The Consultant shall perform the following services with the Douglas County Land Acquisition Coordinator overseeing all aspects of the Right of Way phase.
Title Search/Preliminary Title/Owner Verification: A title search involves a comprehensive, often 50-year review of public records in the Superior Court clerk's office to identify legal owners, liens, and encumbrances. A Preliminary Title Report (PTR) is required for Douglas County projects to identify owners.
Closing/Final Title Certificate: Georgia law dictates that a licensed attorney must oversee all real estate closings, ensuring expertise in land transfer and title work. The closing will finalize the transfer of property needed for the transportation project. A Final Title Certificate and a completed closing statement must accompany each deed.
Condemnation: Douglas County prefers buying property by deed, but as a last resort, may file a condemnation lawsuit in county superior court if negotiations fail, using a Declaration of Taking to gain immediate ownership. Using legal descriptions, plans, plats, appraisals, etc. supplied by the Douglas County Land Acquisition Coordinator, the Attorney shall prepare the Petition and proceed with corresponding condemnation tasks (declaration of taking, deposit estimated compensation, oversee serving the petition to the property owner, file the petition with the County superior court, list the petition in the County legal organ, receive and review appeal(s), etc.)
Final Right-of-way Certification: The final right-of-way (ROW) certification confirms all property rights, easements, and right-of-entries are acquired, and relocations are complete, ensuring compliance with federal/state laws and that all legal titles are secured, and allowing construction to begin.
