanced Multispectral Scanning System for color photography, scanning color photographs with reproduction of reflective and transmissive materials as the human eye perceives color.

3. Operational Approach: Operation of the Multispectral Scanning System should not require extensive image capture and processing as is typical of a 20+ band scientific multispectral imaging system. Image capture is not intended to be the starting point for extensive analysis of potential combinations of spectral band captures. The system should function more like a typical RGB capture with additional channels of capture, processing out with minimal operator intervention.

4. Efficiency of Operation: The Multispectral Scanning System shall achieve a production level better than 10 captured and fully processed images per hour.

5. Multispectral Scanning System Components: The contractor shall provide a complete imaging system, including illumination, capture device and related accessories, appropriate workflow and color conversion and analysis software and hardware. The Contractor shall supply appropriate carriers, as needed, for holding typical sizes/formats of originals.

6. Training and Support: The contractor shall provide training and support as follows:

On-site training for up to six Library staff, to be provided directly following the system installation Training manuals and other aids as appropriate Remote support services via telephone or website during the warranty period

C.3.2. TECHNICAL SPECIFICATIONS

FADGI 3 Conformance. The scanning system must meet FADGI 3 specifications, as documented for Prints and Photographs in the most recent version of the FADGI Technical Guidelines for Digitizing Cultural Heritage Materials. (These are found at:

www.digitizationguidelines.gov)

The Contractor shall supply a scanner, computer workstation(s), and related software for image capture and image processing for creating high-resolution, high-quality spectral images spanning the visible electromagnetic spectrum.

The provided multispectral scanning system shall encompass the following technical specifications:

Reflective Imaging.

• Original image sizes from 2” x 2” to 30” x 40”

• 400 ppi at 18” x 24”

• 600 ppi at 14” x 19”

• 1000 ppi at 8” x 10”

• 2000 ppi at 4” x 5”

Transmissive Imaging.

• 4000 ppi at 35mm

• 2000 ppi at 4” x 5”

• 1000 ppi at 8” x 10”

Light Sources. The multispectral scanning system shall include appropriate light sources for both reflective and transmissive imaging. Lighting must be even across the image field, corrected with “flat fielding” as appropriate to pass FADGI 3 requirements for evenness of field.

Tonal or AD converter resolution. The multispectral scanning system shall support conversion of the spectral imaging data to 8-bit and 16-bit grayscale, RGB and to L*a*b*.

Dynamic range. The multispectral scanning system shall support a minimum 3.2 density range for reflective materials and

4.0 for transmissive materials.

File Formats. The multispectral scanning system shall be capable of outputting the following file formats at a minimum:

• TIFF – uncompressed

• JP2 – lossless and lossy

• JPEG

Metadata. The multispectral scanning system shall be capable of:

• Collecting and recording technical, administrative, and descriptive metadata in EXIF and XMP data structures as appropriate, including ICC color management information

• Importing and recording metadata from an external source (e.g., descriptive metadata from a supplied CSV file or database)

• Delivering digital images with associated metadata embedded with the image or as a sidecar file.

C.3.3. VUNERABILITIES AND CONTRACTOR RESPONSE

Software used by the Library is subject to routine security scanning whether hosted internally or externally as part of the Library’s continuous security monitoring program. These security scans may result in the identification of software security vulnerabilities in connection to the scanning system provided by the contractor under this contract. The COR will inform the contractor in writing if the Library finds any security vulnerabilities in the provided Multispectral Scanning System.

The contractor shall mitigate any security vulnerabilities within the following timeframes after receiving written communication from the COR:

Upon written notification of a security vulnerability, the contractor shall take steps to correct the vulnerability within the above timeframes, including code modification, testing and installation on all Library instances of the software. The contractor shall also provide documentation, such as release notes, installation guides and user guides, documenting the changes made to the software to address the identified vulnerability. Costs associated with addressing software security vulnerabilities are not reimbursable separately and should be included as part of the contractors quote for providing the Library the software licenses or software maintenance. The Library will not separately reimburse the contractor for the cost of addressing security vulnerabilities.

C.3.4. HARDWARE AND SOFTWARE PRODUCTS

The contractor shall provide the end-of-support date for the following hardware and/or software product(s) being procured under this contract, which are the following:

(a) Performance of work under this contract is subject to the technical direction of the COR. The term “technical direction” includes, without limitation, direction to the contractor that directs or redirects the labor effort, shifts the work between work areas or locations, and/or fills in details and otherwise serves to ensure that tasks outlined in the contract are accomplished satisfactorily.

(b) Technical direction must be within the scope of the contract specification(s)/work statement. The COR does not have authority to issue technical direction that:

(1) Constitutes additional work outside the contract specification(s)/work statement;

(2) Constitutes a change as defined in the “Changes” clause of this contract;

(3) Causes an increase or decrease in the contract price, or the time required for contract performance;

(4) Changes any of the terms, conditions, or specification(s)/work statement of the contract;

(5) Interferes with the contractor's right to perform under the terms and conditions of the contract; or

(6) Directs, supervises or otherwise controls the actions of the contractor's employees.

(c) Technical direction may be oral or in writing. The COR must confirm oral direction in writing within five workdays, with a copy to the Contracting Officer.

(d) The Contractor shall proceed promptly with performance resulting from the technical direction issued by the COR.

If, in the opinion of the contractor, any direction of the COR or the designated representative falls within the limitations of (b) above, the contractor shall immediately notify the Contracting Officer no later than the beginning of the next Government work day.

(e) Failure of the Contractor and the Contracting Officer to agree that technical direction is within the scope of the contract shall be subject to the terms of the “Disputes” clause of this contract.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records— Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

K.1 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—COMMERCIAL

PRODUCTS AND COMMERCIAL SERVICES (MAY 2022)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision—

Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
