About this file
This is a Justification for an Exception to Fair Opportunity (JOFOC) document for the Department of Commerce NOAA Ship Henry Bigelow, requesting brand name replacement parts for an Oily Water Separator (OWS) system in the ship's engine room. The estimated value is $22,000 for specific parts from Alfa Laval and GEA manufacturers.
The required parts include 2 Operating Slides (545654-02AL), 1 Inlet Pipe with Paring Disc (561272-80AL), 2 Flat Belts 60 Hz (260169-23AL), 1 Bowl Disk (559714-82AL), 2 Solenoid Valve Assemblies (0018-7614-000GEA), 1 Low Pressure Hose (0018-7943-000GEA), and 1 additional Low Pressure Hose (0018-7940-000GEA). The justification cites that OWS is a critical system under OMAO policy 0602, and brand name parts are required to ensure correct and safe function of the system, with maintenance lapsing or parts breaking resulting in a no-sail condition.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY FOR AN ORDER EXCEEDING $3,500 AND UP TO THE SIMPLIFIED ACQUISITION THRESHOLD (AUTHORITY: FAR 16.505(b)(2)(i))
1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), NOAA Office of Marine and Aviation Operations, Acquisition, Analysis, and Accountability Branch. Procurement for NOAA Ship Henry Bigelow
2. Description of supplies or services required to meet agency needs (including the estimated value).
NOAAS Henry B. Bigelow requires replacement parts for the Oily Water Separator in the Engine Room on board the ship. These replacement parts need to meet the manufacturer specifications for the unit. The estimated cost with shipping will be about $22,000 per market research. These units are needed as soon as possible to meet ship’s sailing schedule and equipment maintenance schedules.

3. Authority and supporting rationale. The contracting officer has determined the circumstances of the contract action to meet the following statutory exception under FAR 16.505(b)(2)(i) as supported below:
Brand name - Oily Water Separators (OWS) are critical components to engine room function and are highly regulated in both use and maintenance. The parts associated with these units are specific to the unit itself and the vendor above meets these requirements to ensure correct and safe function of the OWS. Alfa Laval and GEA are highly specialized parts to ensure safe continued operation of our OWS on board and can provide them in a timely manner. OWS is a listed “critical system” and maintenance lapsing or parts breaking are a no sail as dictated by OMAO policy 0602.
