About this file

This document is a Statement of Work (SOW) for a state and local contract opportunity between the Oregon Department of Transportation (ODOT) and a consulting firm for curb ramp remediation under a settlement agreement. The project involves designing approximately 28 curb ramps along OR-213 and OR-224 highways in the Happy Valley and Mulino areas, with the goal of making state highways more accessible to people with disabilities. The contract is part of a 15-year settlement agreement requiring ODOT to remediate non-compliant curb ramps, with a target of remediating 75 percent of non-compliant locations by December 31, 2027. The work will be completed in two phases: Phase 1 involving ramp evaluation, package development, design, and final plans, specifications, and estimates (PS&E); and Phase 2 covering construction administration and engineering inspection. The project is identified in the Statewide Transportation Improvement Program (STIP) with a key number of 23771.

The estimated construction contract price for the project is $970,000, with the consulting firm to be compensated through various methods including fixed price, time and materials, and potentially cost-plus-fixed-fee. Funding will come from the state transportation improvement program, with the project designed to meet multiple accessibility standards including the Americans with Disabilities Act, Public Right of Way Accessibility Guidelines, ADA Standards for Accessibility Guidelines, and other federal and state regulations. The contract includes provisions for contingency tasks, utility coordination, environmental services, right-of-way acquisition, and comprehensive project management. The consulting firm will be responsible for developing communication plans, conducting public involvement activities, coordinating with utilities, performing environmental assessments, and completing all design and engineering tasks necessary to prepare the project for construction.

A. PROJECT DESCRIPTION and OVERVIEW of SERVICES Background: The Oregon Department of Transportation and the Association of Oregon Centers for Independent Living, et al. entered into a 15-year settlement agreement on Nov. 2, 2016, to make state highways more accessible to people with disabilities (“Settlement Agreement”). The Settlement Agreement contains certain requirements with respect to remediation of the curb ramp inventory (“Settlement Agreement Curb Ramp Inventory” or “Curb Ramp Inventory”). This Curb Ramp Inventory (as updated from time to time) identifies the locations of non-compliant and missing curb ramps that ODOT agrees to remediate. The Final Settlement Agreement sets forth the “Applicable Standards” required for curb ramp mediation:

· Americans With Disabilities Act (“ADA”) and its implementing regulations,

· PRO WAG (Public Right of Way Accessibility Guidelines),

· the ADA Standards for Accessibility Guidelines (ADAAG), Section 504 of the Rehabilitation Act of 1973, and

· Part 4 (Highway Traffic Signals) and Part 6 (Temporary Traffic Control) of the Manual on Uniform Traffic Control Devices (”MUTCD”).

Consultant shall utilize the packaging process to streamline the design and develop the most efficient process appropriate for the ramps within Construction Packages, and multiple packages may be developed sequentially or concurrently. All Project Curb Ramps which are included in this WOC must be included in a Package Proposal.

Simplified Design is a version of design that does not involve the Conceptual Design process and instead utilizes standard drawings in lieu of individual ramp designs to prepare the Final PS&E schedule. Modified Standard Design and Full Standard Design Process both utilize the Conceptual Design process and Final PS&E, but whereas the Full Standard Design Process proceeds through each design step, the Modified Standard Design only includes steps applicable to the Package.

Once Consultant determines a package must be recommended, Consultant shall develop a draft “Package Proposal” that must contain the following:

· Description of the features/characteristics used to develop the Construction Package

· List of recommended ramps to be included within the Construction Package

· Recommended Level of Design (Simplified Design or Modified Standard Design Process, or Full Standard Design Process) and which design tasks and deliverables to include from the Level of Design Tasks: Task 14 (Design Acceptance Package) and Task 16 (Plans, Specifications and Estimate). As appropriate for the recommended Level of Design, include the following Design deliverables:

· Design Acceptance Package (“DAP”) Narrative;

· DAP Design Exception (“DE”)/Deviation Summary Report;

· Draft DAP;

· Final DAP;

· Final PS&E.

· For Modified Full Design or Standard 1 copy of Conceptual Design sketches each Project Curb Ramp within the Package
