About this file
This is a Request for Proposal (RFP) issued by the State of Oregon Department of Transportation (ODOT) for the Commercial Driver Licensing (CDL) Third Party Skills Testing Program. ODOT seeks to contract with up to three private, for-profit businesses to administer CDL skills tests on behalf of the agency throughout Oregon. The program has been operational since the late 1980s, with four existing private contractors currently administering approximately 96 percent of CDL skills tests statewide. ODOT is specifically targeting high-need urban and underserved remote areas including the Portland Metro area, mid-Willamette Valley (Salem, Albany, Eugene), Southern Oregon (Roseburg, Medford, Klamath Falls), Central Oregon (Bend, Redmond, Burns), Eastern Oregon (The Dalles, Hermiston, LaGrande, Ontario), and the Oregon Coast. In 2024, approximately 6,979 CDL skills tests were administered across the state, demonstrating substantial demand for third-party testing services. The RFP closing date and opening date are specified in OregonBuys; there is no pre-proposal conference. Questions and requests for clarification must be submitted 10 calendar days prior to the bid opening date. The initial contract term is anticipated to be five years with an option to renew for a cumulative maximum of 10 years. Award notification is expected approximately four weeks following the bid opening date.
Contractors selected under this RFP receive no direct compensation from ODOT; instead, they are authorized to set and collect fees directly from CDL skills test applicants. The RFP includes a non-binding 12 percent aspirational target for Certified Small Business participation. Proposers must be registered vendors in OregonBuys and must meet all minimum qualifications and submission requirements, including completion of the Third Party Testing Qualification Certification and submission of a technical proposal addressing program accommodations, program management plans, employment criteria, and experience with similar programs. Proposals are limited to 10 pages and must be submitted electronically via OregonBuys in PDF format with a maximum file size of 6 megabytes. The evaluation process is based on 950 total points distributed across four criteria: Program Accommodations (450 points), Program Management Plan (300 points), Employment Criteria (100 points), and Experience on Similar Programs (100 points). Agency reserves the right to conduct additional rounds of competition, including interviews, presentations, or best and final offers, at its discretion. No direct funding is provided to contractors; the program operates on a fee-for-service basis with applicants paying for testing services.

DEFINITION OF TERMS
For the purposes of this RFP, capitalized words are defined in OAR 735-060-0003, OAR 125-246-0110, RFP section 1.3.2 - Crosswalk of Terms used In OregonBuys, and Exhibit A (Scope of Work) of RFP Attachment A (Sample Contract).
OVERVIEW AND PURPOSE
Agency Overview and Background Agency’s Driver and Motor Vehicle Services division (“DMV”) promotes driver safety, protects financial and ownership interests in vehicles, and collects revenue to finance Oregon’s multimodal transportation system. DMV also oversees the Commercial Driver Licensing (“CDL”) Third Party Skills Testing Program. The purpose of the CDL Third Party Skills Testing Program is to provide a more expeditious option for CDL skills testing to prospective commercial drivers.
Program Overview, Background and Purpose DMV’s CDL Third Party Skills Testing Program (the “Program”) has been in place since the late 1980s. There are currently 4 private, for-profit businesses administering CDL skills tests under this Program.
In the 2-year time period of 2023 to 2024 DMV issued approximately 12,000 CDL licenses per year. A person issued an original Oregon CDL must pass various DMV tests as required by state statutes and the Federal Motor Carrier Safety Regulations (Title 49 CFR). DMV will waive a CDL skills test if an applicant surrenders a valid out-of-state CDL. DMV also accepts proof of prior commercial motor vehicle operation in military service to waive a skills test, as well as out-of-state CDL skills test results for applicants who have completed out-of-state testing in conjunction with driver training from an approved organization.
Between January 2023 and December 2024, skills test examiners employed by Oregon DMV and private, for-profit third party testing businesses administered approximately 4,700 CDL skills tests. The private third party testing businesses administered nearly 96% (4,512) of these CDL skills tests. DMV expects the amount and percentage of CDL tests administered by third party testing businesses to continue in future years.
In 2019, DMV solicited for identical services as described in this RFP, issuing 2 contract awards. In 2020, due to increasing demand, DMV conducted another solicitation for identical services as described in this RFP, issuing 4 additional contract awards. DMV has determined that there is not adequate state-wide third party CDL testing businesses that can perform testing services on behalf of DMV around the state. DMV is specifically looking to add testing in high need, urban, and underserved remote areas of Oregon including, but not limited to, the mid-Willamette valley (Salem, Albany, Eugene), Portland Metro area, Southern Oregon (Roseburg, Medford, Klamath Falls) Central Oregon (Bend, Redmond, Burns) Eastern Oregon (The Dalles, Hermiston, LaGrande, Ontario) and the Oregon Coast.
Because Agency resources are limited, the wait-time to schedule a CDL skills test with DMV may hinder a person from obtaining commercial driving privileges. Therefore, Agency is seeking private CDL third-party testing businesses (“Contractor”) for the administration of CDL skills tests for persons applying for an Oregon CDL. The purpose of the Program is to provide alternate, DMV equivalent services to Oregonians needing to pass a CDL skills test prior to DMV issuing commercial driving privileges.
Upon entering into a Contract with Agency, and completing any required training, the awarded Proposer(s) will be authorized to administer CDL skills tests on behalf of Agency. Proof of successful completion of an applicant’s CDL skills test with any such Contractor will be accepted by DMV in lieu of a DMV-administered CDL skills test. To ensure consistency and uniformity of CDL skills testing across the state, Contractor(s) shall administer CDL skills tests and use scoring criteria identical to the model skills test procedures used by DMV and established in the Oregon CDL Examiner’s Manual. To ensure uniformity in testing and compliance with federal regulations, Contractor shall not deviate from the model CDL skills test in the Oregon CDL Examiner’s Manual.
The Contracts awarded under this RFP to administer CDL skills tests include no direct compensation paid from Agency to a Contractor. Instead, each Contractor is authorized to set and collect fees from the CDL skills test applicants as provided in the Contract.
The following is a breakdown of CDL skills tests administered by DMV and private third party testing businesses in 2024 throughout Oregon.

Central Oregon Bend-Redmond: 288 Klamath Falls: 183

RANKING OF PROPOSERS
The Purchaser will average the scores for each Proposal in a given round of competition (calculated by totaling the points awarded by each Evaluation Committee member and dividing by the number of members).
The Purchaser will then determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.
Agency may, in Agency’s sole discretion, determine an apparent successful Proposer with no additional rounds of competition. If additional rounds are conducted, Agency will rank advancing Proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any time during the solicitation process.
NEXT STEP DETERMINATION
At the conclusion of a round of competition, Agency may choose to conduct additional round(s) of competition if, in Agency’s sole discretion, it is in the best interest of the State. Additional rounds of competition may consist of, but will not be limited to:

The Competitive Range will, to the greatest extent practicable, consist of the 5 highest ranked Proposers. Agency, in its sole discretion, may increase or decrease the number of Proposers selected for the Competitive Range if there is a natural break in the scores. Agency will post a notice in OregonBuys of its Competitive Range Determination and provide details about the process and schedule for the subsequent round.

Be emailed to the Purchaser;
Reference the RFP number;

ADDITIONAL ROUNDS (Optional at Agency’s discretion) Interviews/Follow-up Questions If Agency determines interviews or follow-up questions are necessary, Proposers in the Competitive Range will be invited to participate and the following will apply:
