Non-Competitive Memorandum for Simplified Acquisition Actions
This is a Non-Competitive Memorandum for Simplified Acquisition Actions submitted by the Department of Justice, Bureau of Prisons at FCI Cumberland. The memorandum justifies a sole source acquisition for comprehensive medical services required to support the inmate population at the facility.
The required services include inpatient/outpatient medical, dental, and mental health care provided through purchase orders. Services encompass Inpatient/Outpatient Facility and Physician services, as well as Outpatient Institution Services of Dentist, Dietician, Pharmacist, and Optometrist. The performance period is January 1, 2026, through January 31, 2026, with an estimated value of $300,000.00. The incumbent contractor, American Correctional Healthcare, Inc. (ACH), is being continued under this interim sole source acquisition pending execution of a new multi-year agreement by the Field Acquisition Office. The justification emphasizes that ACH's established medical network, continuity of care capability, and seamless service delivery without lapses are critical to preventing disruption to the institution's medical mission and patient care. The memorandum asserts that while comprehensive medical services are available in the commercial marketplace, ACH is the only provider able to ensure immediate service delivery without any lapse in performance, making the sole source award appropriate under 41 U.S.C. 253 and 41 U.S.C. 1901(e).
