About this file
This is a construction specification document issued by the Texas Department of Transportation (TxDOT) for the removal and/or replacement and/or disposal of a railroad bridge overpass on Interstate Highway 37, located approximately 1.20 miles west of State Highway 358 at the Old Union Pacific Railroad (UPRR) Overpass in Nueces County, Texas. The project involves the demolition and removal of the existing railroad bridge structure that spans over IH 37. The specification document outlines the technical requirements, standards, and procedures that contractors must follow to execute this removal work in compliance with Texas transportation standards and applicable regulations. The solicitation invites qualified contractors to bid on this State Let Construction Contract, with the work to be completed according to TxDOT's engineering specifications and project scope.
The document establishes the detailed technical and contractual requirements governing how the contractor must perform the bridge removal work, including demolition procedures, material disposal requirements, traffic control measures, and safety protocols. Specific pricing terms, set-asides, contract award dates, and performance timelines are contained within the related solicitation documents. Contractors responding to this opportunity must review both the specification document and the primary solicitation notice to understand all bid submission requirements, evaluation criteria, and project deadlines.

ITEM 6
IH 37 Railroad Bridge over main lanes (NBI: 16-178-0074-06-095) contains confirmed hazardous materials, including lead-based paint and asbestos-containing materials (ACMs), which require regulated abatement. Laboratory testing verified that the lead concentration in the paint sample taken from the steel girders is 0.016% (160 ppm), which exceeds the TxDOT abatement threshold of 90 ppm. In accordance with Special Provision to Item 6, Article 6.10, when hazardous paint coatings must be removed to allow for dismantling, the Contractor is responsible for the removal in compliance with Item 5011.
Painted steel that is to be dismantled by unbolting will not be cleaned by TxDOT. Additionally, asbestos sampling by J3 Resources confirmed that 3 of 9 samples exceeded 1% asbestos, including approximately 550 SF of black caulk at the former railway flashing, containing 8% chrysotile asbestos.
The Contractor must notify the Engineer at least 30 days in advance of any demolition involving ACMs to allow for proper notification to the Texas Department of State Health Services (DSHS), as required by NESHAP and TAHPR. Contractor is responsible for complying with all OSHA standards and regulations, and responsible for the health and safety of all employees, contractors, and subcontractors on this project.
For asbestos abatement work, provide personal or subcontractors that are licensed, registered, or accredited by the Texas Department of State Health Services (DSHS) and insured for the appropriate asbestos related activity.
Provide an on-site supervisor, or ensure the subcontractor has a supervisor, meeting the requirements under OSHA for a “competent person” for all work involving ACM where the asbestos content is greater than 1%. The competent person must be familiar with and experienced in asbestos abatement and other related work and must enforce the use of all safety procedures and equipment. The supervisor must be knowledgeable of all EPA, OSHA, and NIOSH requirements and guidelines. Provide documentation of the supervisor’s qualifications to https://www.txdot.gov/inside-txdot/forms-publications/consultants-contractors/publications/bridge.html#design https://www.txdot.gov/inside-txdot/forms-publications/consultants-contractors/publications/bridge.html#design the engineer.
Submit required notifications to DSHS. Assume responsibility for ensuring that all required notifications are submitted by the deadlines and in the manner required by DSHS. Provide copies of all required notifications to the Engineer. No time extensions or suspension of the charges will be made for failure to submit timely notifications or revised notifications.
The Contractor shall not introduce hazardous materials to the project and is responsible for removal and disposal of any hazardous materials introduced by their activities. Materials are to be stored in a safe location outside TXDOT property or right-of-way, unless otherwise approved by the Engineer. Costs for testing and removal of contractor-provided materials will not be compensated.
ITEM 7
The work performed for Item 7.2.4, “Public Safety and Convenience” will not be measured or paid for directly but will be subsidiary to pertinent Items.
The total disturbed area for this project is 0 acres. The disturbed area in this project, all project locations in the Contract, and Contractor project specific locations (PSLs), within 1 mile of the project limits, for the Contract will further establish the authorization requirements for storm water discharges. The Department will obtain an authorization to discharge storm water from the Texas Commission on Environmental Quality (TCEQ) for the construction activities shown on the plans. The Contractor is to obtain any required authorization from the TCEQ for any Contractor PSLs for construction support activities on or off ROW. When the total area disturbed for all projects in the Contract and PSLs within 1 mile of the project limits exceeds 5 acres, provide a copy of the Contractor NOI for PSLs on the ROW to the Engineer.
