Control No. 19-053C

-1- Revision 1, dated 13 Apr 09

SOLE SOURCE JUSTIFICATION

1. Agency/Contracting Activity: MICC Carlisle Barracks

2. Description of Action:

Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time & Materials Cost

Funds: OMA Other Funds:

Name of Proposed Contractor(s): The Senator Group Street Address: 4111 N. Jerome Rd. ATTN David Crimmins City, State, Zip: Maumee, OH 43547 Phone: 563-275-8347 / 419-887-5806 E-mail: DCrimmins@thesenatorgroup.com

3. Description of Services or Supplies:

The total estimated value of the proposed action is $73,316.00.

These Cell Pods are required for collaborative spaces and executive office space that meets fire and HVAC requirements while maintaining privacy required for collaborative spaces and office space for a General Officer.

4. Authority: Action using simplified acquisition procedures (select one):

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization)

5. Reasons for Authority Cited: Mission critical items that fit the requirements for library collaborative spaces and an office space for the USAWC Deputy Commanding General for Reserve Affairs. These cell pods accommodate privacy considerations while the Ecophon Opening Acoustic Ceiling Kit incorporates a patented Air Flow Circulation System that eliminates the need for costly A Wing and Library modifications to the existing HVAC system. The proprietary ceiling also includes overhead LED Lighting controlled by PIR motion detection sensor which again eliminates costly room modifications. Finally, and of significant importance, the patented ceiling utilizes an opening roof that can be activated by smoke detector, manually, or loss of power which eliminates fire detection/ suppression modifications to A Wing and Library spaces. This roof is patented under US Patent Application No. 16/171,015.2 and is required to avoid costly construction that will be lost when the new academic facility is completed. These products also has the potential for reutilization after the new academic facility is constructed and occupied.

-2- Revision 1, dated 13 Apr 09

6. Actions to Increase Competition: The Senator Group brand name cell pod library and executive office solution is required as a result of contemporary research of similar resource solutions. The patented ceiling is key to HVAC and Fire Detection space requirements and was not found to be available in other models of competing products.

7. Market Research: The Senator Group cell pod has been specifically chosen based on research and observation of numerous competing products. After an extensive review of numerous products and consultation with UNICOR representative who determined they do not offer a product to meet the requirement, it has been determined that the Senator Group cell pod is the only product that will meet the specific requirement posed by the existing space within the Root Hall A wing.

8. Procurement History: No known history with The Senator Group
