About this file

This is a Request for Proposal (RFP) issued by the Oregon Department of Transportation (ODOT) for marketing, advertising, and communication services related to the Amtrak Cascades passenger rail route, a partnership between ODOT and the Washington State Department of Transportation (WSDOT). ODOT seeks one or more consultants to develop and execute a comprehensive marketing plan to optimize ridership on the Amtrak Cascades service, which operates between Vancouver, British Columbia and Eugene, Oregon. The services include creating and delivering content across multiple marketing channels, maintaining the Amtrak Oregon website, and potentially developing a financial model for revenue-generating content. The RFP announcement and all documents are published in the OregonBuys eProcurement system. Questions and requests for clarification must be submitted 10 calendar days prior to the bid opening date. The proposal submission deadline is specified in OregonBuys. No pre-proposal conference will be held. The agency anticipates issuing a Notice of Intent to Award approximately three weeks following the bid opening date, with an award protest period of seven calendar days thereafter. The initial contract term is two years with options to renew for a cumulative maximum of ten years.

The annual budget for the initial two-year term is $250,000. All fully loaded hourly rates submitted in the price proposal must remain in effect for at least the first twelve months of the contract. Proposers must demonstrate prior experience completing an advertising campaign for a public agency within the last five years and having completed a project with a total contract spend of at least $200,000 within that timeframe. ODOT has established a Certified Small Business aspirational target of twelve percent to encourage prime contractors to subcontract with certified firms. Proposals will be evaluated on four criteria: project management plan (55 points), experience on similar projects (50 points), key staff qualifications and availability (50 points), and presentation and clarity of proposal (45 points), followed by a price evaluation worth up to 50 points, for a total of 250 possible points. All proposals are public records subject to inspection after the Notice of Intent to Award is issued. Vendor registration in OregonBuys is required, and proposers must comply with Oregon tax laws and nondiscrimination requirements.

WSDOTWashington State Department of Transportation

OVERVIEW AND PURPOSE

Agency Overview and Background The Oregon Passenger Rail Program—Amtrak Cascades—provides efficient and accessible intercity passenger rail service from Vancouver, British Columbia to Eugene, Oregon. Amtrak Cascades is a partnership between ODOT and the Washington State Department of Transportation (“WSDOT”) who contract with Amtrak to provide service. Oregon has experienced record ridership with year-over-year gains since 2021 when twice daily service between Seattle and Eugene was restored. Beginning in 2026, a new fleet of trains will be phased in with eight new trainsets and 2 new locomotives. In the next 5 years, ODOT anticipates potential service increases, as well as infrastructure improvements along the route, which could have temporary service impacts.

Project Overview, Background and Purpose The purpose of this Project is to develop and deliver valuable, relevant, and consistent content across multiple channels to attract and retain riders and inspire them to book a trip in Oregon via Amtrak Cascades. Valuable content includes information riders need (such as how to travel with a bike), and relevant content includes timely updates and information (such as seasonal promotions (e.g., “game train”)). Content should be consistently delivered and updated with sufficient frequency for information retention and clear brand association. Content should also be creative, inclusive, and use plain language.

ODOT has 3 primary objectives for this Project:

1.Support continued ridership increases by inspiring current customers to take an additional rail trip on the new train fleet, as well as inspiring new riders.
2.Increase customers’ confidence in using Amtrak Cascades service.
3.Increase Oregonians’ exposure to and awareness of Oregon rail as a relaxing way to experience the Pacific Northwest and an alternative to driving.

Consultant may be asked, at ODOT’s discretion, to create a financial model featuring revenue streams that will support the marketing strategy, with the goal of making the pool of content self-supporting.

Currently, ODOT and WSDOT have separate Amtrak Cascades websites. It may be decided to combine the websites to have one that addresses both states’ needs. Consultant may be required to work with WSDOT to accomplish this goal.

SCOPE OF WORK/SPECIFICATIONS

ODOT’s Public Transportation Division is seeking one or more consultants to provide Marketing, Advertising, and Communications Services for Amtrak Cascades. The services that the awarded Proposer is expected to perform includes, but is not limited to, assisting Agency in developing and executing a marketing plan to optimize ridership of Amtrak Cascades and maintain and update ODOT’s Amtrak Oregon website (the “Services”).

A sample list of tasks and deliverables is shown in the Sample Contract Exhibit A Statement of Work.

RANKING OF PROPOSERS

The Purchaser will average the scores for each Proposal in a given round of competition (calculated by totaling the points awarded by each Evaluation Committee member and dividing by the number of members).

The Purchaser will combine the average score for each Proposal with Proposer’s price score.

After any applicable preference has been applied, the SPC will determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.

Agency may, in Agency’s sole discretion, determine an apparent successful Proposer with no additional rounds of competition. If additional rounds are conducted, Agency will rank advancing Proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any time during the solicitation process.

NEXT STEP DETERMINATION

At the conclusion of a round of competition, Agency may choose to conduct additional round(s) of competition if, in Agency’s sole discretion, it is in the best interest of the State. Additional rounds of competition may consist of, but will not be limited to:

Interviews Presentations/Demonstrations/Additional Submittal Items Discussions and submittal of revised Proposals Serial or simultaneous negotiations Best and Final Offers Competitive Range Determination If Agency, in its sole discretion, determines that one or more additional rounds of competition is necessary, it will select a Competitive Range to indicate the Proposers that will be invited to participate in a subsequent round. The Competitive Range may include all or, at Agency’s sole discretion, some (based primarily on a natural break in the distribution of scores), of the Proposers from a previous round. Agency, in its sole discretion, may increase or decrease the number of Proposers selected for the Competitive Range if there is a natural break in the scores. Agency will post a notice in OregonBuys of its Competitive Range Determination and provide details about the process and schedule for the subsequent round.

Competitive Range Protest Proposers excluded from a round may submit a Written protest of Competitive Range. Protests must:

Be emailed to the Purchaser;

Reference the RFP number;

Identify Proposer’s name and contact information;

Be sent by an authorized representative;

State the reason for the protest; and Be received within 7 calendar days after issuance of the Notice of the Competitive Range unless a different due date and time is specified in such notice.

Agency will address all protests within a reasonable time and will issue a Written decision to the respective Proposer. Protests that do not include the required information may not be considered by Agency.

ADDITIONAL ROUNDS (Optional at Agency’s discretion) Interviews/Follow-up Questions If Agency determines interviews or follow-up questions are necessary, Proposers in the Competitive Range will be invited to participate and the following will apply:

· A minimum of 3 evaluators will score the interviews/follow-up questions.

· The interviews/follow-up questions will have a maximum score of 50 points.

· Interviews may be in person at a location determined by Agency; however, Agency may elect to conduct interviews via teleconference or video conference;

· As an alternative to interviews, Agency may elect to send follow-up questions via email to Proposers in the Competitive Range. Agency must receive Proposers’ responses to the follow-up questions by the deadline set forth in the email to Proposers. Agency may conduct face-to-face interviews if determined necessary after conducting written follow-up questions.

· Further details regarding interviews or follow-up questions will be included with Notice of Competitive Range.

SCORING AND RANKING OF PROPOSERS FOR SUBSEQUENT ROUNDS

If Agency conducts 2 or more rounds of competition, the rounds will be scored independently. Once the ranking from a previous round is complete and a Competitive Range has been determined, Proposers participating in a subsequent round will compete on an equal basis – scores from the previous round will be set aside and will not carry over. The Proposer with the highest score from the final round will receive the highest final ranking.

Agency may award less than the full Scope of Work described in this RFP. Agency, in its sole discretion, may make additional award(s) for up to 9 months following the close of this solicitation. Agency may select the next ranked Responsive and Responsible Proposer, issue an Intent to Award notice and begin a new award protest period. If agreement with that Proposer is not reached, Agency may offer award to the next ranked Proposer and so on until agreement is reached or until Agency terminates the process. Agency may require reconfirmation of the qualifications and staffing of any Proposer.

1.2 INTENT TO AWARD PROTEST

1.2.1 Protest Submission

All higher ranked Proposals are non-Responsive.

Agency has failed to conduct an evaluation of Proposals in accordance with the criteria or process described in the RFP.

Agency abused its discretion in rejecting the protestor’s Proposal as non-Responsive.

Agency’s evaluation of Proposal or determination of award otherwise violates ORS Chapter 279B or ORS Chapter 279A.

If Agency receives only one Proposal, Agency may dispense with the evaluation process and Intent to Award protest period and proceed with Contract Negotiations and award.

1.2.1.1 Protest Requirements:

Protests must:

Be submitted via email to the Purchaser identified for this RFP in OregonBuys;

Reference the RFP number;

Identify Proposer’s name and contact information;

1.3.6 Nondiscrimination in Employment

As a condition of receiving the award of a Contract under this RFP, Proposer’s authorized representative must certify by marking the “APPROVED” checkbox and entering their name and title on Attachment C - Proposer Information and Certification Sheet that, in accordance with ORS 279A.112, Proposer has in place a policy and practice of preventing sexual harassment, sexual assault, and discrimination against employees who are members of a protected class. The policy and practice must include giving employees a written notice that the policy both prohibits, and prescribes disciplinary measures for, conduct that constitutes sexual harassment, sexual assault, or unlawful discrimination.

Price Information Billing rates and price data may not be discriminatory against Agency. It is discriminatory against Agency if employee (or owner/sole proprietor) compensation (in whatever form or name) is in excess of that being paid for similar non-Agency work under comparable circumstances.

Detailed Price Proposal – A detailed Price Proposal must be submitted no later than 5 Business Days after Agency and selected Proposer agree on scope and finalize the statement of work. The Price Proposal (using the fully loaded billing rates submitted) must include all labor, profit and expenses to complete each task and deliverable of the Services as follows:

· Proposed staff assignments (job classifications and names) and hours per task and sub-task;

· Hours per task and sub-task for each subcontractor, if any, with job classifications and names;

· Itemization of any necessary equipment expenses, travel and other direct non-labor expenses for prime (and for each subcontractor, if any).

By submitting a Proposal, Proposer agrees to comply with the requirements of the RFP, including the terms and conditions of the Sample Contract (Attachment A), with the exception of those terms listed below for negotiation.

Proposer shall review the attached Sample Contract and note exceptions to non-negotiable items. Proposer must submit those exceptions to Agency during the RFP Protest period set forth in Section 1.2. If Agency agrees to make any requested changes to the Sample Contract, Agency will issue an Addendum to notify Proposers of such changes. Unless Agency issues an Addendum modifying any of the terms and conditions, Agency intends to enter into a Contract with the successful Proposer substantially in the form set forth in Sample Contract (Attachment A).

Following the selection of the apparent successful Proposer, Agency may agree to negotiate changes to the negotiable provisions (listed below) of the Sample Contract. However, Agency is not required to make any changes and many provisions cannot be changed. Proposer is cautioned that the State of Oregon believes modifications to the standard provisions constitute increased risk and increased cost to the State.

Any subsequent negotiated changes are subject to prior approval of the Oregon Department of Justice.

Agency is willing to negotiate ONLY the Statement of Work and compensation method.

Agency reserves the right to determine the basis for compensation (e.g., fixed price, fixed price per unit, time and materials, etc.).

In the event that the parties have not reached mutually agreeable terms within 2 weeks, Agency, at its discretion, may terminate Negotiations and commence Negotiations with the next highest ranking Proposer.
