Amendment 0002

1. C 5.1.9 - The requirement for unloading two JP8 tankers, one biodiesel tanker and one UNL/E85 tankers simultaneously seems excessive given the amount of demand. It is almost inconceivable that 4 tankers would show up at the same time, especially given the amount of deliveries expected. In addition to the expense involved, finding space for the 4 containment areas is very problematic. Suggest consideration be given to modifying the requirement to two trucks with any type of fuel simultaneously.

Concur. Requirement in Paragraph C 5.1.9 will be changed to read ”Capable of off-loading two trucks with any type of fuel simultaneously.”

2. C5.1.9 – The requirement to load two JP8 and one biodiesel simultaneously presents space and expense problems at 52 and 14 areas and, given the amount of demand forecast, may not required.

Request consideration be given to require two trucks simultaneous load either or both JP8 and biodiesel.

Concur. Requirement in Paragraph C 5.1.9 will be changed to read ”Capable of loading two trucks with JP8 and/or Bio-Diesel simultaneously.”

3. Will the government provide laboratory services for flashing JP8 daily? If so, where will the samples be taken?

No, the government will not provide laboratory services.

4. Will Camp Pendleton bring high voltage power, water and communications to the property line?

Area 41 in particular does not have power or communications adjacent to the property line.

All utilities have already been brought by the base to the property lines. The shape of the Area 41 site includes the area at the “tail of the bird” where the electrical connection can be found. No additional connections will be made by the base.

5. C 5.1.9 - What is the definition of “energy efficient” lighting?

Lighting must meet the requirements of the BEAP and any other federal, state or local requirements.

6. Is a copy of the monitor well maps available? Geotracker only shows 3 at 22 Area and, at the meeting, 8 were indicated.

The latest groundwater report for Area 22 is dated July 15, 2009 and is on the Geotracker website.

Please refer to Figure 5 of that report. It provides the location and number of wells at that site.

7. Is there soil boring data available, particularly the boring logs for each site?

Soil borings were initially drilled to collect contaminant data typically during the 1990s. You will need to refer to the Geotracker website for those boring logs or to the Regional Water Quality Control Board records.

8. Please confirm those sites that may receive tracked vehicles.

Areas 21 and 41.

9. What equipment is available to us from the current buildings at 21 and 22 Areas? Please confirm that any buildings within the lease area are available to us.

If old equipment is being reused, the contractor is responsible for ensuring that all equipment is compliant and compatible with all E85/biodiesel requirements.

10. Area 52 has pipes extending out of the ground throughout the property. Please confirm that these pipes are abandoned.

These pipes are active.

11. During excavation activities if petroleum impacted soils are encountered (particularly at 21, 22 Areas) and are unable to be reused as suitable backfill, will Camp Pendleton be responsible for transportation and disposal of the contaminated soil?

No, Camp Pendleton does not typically provide funds for cleanup of DESC sites. This is the Contractor’s responsibility.

12. Please confirm that the removal of the existing facilities at 21 and 22 Areas are the responsibility of the government.

Yes, demolition projects will be submitted to DESC’s SRM-E system as soon as the COCO facilities are fully operational.

13. Will the government relocate existing overhead electrical lines and poles on some of the Areas that would be in the footprint of the new facilities?

No.

14. What are the phone line rates at Camp Pendleton?

The phones lines will be the Contractor’s responsibility.

15. The page limit makes it somewhat difficult to make a complete presentation. Could the drawings and the resumes be excluded from the page count?

Yes, they will be considered attachments.

16. Please explain the procedures and time lines for obtaining base access for equipment, materials, and personnel.

The contractor must contact the appropriate installation offices to ensure access and approval before bringing equipment, materials, and personnel on to the base.

17. Please clarify if we are to include the cost of construction in the base 5 year period.

Yes.

18. In the lease at para 16 (f), pg 11, it states we must follow the design criteria and guidelines established in the Base Exterior Architecture Plan. Can you please provide these documents since they were not provided with the RFP.

Yes, they will be posted on FBO.

19. Will the Government consider approving progress payments for the construction of the support facilities and infrastructure and, storage and distribution systems?

This is a service contract under the provision of section 2922 of title 10 of the US Code (USC), and not a construction contract. Section 2922 grants the Secretary authority to contract for fuel storage facilities and for the services of the storage, handling and distribution of fuel for up to 5 years with up to three 5 year option periods, not to exceed 20 years. The Contractor will own any facilities constructed on the lease land and continue to own the facilities. DoD will retain the option to buy any installed facilities at the end of the expiration or termination of the contract, or the contracting officer may at that time direct the contractor to remove the facilities at the Government's cost.

