OFFICE OF ACQUISITION MANAGEMENT
Limited-Sources Justification (LSJ)
Orders or BPAs Exceeding the Simplified Acquisition Threshold J&A-20-0289
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of the Office of the Chief Information Officer (OCIO), proposes to extend a Blanket Purchase Agreement (BPA) Call Order pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved.
(a) Type of action: Firm-fixed-price Call Order modification
(b) Amount the current J&A is justifying: $575,598.10
(a) (c) Brief Description: OAQ intends to issue a sole source modification under BPA Call Order No.: HSCETC-17-F-00010 for support of IT strategic planning, integrated governance, portfolio management, and surges, as needed to continue Homeland Security Investigations (HSI) Portfolio Management services from the following company—
Booz Allen Hamilton Inc. (BAH) 8283 Greensboro Dr.
McLean, VA 22102
DUNS: 006928857
3. Description of Supplies/Services.
The proposed modification is to provide continued HSI Portfolio Management support at a total cost of $575,598.10, for five months, inclusive of a two (2) month extension and three
(3) one-month option periods. The HSI Portfolio Management contract supports the ICE Office of the Chief Information Officer (OCIO)/Solutions Delivery Division (SDD)/HSI Information Technology (IT) Portfolio Delivery Branch by providing oversight, support, and delivery of IT services and solutions in furtherance of HSI’s operational mission. Three additional one-month options will be included and exercised as necessary depending on the amount of transition time required relative to the follow-on contract.
BAH is currently providing IT Portfolio Management services in support of HSI and its IT Portfolio Delivery Branch. These services include providing support for IT strategic planning, integrated governance, portfolio management, and surges, as needed. IT strategic planning support services include managing, maintaining, and refining the HSI IT Strategic Plan for the HSI IT Ecosystem, according to HSI-wide priorities. Integrated governance support includes managing the HSI IT Portfolio Governance Model Lifecycle and associated
Orders or BPAs Exceeding the Simplified Acquisition Threshold J&A-20-0289 processes to continuously integrate HSI-wide priorities with ICE and OCIO initiatives.
Portfolio management support includes technical project monitoring and control activities for portfolio management projects, including management of scope, budget/cost, risks/issues and schedule. Options 4 through 7 were issued as bilateral modifications under the commercial items changes clause. ICE publicized a limited-sources justification, dated 03/04/2020, prior to incorporating options 4 through 7 into the Call Order. This action increased the total value of the Call Order by $695,718.80. As a result of the proposed modification, the BPA Call Order value will be increased from $6,448,175.57 by $575,598.10 to $7,112,773.38.
4. Authority and supporting rationale and a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Authority:
Select only one of the following circumstances justifying limiting sources pursuant to FAR 8.405-6(a)(1)(i) below and demonstrate the proposed contractor’s unique qualifications to provide the required supply or service.
8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays.
8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
Rationale:
The ICE Homeland Security Investigations (HSI) directorate is a critical asset in the ICE mission, responsible for investigating a wide range of domestic and international activities arising from the illegal movement of people and goods into, within, and out of the United States. HSI uses its legal authority to investigate issues such as immigration crime, human rights violations, and human smuggling; smuggling of narcotics, weapons, and other types of contraband; and financial crimes, cybercrime, and export enforcement issues.
HSI’s Portfolio Management team is a vital resource in executing the HSI mission. This team is responsible for supporting data warehousing and the IT Portfolio Delivery Branch, which are essential to HSI’s investigative operations. BAH currently provides critical support to this team. HSI relies on the Portfolio Management Program to support its investigations of a wide range of illegal activities under its purview.
On November 3, 2016, ICE issued BPA Call Order number HSCETC-17-F-00001 off ICE BPA HSCETC-15-A-00001. The BPA was awarded to the schedule contract holder, Booz Allen Hamilton, Inc., under FAR subsection 8.405-3. Call Order HSCETC-17-F-00001 consisted of a base and three twelve-month options. This order expires on September 9, 2020.
Although the Government has identified several contractors through its market research with the capabilities to perform Portfolio Management services, BAH is the only contractor capable of performing these services during the transition-out period. The anticipated Call Order extension will maintain continuity of operations for HSI’s Portfolio Management by allowing the incumbent contractor to transition-out in the event that a new awardee under a new task order may assume performance of the services. Although the Government intends to award a recompeted task order by September 2020, the Call Order extension includes options for up to five-months to allow for overlap and ensure that the Government will not risk a gap in service.
BAH is uniquely positioned to sustain continuity of support for the HSI Portfolio Management given that the contractor has been supporting this program for the last four years. By allowing BAH to perform the transition-out services, the Government thereby lessens the risks of duplicative costs and degraded support. BAH is the only contractor with
Orders or BPAs Exceeding the Simplified Acquisition Threshold J&A-20-0289 the requisite knowledge and capabilities to perform the needed services over the period of performance, the maximum potential length of which is six-months. Due to the specialized nature of ICE’s mission and the sensitive data associated with this requirement, no other concern would be able to perform the support services required during the transition-out period leading up to a new award due to the timing of the recompete, which is currently being procured.
For this reason, it was determined impractical to solicit and award a contract action for this transition-out period because the services are highly specialized and only capable of being performed at this time by the incumbent. First, it would not be possible to award the recompete in time to cover the transition-out period, and second, it is not feasible to have a new contractor perform it because of the limited amount of time available to procure this action.
BAH already has the security clearance and familiarity with the requirement to continue performance at the current standard until a new awardee is selected through the re-competition. The time required for a new contractor to setup a support environment for HSI Portfolio Management may result in an interruption in services, impacting the agency’s mission. Accordingly, it is in the best interest of the Government to issue this short-term contract while ICE finalizes the documents to issue a competitive solicitation for a new contract award.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The Contracting Officer anticipates the proposed price will be the best value as the additional services required will be at the same level-of-effort as the Option Periods in which they are being proposed. Further, the CO will compare quoted pricing to Booz Allen Hamilton Inc.’s current contract. This extension is planned to continue all operations as they are currently, utilizing the current rates.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
ICE conducted extensive market research as part of the acquisition planning for the competitive solicitation, including the release of a Request for Information (RFI) in February 2020 and surveying of the larger marketplace. The research indicates there are multiple vendors representing the requisite capabilities to perform the work. Although ICE identified vendors on GSA Schedule that can provide these types of services, BAH is the only one with cleared personnel having the necessary knowledge, gained through years of supporting the program for the duration of the recompete period. A new Independent Government Cost Estimate (IGCE) was completed for this additional work utilizing the same methodology of the PTSS BPA blended rates to support the IT Portfolio Management support work. It is
Orders or BPAs Exceeding the Simplified Acquisition Threshold J&A-20-0289 anticipated that there will be no rate change as a result of this extension.
7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.
ICE is currently competing this requirement on the NIH NITAAC CIO-SP3 Small Business contract vehicle. An RFP was released in July 2020, and the milestone schedule contemplates ICE awarding a new contract with a target date of 9/30/2020.
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.
The competitive procurement for these services is anticipated to be awarded in the 4th quarter of FY 20. Therefore, the extension of support on BPA Call Order # HSCETC-17-F- 00010 will provide the critical coverage of support until ICE can transition this requirement to the new contract. Once the new contract is competitively awarded and transitioned, ICE will no longer require Portfolio Management support from BAH and will eliminate the need for any subsequent limited sources acquisitions.
9. DHS intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2)(i).
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
