SV-103 Summitville Mine Toe Seep Modifications Contract Documents
This document package represents a State of Colorado construction contract issued by the Colorado Department of Public Health and Environment (CDPHE) for modifications to the toe seep collection and pump back system at the Summitville Mine Superfund Site. The project involves ten discrete line items for work to be performed, including mobilization and demobilization, manhole dewatering, flow meter replacement, pressure transducer replacement, controls replacement, programmable logic controller (PLC) reprogramming, instrument data management, pump installation, commissioning and testing, and provision of manuals and operator training. The contractor must achieve substantial completion within 30 calendar days from the Notice to Proceed and final completion within an additional 10 calendar days, for a total project duration of 40 calendar days. Bidders were required to demonstrate qualification through completion of three similar projects within the past five years involving instrumentation installation in water pumping systems and PLC integration. Minimum qualification criteria documentation was required to be submitted with the bid.
The contract is structured as a fixed-price, lump-sum bid for all work items, with bidders required to include all applicable taxes in their proposals. The State retains five percent retainage from progress payments until final completion and acceptance. Federal requirements apply to this project as it is funded in part by the Environmental Protection Agency through a Cooperative Agreement with CDPHE, triggering compliance with provisions of 40 CFR 35 Subpart O, including mandatory Davis-Bacon wage rate requirements, minority and women business enterprise participation goals of 6.1 percent and 6.6 percent respectively, conflict-of-interest certifications, and extensive federal financial management and audit requirements. Liquidated damages are assessed at $2,000 per day for delays beyond the final acceptance period. The contractor must furnish performance and labor-material payment bonds, maintain comprehensive general liability insurance with limits of $2,000,000 general aggregate and $1,000,000 per occurrence, and comply with Colorado labor requirements mandating that at least eighty percent of work be performed by Colorado residents.

The following requirements are based on this contract being funded, at least in part, by the federal government through the U.S. EPA. The requirements are based on the Cooperative Agreement between the Colorado Department of Public Health and Environment (CDPHE) and the

and (3) a statement that it immediately shall disclose any such information discovered after submission of its bid or proposal or after award. CDPHE shall evaluate such information and shall exclude any bidder or offeror if CDPHE determines the offeror’s conflict of interest is significant and cannot be avoided or otherwise resolved.

6. The CONTRACTOR agrees to comply with requirements contained in 40 CFR 35, Subpart O, that are applicable to a party contracting with a grant recipient (CDPHE is the grant recipient).
A summary of those requirements follows. Failure of this summary to specifically identify any such federal requirements does not relieve the CONTRACTOR of his responsibility to comply with applicable parts of the federal regulation:
A. Royalties and Patents.
The CONTRACTOR must report to CDPHE, promptly and in reasonable written detail, each known notice or claim of patent or copyright infringement under this Contract.