The DoD is interested only in receiving the required fuel support services and is not interested in owning any fuel infrastructure. Indeed, DoD policy mandates “The Military Services shall seek to minimize Government-owned fuel infrastructure on military installations to the maximum extent possible through the use of commercial assets and privatization of existing infrastructure, except those systems needed for unique security reasons or when privatization is uneconomical.” See DODD 4140.25, “DoD Management Policy for Energy Commodities and Related Services,” para. 4.5, April 12, 2004.

The US Marine Corps will lease the land under the provisions of 10 USC sec 2667 for the facilities to the awardee who will own a leasehold estate in the land and will own any capital improvements on the land.

Therefore, this will be a Contractor-owned, Contractor-operated (COCO) fuel facility.

Since this is a service contract and not a construction contract, payment to the contractor will not begin until the contractor starts to perform the services. Therefore there is no authority for DESC to make advance or progress payments as there would be in a construction contract. Perspective awardees must obtain whatever financing is necessary to install the facilities incidentally necessary to perform the required services and may amortize this cost in their monthly service charge over the five year base period.

20. We noted that the RFP does not require compliance with the Davis Bacon Act for the anticipated construction work. It has been our experience that the Department of Labor considers the Davis Bacon Act applicable to incidental construction being performed under a service contract if it is more than $2,000, is paid for with government funds, is performed on government property, and it ultimately became the property of the Government. Since the work is being performed on government property, title to the construction contemplated upon completion of the contract will transfer to the Government, and the value of the construction will exceed $2,000 will you please clarify if the Davis Bacon Act is applicable or, has DESC obtained a Davis Bacon Act waiver from the Department of Labor?

If the Davis Bacon Act is applicable to the incidental construction can you please provide the applicable wage determination?

The Davis Bacon Act which governs construction contracts does not apply to this service contract which necessarily includes the incidental installation of fuel facilities. See FAR 22.402(b). The contractor will own in the form of a leasehold estate the land on which the contractor will install whatever facilities are necessary to perform the required fuel support services. The Contractor also will own any installed facilities on its land necessary to perform the services, even at the termination of the contract unless the Government exercises its option to purchase the facilities. The DoD retains the option to buy the facilities at the end of the 20 year period under 10 USC § 2922, which grants the Secretary authority to contract for fuel storage facilities and for the services of the storage, handling and distribution of fuel for up to 5 years with up to three 5 year option periods, not to exceed 20 years. The contracting officer also may direct the contractor to remove any installed facilities at the termination or expiration of the contract with the Government reimbursing the contractor for the removal. The Service Contract Act will apply to this service contract instead since the purpose of this contract is to obtain fuel handling services and not to install or acquire any fuel facilities. Any installation of facilities or capital improvements is incidental to the service contract and is not a substantial or segregable part of the service contract. See FAR 22.402(b)(1)(iii) & (b)(2).

Perspective awardees must obtain whatever financing is necessary to install the facilities to perform the required services and may amortize this cost in their monthly service charge over the five year base period.

21. Please provide the SB subcontracting goals so that we may properly prepare our SB Contracting plan.

We do not provide the subcontracting goals. That is part of your requirement for this procurement. As a reminder, 0% is not an acceptable goal.

22. Can you please clarify the amount of time that will be permitted to complete the facilities since there appears to be a conflict. At Sec E, para E36, pg 8, it states that all facilities to be provided under the contract must be ready for inspection and acceptance by 1 May 2010. If the Government holds to their estimated time of 180 days to award a contract which is, 25 April 2010, there will only be 6 days to submit all the required post award certifications, mobilize, and complete the facilities.

Since there is a 90 day window after award for Congressional Notification, and no real site work can start until after then, you will have 180 days AFTER the Congressional Notification period ends (if there is no objection from Congress) to complete the construction.

23. C-5.1.9 Third bullet: Truck receipt capability with filtration for receipt of JP8 IAW product specification. Is it the government’s intention that all JP8 tanks, regardless of size or facility location only receive JP8 deliveries through a filter separator?

JP-8 is Aviation fuel, and you must issue, receive and maintain the product in accordance with that specification.

24. C-5.1.9 21st Bullet: Fixed systems to provide a means of immediate notification to the IFC of any emergency 24/7 IAW NFPA provisions.

What are the current Pendleton Fire Chiefs requirements for Fire Alarm systems, i.e. Honeywell, Monarch and wired or radio signal to the control center?

The fire alarm systems on Camp Pendleton are to any addressable fire alarm panel and report all signal via digital alarm communicator transmitter. Two dedicated phone lines are required to transmit these signals to dispatch.

Is there currently a contractor on Camp Pendleton that has rights to all installations of this type that this contractor will have to sub to?

