About this file

This justification document approves the use of other than full and open competition for an Architect/Engineer follow-on services contract with Elevar Design Group, Inc. The U.S. Environmental Protection Agency's Office of Acquisition Solutions in Cincinnati, Ohio requires Elevar to complete A/E services for the seawater pumps system relocation construction project at the agency's Narragansett, Rhode Island facility. Elevar currently serves as the designer of record through an expired contract and has provided a design change bulletin to address issues discovered during pump testing. The follow-on contract will cover Elevar providing construction administration and inspections through project completion scheduled for October 2023 since extending the current task order beyond June 2023 is not feasible.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 41 U.S.C. 253(c)(1).

1. Identification of the agency and the contracting activity.

The U. S. Environmental Protection Agency’s Office of Acquisition Solutions is processing the requirement. The contracting office is the Cincinnati Acquisition Division located in Cincinnati, OH.

2. Nature and/or description of the action being approved.

Architect/Engineer (A/E) follow on services for a Seawater Pumps System Relocation Construction Project at ORD facility Narragansett, RI. The action being approved is for a firm fixed price contract with Elevar Design Group, Inc. to complete the A/E follow on services because the current task order 68HERC20F0042 under expired contract EP-C-17-028 cannot be extended beyond June 30, 2023.

3. A complete description of the supplies and/or services required to meet the agency’s needs, including the estimated value.

Elevar Design Group, Inc. has been providing A/E follow on services for Seawater Pumps System Relocation Construction Project at the ORD Narragansett, RI facility. During testing of the new sea water pumps it was discovered the installed seawater pumps do not have the capability to lift water out of the bay. EPA has moved ahead with Elevar to provide a change bulletin design for vacuum system to pull the water all the way to inlet of centripetal pump. The current A/E, Elevar, has provided a correction via the change order process which is pushing the period of performance past the current period of performance June 2023. It is not in government’s best interest to bring a new A/E into the project because Elevar is the risk designer of record for the change bulletin. Elevar is currently providing the A/E services during the construction phase of the project. The A/E will provide contract administration services and inspections during the remaining construction phase which is currently scheduled to be completed by October 2023.
