About this file

This is a Single Source Determination document using Simplified Acquisition Procedures (SAP) for a federal contract action not exceeding the simplified acquisition threshold.

The Department of Commerce, NOAA Acquisition and Grants Office (Western Acquisition Division, Alaska Fisheries Science Center, and Resource Ecology and Fisheries Management Division) requires Bruker OPUS software to operate Fourier transform near infrared spectrometers for scanning otoliths to predict fish ages in support of Magnuson-Stevens Act stock assessment requirements. The current software is no longer supported for Windows 11, necessitating an upgrade to maintain IT compliance and continue instrument operation. The sole source identified is Bruker Corporation, located at 40 Manning Road, Manning Park, Billerica, MA 01821, USA (telephone: +1 (978) 439-9899 or +1 (978) 663-3660). The justification for sole source procurement is based on two factors: functional compatibility requirements, as the Bruker OPUS software upgrade is a direct upgrade within the same software ecosystem that integrates seamlessly with existing laboratory hardware and protects historical data integrity, and Bruker's status as the proprietary developer and exclusive vendor of OPUS software with no alternative third-party products available. Market research confirmed no other company or vendor sells the OPUS software. The determination was certified by Derek Chamberlin (Supervisory Research Fisheries Biologist) on 6/25/26, approved by Robert Roy (Director, AFSC) on 6/25/2026, and determined by Jason Jenks (Contracting Officer) on 7/13/2026.

SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), Western Acquisition Division, Alaska Fisheries Science Center (AFSC) and Resource Ecology and Fisheries Management Division (REFM)

2. Description of supplies or services required to meet agency needs (including the estimated value). This software is needed to operate Fourier transform near infrared spectrometers to scan otoliths to predict ages for use in stock assessment in support of MSA requirements. The current software is no longer supported for Windows 11, thus we must upgrade to maintain IT compliance and continue instrument operation.

3. Identification of the single source or the brand name to be solicited. Bruker Corporation, 40 Manning Road, Manning Park, Billerica, MA 01821, USA, +1 (978) 439-9899 or +1 (978) 663-3660

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

Compatibility to existing systems or equipment - The procurement of this Bruker OPUS software upgrade is functionally mandatory to ensure seamless compatibility with our existing laboratory infrastructure. Because it is a direct upgrade from our current, older version to the newer version within the same software ecosystem, it integrates perfectly with our established hardware. Any alternative, third-party software is entirely incompatible and will not work with our instruments. Utilizing this specific upgrade protects the integrity of our historical data and prevents critical operational failures, allowing our fish age production workflows to continue without disruption.

Other - Only one source is capable - This procurement qualifies as a sole source acquisition because Bruker is the proprietary developer and exclusive vendor of the OPUS software. No other external vendor, manufacturer, or third-party distributor sells, licenses, or supports this specific platform. Because our laboratory requires this exact software to interface with our current instrumentation for fish age production, no alternative product or vendor can fulfill this operational requirement.

5. Market Research.

Our market research has been unable to find any other company/vendor that sells the OPUS software.

6. Technical/Requirements Representative Certification

I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.