No, there is no contractor on Camp Pendleton that has these rights for installation of alarm systems.

Does the AHJ require further systems at fuel facilities such as heat sensors, red eyes, etc?

Compliance of stations shall in accordance with NFPA 30 and 52.

25. It was mentioned at the pre-proposal by a base official, that Camp Pendleton highly prefers the use of only UST’s. Is this correct or does the contractor have the freedom to self decide what tank types to use?

There is no set base policy for type of tank. CPEN currently has both types of tanks. Submit your design proposal and we will evaluate accordingly.

26. C-3.1.2 During the pre-proposal, it was stated that some sites will require both unleaded and E85, yet C-3.1.2 states Unleaded requirement also covers E85. Will a tank be required for each product and if so, at what locations?

Any station that has both E85 and unleaded at one location, will have different SDAPDC permit requirements applicable to each.

27. C-5.1.1.3 reference is made to contract clause L116.01. Where is this clause located?

It is in Amendment 0001.

28. C-5.1.3 No petroleum product shall be received or issued until product quality determinations have been confirmed for conformance with specification. Other than clear/bright visual and API, what testing requirements will the contractor be required to conduct?

The Contractor must ensure product meets their specifications before it can be issued.

29. C-5.1.2.3 VIL encoding. Should it be assumed that all currently issued VIL’s on Camp Pendleton will stay in operation once the contractor facilities are operational? If so, should it also be assumed that the current VIL log, lockout list, etc will be provide to the contractor at startup?

Yes, base will provide information to the contractor, however, they will all need rekeying as the facility DODAAC will change for the COCO.

30. Will the government require fuel samples from tanks, receipt vessels, monthly filter effectiveness, and if so, will a designated government lab be provided to ship the samples to for testing?

There will be no designated government lab. Contractor must ensure fuel is in compliance with the product spec and do whatever is required to test for on spec product.

31. Explain how the “Blast Zone”, which has not been established in writing, is to be treated?

The Blast Study will be provided as part of the amendment. You will need to determine for yourself how it is to be treated, just like any other federal, state or local requirements.

32. Will the contractors be able to connect to existing sewage mains for removal of storm water or will retention ponds be required?

Stormwater will not be discharged to the sanitary sewer mains. Stormwater will be discharged to the existing base drainage network. On-site detection shall be in compliance with UFC 3-230-17FA and any other relevant UFCs. Lead silver is required for retention ponds.

33. Will the contractors be able to use existing borrow pits and dumps to bring in needed dirt and to dispose of existing debris? If so, what is the distance of each facility from the six fuel point facilities?

No, The contractor is to responsible for removing debris from the base.

34. In the solicitation they only cite the NAICS Code for operation (424710), construction of the facility falls under a completely different NAICS Code (237120).

The correct NAICS code is 424710 because this is not a construction contract. This procurement is performance-based.

35. PWS, Page 6, states that we must comply with the Camp Pendleton Environmental Policies and Regulations. Could a copy of these regulations be issues so we can see our requirements?

Camp Pendleton does not maintain an exhaustive list of environmental policies and regulations that base personnel and contractors must comply with. Environmental staff briefed some of the more frequent concerns that may impact the project during the preproposal conference. Unless included herein, contractors must comply with all pertinent Federal, State, and local environmental regulatory agencies/websites to determine what requirements are applicable to their installation and operation/maintenance activities.

Contractors will be responsible for complying with the environmental and natural resource obligations spelled out in the EA and FONSI.

The contractor will need to provide AC/S ES with copies of all environmental permits acquired by the contractor for the operation and maintenance of the contract. Until all permits are officially transferred, the contractor will need to provide copies of all official communication with environmental regulators (e.g., permit applications) to AC/S ES.

Applicable regulations state requirements for EVR Phase I and Phase II equipment for gasoline dispensing and EVR Phase I equipment for E85. Equipment can only be installed and maintained ONLY by a certified technician. Please refer to SDAPCD and CARB for all applicable requirements for gasoline storage, transfer, and dispensing operations.

A copy of the Hazardous Waste Management Base Order is attached. Copies of SOPs for UST management, AST management, and spill prevention, response, and reporting will be provided. Please note these are Base requirements. Federal, state, and local requirements still apply.

36. PWS, Page 13, states that the facilities must be capable of loading JP-8 at two points and Bio-Diesel at one point simultaneously at the Master Service Areas. Is this bulk loading or retail loading?

In the 14 and 52 Areas this refers to bulk, however, that statement has been changed to “Capable of loading two trucks with JP8 and/or Bio-Diesel simultaneously.”

