COMMERCIAL COMBINED SYNOPSIS/SOLICITATION

Inyo NF, Lake Mary System Geophysics Survey, Mammoth Ranger District

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request for Quotation, RFQ# 127EAS22Q0077

This procurement is being issued as a 100% SMALL BUSINESS SET ASIDE.

North American Industrial Classification Standard (NAICS) 541360, Size Standard of $16.5 Million.

This solicitation document incorporates provisions and clauses of those in effect through Federal

Acquisition Circular 2022-07 and Agriculture Acquisition Regulation (AGAR) last updated 29 March

2021. The result of this requirement will be a firm fixed priced (FFP) contract.

The following factors shall be used to evaluate quotes: price, technical, and past performance.

Technical and past performance, when combined, are of greater importance than price.

SITE VISIT:

An official site visit is not scheduled for this requirement. Most Forest Service land is open to the public and available for contractors to self-view sites.

Statement of Work

SCOPE

The Contractor shall furnish all labor, materials, equipment, tools, transportation, incidentals, inspection, quality control and supplies necessary to conduct a geophysics investigation along three alignments adjacent to the roadway. See attached drawing and picture. The length of the profiles along the road/embankment shoulder range between 360 and 460 linear feet. Spillways interrupt the proposed alignments as indicated in the drawings.

The Contractor shall develop a 2D shear wave velocity representation of the soil and rock to minimum depth of 50 feet. The method utilized may include 2D S wave refraction and/or MASW. Site conditions will dictate the appropriate method. A 2D P wave refraction survey will be conducted to help locate and delineate bedrock. The Contractor should be prepared to deploy whatever method is appropriate when mobilized that will yield the most favorable results. Forward and reverse models must be provided by the

Contractor. At least 12 shots per spread must be conducted including forward and reverse end shots, off end shots, and interior shots. Energy sources required to excite all near surface modes will be at the discretion of the Contractor. In addition, the Contractor shall develop a Vs30 for each site. The Contractor must provide 2D representation of P and S wave data. The Contractor shall provide interpretation of the data including delineation of bedrock.

If the Contractor believes that minor deviations to the scope will result in improved the results of the final product, the Contractor is encouraged to provide these recommendations as part of its technical proposal.

PROJECT LOCATION

This project is located within the Mammoth Ranger District on the Inyo National Forest in Mono County, California.

The dams being surveyed are at the following latitude and longitude coordinates:

The alignment of the surveys will be contingent on site conditions at the time.

The Mammoth Ranger District Office is located at: 2510 Hwy 203 Mammoth Lakes, CA 93546.

CONTRACT TIME

The contract duration is estimated to have period of performance (POP) of 60 days from the issuance of the approval to begin work.

Contract time includes delays for weather, locating and transporting supplies and materials, and final site cleanup.

The requirements contained in these listed specifications are hereby made a part of this solicitation and any resultant contract.

Note that the specification list includes the major specifications applicable to this project.

Other specifications referred to within these specifications (even though not specifically listed herein) are also fully applicable to this request for quotes and any resultant contract.

PROJECT SCHEDULE

PRELIMINARY MEETING AND SUBMITTAL SCHEDULES

DELIVERABLES

Premilitary findings:

Preliminary results will include a 2D representation of the shear wave velocity profile to a depth of

30 feet minimum. In addition, P wave refraction profile shall be provided.

Final Report:

The report shall contain a description of methods used to acquire the data, basic description of the theory, issues that may have skewed model results, 2D representation of the shear wave velocity profile (forward and reverse), 2D representation of P wave refraction results, and Vs30 at location of Line 2. The Contractor shall provide a professional interpretation of the results to include delineation of the rock/weathered rock/soil interface. The final report will be submitted electronically with professional stamps.

Note. The above list of the minimum mandatory submittals. This may not be the complete list of submittals; other submittals may be necessary to complete project in accordance with these specifications and/or applicable regulations.

Attachment 3: Evaluation Criteria

The Government intends to award a firm fixed price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered.

Quotes submitted in response to this solicitation shall include a Technical Proposal, Price Quote and completed Reps and Certs document found at the end of Attachment 4, RFQ Provisions and Clauses.

Technical Proposal – The technical proposal shall address the contractor’s proposed plan of accomplishing the required work by detailing the steps, equipment, and or manpower the contractor plans to use for this project.

The contractor shall identify the methods for completing work for each respective CLIN identifying and explaining how the contractor will establish and maintain all required systems and an example of the required reporting to be furnished by the contractor to the government per the SOW.

The completed technical proposal is intended to evaluate the contractors understanding of the requirement and technical capability.

The completed Technical proposal shall be no longer than 3 pages long.

Price Quote – Include the following: 1) completed, signed SOI from this solicitation and, 2)

Acknowledge any amendments issued on sam.gov for this solicitation by completing and signing the posted SF-30.

Offerors that do not submit all sections of evaluation factors may not be considered for contract award.

Responses should be submitted on the most favorable terms that the offeror could make to the

Government.

The Government reserves the right to reject any or all offers or to make award without conducting negotiations.

Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) The use in this solicitation of any Federal Acquisition Regulation (48 CFR Chapter 1) provision with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the provision.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications

Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror

Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it

"does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at

52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video

Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal

Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for

"covered telecommunications equipment or services".

(d) Representation. The Offeror represents that—

Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. (2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

(d) Comptroller General Examination of Record. 452.204-70 Modification for Contract Closeout (DEVIATION JUL 2022)

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR

13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer

(CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and

Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
