Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity: Mission and Installation Contracting Command (MICC) White Sands, White Sands Missile Range (WSMR), New Mexico.
2. Description of Action: Approval is requested to purchase supply items that are sole source to Thermo Eberline LLC, the original equipment manufacturer. The contract type is Firm Fixed Priced
3. Description of Supplies/Services: The following supply items, Digital Area Monitors and Ion Chambers (DAM-Ion) provides radiation safety equipment in support of the Survivability, Vulnerability and Assessment Directorate (SVAD) Fast Burst Reactor (FBR) requirements. This equipment provides criticality alarms systems of SVAD Personnel in the Neutron testing and combined environment testing that support the Strategic Missile Defense Program.
The breakout is as follows:
Digital Area Monitor Part Number RMS3C4 – 18 Each Ion Chamber Part Number DA1-8CCR3 – 10 Each Ion Chamber Part Number DA1-8CCR1 – 8 Each Shipping Costs
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Reason for Authority Cited: Thermo Fisher Scientific dba Thermo Eberline LLC is the original equipment manufacturer of DAM-Ion Chamber unique-highly specialized Radiation Safety Equipment that has been supported under previous contracts W9124Q-09-P-0125 and W9124Q-12-P-0063 and can support the immediate requirement of SVAD’s FAST BURST REACTOR Neutron and Combined Environmental test missions.
Thermo Eberline LLC radiation safety equipment is no longer being manufactured nor are replacement parts being produced. This instant procurement is a volume purchase of the DAM- Ion Chamber radiation safety equipment. As a result, Thermo Eberline LLC has offered a significant discounted purchase price to the Government, which they did provide their catalog price of these items sold to the public.
Other vendors that manufacture this type of equipment, Ludlum Measurements Inc., and Fluke Biomedical Inc., could not meet the radiation measurement ranges that are required by SVAD WSMR, New Mexico. More specifically, SVAD’s required Radiation Measurement Range is ten thousand (10,000) RADS per hour.
Whereas, Thermo Eberline LLC Digital Area Monitor can meet the required ranges with one monitor.
6. Efforts to Obtain Competition: A Sources Sought Synopsis (SSS) DAM-Ion Chamber Salient Performance Characteristics were posted on the FedBizOpps website July 27, 2016 with an August 24, 2016 response date under [Digital Area monitor Model RMS3C4 Ion Chamber Model DA1-8CCR3, and DA1-8CCR1 – 0010871991]. There were no responses from any interested parties. The results were filed in PCF database under PANMCC-17-P-0000-038418
7. Actions to Increase Competition: As indicated in paragraph 6 above, no parties responded to the Sources Sought Synopsis.
8. Market Research: Early on and continuous market research would be required for the follow-on requirement to determine if capable sources could meet SVAD’s requirements. Test missions are scheduled months in advance to ensure range assets for telemetry, cameras, radar, etc. are available and in the proper location on the 3200 square mile range to adequately support the mission. Due to the physical size of the range, multiple tests occur simultaneously as long as they do not interfere with each other or violate safety concerns. Any delay or intermediate change of the Contractor will require a phase-in/phase-out period of at least 30 days to allow a new contractor to be brought up to speed on WSMR test procedures to permit a safe hand-off of support for ongoing tests. More importantly, the disruption of test missions caused during transition would result in an unacceptable delay and negatively affect WSMR's critical test mission. Any break in the services provided under the existing contract, risks significant delays in delivery of critical equipment under test. Any delays caused by transition and learning curve must be minimized.
9. Interested Sources: No interested sources were received in response to the synopsis posted on FedBizOpps on 27 July 2016.
10. Other Facts:
