About this file

This document is a Justification for an Exception to Fair Opportunity for the Department of Commerce, NOAA Office of Marine and Aviation Operations. The procurement is for two sets of Moving Vessel Profiler (MVP-200) cables and junction boxes, to be installed on the Bell M. Shimada and Reuben Lasker ships, with a total purchase value of $28,512. The system allows real-time collection of multiple data parameters simultaneously, including Conductivity, Temperature, Depth, Chlorophyll, Turbidity, Colored Dissolved Organic Matter, and Oxygen.

The justification indicates that AML Oceanographic, LTD is the sole vendor capable of providing these unique and highly specialized components, with no alternative suppliers available. The contracting officer has determined that these specific components are critical to the MVP-200 system's operation and are essential for mission-critical operations. The document is approved by the Contracting Officer Katie Watkins-Brandt on 7/24/2025, utilizing the exception under FAR 16.505(b)(2)(i) for sole source procurement.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

FOR AN ORDER OVER THE MICRO-PURCHASE THRESHOLD AND

UP TO THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 16.505(b)(2)(i))

PR # 140802-25-0642

1. Agency and contracting activity. Department of Commerce, NOAA Office of Marine and

Aviation Operations, Acquisition, Analysis, and Accountability Branch

2. Description of supplies or services required to meet agency needs (including the estimated value).

The Moving Vessel Profiler is a profiling system that allows for the real-time collection of data while the ship is underway. The MVP-200 allows the user to collect multiple different parameters simultaneously, including but not limited to Conductivity, Temperature, Depth, Chlorophyll, Turbidity, Colored Dissolved Organic Matter, and Oxygen. These cables and junction boxes are required to interface between the deck unit and MVP. The request is for two sets, one to be installed on the Bell M. Shimada and one on the Reuben Lasker. Given the MVP will be shared across these two platforms, two sets of cables are required to ensure seamless deployment and operational efficiency. This will allow ship crews to maintain a permanent cable run on the ship, therefore when the MVP is requested, the installation will be limited to the MVP Controller and MVP unit. Total value of purchase is $28,512.

Identification of the awardee to be solicited.

3. Authority and supporting rationale. The contracting officer has determined the circumstances of the contract action to meet the following statutory exception under FAR 16.505(b)(2)(i) as supported below:

Only one awardee is capable - FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

No other vendor provides the junction boxes or interface cables, they are unique to the MVP-200 system and AML Oceanographic, LTD is the only vendor of the system. Without these specific components the MVP-200 system will not be able to operate which will indefinitely delay operations where this unit is mission critical.

4. Market Research.

These units are only available through the distributor AML Oceanographic LTD. There are no other vendors that supply the supporting infrastructure for existing MVP systems, cables and junction boxes are internal components are unique to these systems.

As such, this justification is approved.
