The U.S. Army Corps of Engineers, Los Angeles District is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for large scale construction project (exceeding $25 million) within the Los Angeles County, state of California. A PLA is defined as a pre-hire collective bargainingagreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy:(a) A Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects.(b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will(1) Advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and(2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement.Please provide responses to any or all of the following questions:(1) Should PLAs be executed on selected large dollar, large scale civil works construction contracts in Los Angeles County, California? If yes, describe how a PLA will achieve economy and efficiency in the procurement, produce labor management stability, and/or ensure compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards? If no, describe why?(2) Are there concerns by prime contractors on the availability of skilled construction labor?(3) Would a PLA benefit a project which contains a unique and compelling mission-critical schedule? How?(4) What type of project should not be considered for PLA clauses?(5) What is the time impact to the completion of the contract due to a PLA?(6) What is the cost impact to the bid/proposal due to a PLA?(7) What other factors should the Corps consider before deciding to include PLA provisions in a Corps of Engineers Los Angeles District contract?Please limit your responses to no more than three (3) pages in length. Respondents will not be notified of the results of the evaluation.The U.S. Army Corps of Engineers - Los Angeles District has been tasked to solicit and award a construction contract to construct a new Mental Health Inpatient (MHIP) and a new Mental Health Outpatient (MHOP) building. The proposed project will result in the award of a competitive, firm-fixed price, construction contract procured in accordance with FAR 15, Negotiated Procurement using "Best Value" trade-off process. The government intends to issue a solicitation; however, the results and analysis of the market research will finalize the determination of procurement method. The type of set-aside decision to be issued will depend upon the responses to this synopsis.The purpose of this synopsis is to gain knowledge of interest, capabilities and qualifications of various members of industry, to include large and Small Business Community. Small Businesses includes Section 8(a), Historically Underutilized Business Zones (HUB-Zone), Woman-owned Small Businesses (WOSB) and Service-Disabled Veteran-Owned Small Business (SDVOSB). The Government must ensure there is adequate competition among the potential pool of responsible contractors.The Government is seeking qualified, experienced sources capable of performing construction of a new Mental Health Inpatient (MHIP) building of approximately 78,000 GSF and a new Mental Health Outpatient (MHOP) building of approximately 80,000 GSF. Both MHIP and MHOP buildings are 2-story buildings. Work includes general building construction, clearing and grubbing, site preparation, erosion controls, roads, paving and sidewalks, grading, drainage and sewer, landscaping, site lighting, fire suppression, site utilities, mechanical, electrical, telecommunications and associated work. The project is intended to be certified LEED silver or better upon completion of construction of both buildings. The site of the project is the VA Long Beach Health Care System located at 5901 E. 7th Street, Long Beach CA 90822. The main hospital is to remain fully operational during the construction.In accordance with FAR 36/DFARs 236, the estimated construction price range for this project is between $100,000,000 and $250,000,000.Estimated duration of the project is 700 calendar days.Minimum capabilities required include, previous experience of projects similar to magnitude and complexity and certified LEED silver or above.The North American Industry Classification System code for this procurement is 236220, which has a small business size standard of $36,500,000.00.Small Businesses are reminded under FAR 52.219-14, Limitations on Subcontracting that they must perform at least 15% of the cost of the contract, not including the cost of materials, with their own employees for general construction-type procurement.8(a) firms are reminded they need to have a bonafide office in the area to where the work is to be performed should the acquisition be set-aside for 8(a) program.Prior Government contract work is not required for submitting a response under this sources sought synopsis.Anticipated solicitation issuance date is on or about 1 December 2017, and the estimated proposal due date will be on or about 12 January 2018 . This project will comply with DoD antiterrorism/force protection requirements per UFC 4-010-01.This construction contract is estimated to be between $100,000,000 to $250,000,000This an UNRESTRICTED procurement and will be conducted under NAICS Code: 236220 Commercial & Institutional Bldg Construction. The size standard for this code is $36,500,000. Contract Clause No. FAR 52.219-4, entitled, Price Evaluation Preference for HUBZone Small Business Concerns will be applied to this procurement. The acquisition will use FAR Part 15 Contract by Negotiation procedures for award.