37. Could you define “Built-in Redundancy,” as required on Page 13, of the PWS?

The contractor shall provide an auxillary power source to enable operations 24 hours per day during power outage and emergency situations.

38. Page 23 of the solicitation states “unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.” Could you please explain what the meaning of this statement is?

At the end of the twenty year contract period, there is an option that the Government has the right to receive the title of the facilities or the Contractor may be asked to return the land to how it was prior to installation of the facilities.

39. In the past, these contracts were intended to use “Best Commercial Practices” and now this solicitation is requiring us to use Government Standards. Could you please give a list of Government Standards the facilities are to be designed and built to?

This is a performance based solicitation, and will be evaluated in accordance with Best Commercial Practices.

40. Please confirm that fuel nozzles requirements are of standard design, i.e. not loading rack type.

This is a performance based contract. We do not tell you how, just what the requirements are and that you must be in compliance with all federal, state and local requirements. Submit your best proposal and we will evaluate.

41. Please provide copies of NEPA docs for effected sites.

Final EA was completed. FONSI will be posted on FBO.

42. Please provide copies of Environmental Impact Study.

An EA, not an EIS, was completed and will be posted on FBO.

43. Regarding timeline for construction, the RFP says no work begins operationally until May 2010. Is simultaneous construction allowable? Would the Government consider incremental start up if locations are ready at different times?

Work can not begin until at least 90 days after award due to the Congressional notification requirements except for obtaining permits. Simultaneous construction is a contractor decision and has been done on other COCO projects. Incremental startup is usually not done on COCO projects, but may be considered depending on the situation after award.

44. Please provide cost structure for the de-watering of any site that has high ground water, i.e. cost per gallon to discharge cleaned water CPMB's sanitary sewer system.

This is unknown, but may require testing, treatment, and coordination with AC/S Facilities for wastewater disposal (after treatment) if allowed.

45. Are above ground tanks acceptable? The Solicitation infers UST's are to be installed. At the site visit there was mention of a preference for UST based on base studies. Are these studies available for offerers consideration?

The Blast Study that is referenced will be provided as part of the amendment. There is no official base policy mandating any type of tanks, and there are currently both types on base. Submit your best design proposal and we will evaluate.

46. Please provide copy of the "Camp Pendleton Base Exterior Architecture Plans and Master plan

(BEAP).

This will be posted on FBO.

47. Please advise if each site requires build out i.e. asphalt paving, concrete drives, landscape entire Lease Site, or can the lease site be partially developed to accommodate a smaller foot print? Is there a requirement for a surface material on the property or will it be acceptable for the contractor to leave the property in a natural manner like 21 Area where it is covered in sand leaving it accessible for a patron to get to the fueling island?

A smaller footprint can be used as long as the facility design meets all the requirements and can accommodate all types of vehicles without backing up traffic onto the base roads. Also, no additional utility connections will be provided by the base, as the site parcels were chosen in part due to their connections to existing utilities and water/sewer.

As to the site, this is a performance based contract. We do not tell you how, just what the requirements are and that you must be in compliance with all federal, state and local requirements. Submit your best design proposal and we will evaluate.

48. Please advise if a canopy is to be installed over the fueling points.

This is a performance based contract. We do not tell you how, just what the requirements are and that you must be in compliance with all federal, state and local requirements. Submit your best proposal and we will evaluate.

49. Reference the Socioeconomic requirement of Section L. Please explain the difference in determining size standard for purposes of bidding this solicitation.

Does a firm between 100 and 500 employees qualify as small based on para (a) below, or large based on para (b)?

L2.05 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (JUN 2008)

(a) NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE AND SMALL BUSINESS

SIZE STANDARD. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern that submits an offer in its own name, but which proposes to furnish an item that it did not itself manufacture, is 500 employees.

(b). THE NAICS Code is 424710 and the threshold is 100 employees (Page 3 of 42)

The NAICS code for this procurement is 424710 and the threshold is 100 employees.

50. Please provide access to the Camp Pendleton Integrated Natural Resource Management Plan (INRMP) and the Integrated Cultural Resource Management Plan (INCRMP). Is there a specific Natural Resource Management Plan for the areas being leased? Is there a specified format for the leasee plan to be submitted in? Is the 2007 documentation on the Camp Pendleton website the most recent version?

The INCRMP is not yet available for public review. This is the public online link for the INRMP:

http://www.pendleton.usmc.mil/base/environmental/inrmp.asp

51. Please provide a copy of the Camp Pendleton Integrated Contingency Plan and SPCC.

This will be posted on FBO.

52. Reference OSP clause B34.01, schedule of prices. Please explain what offerors should include for Area 32.

The six COCO locations for clause B34.01 are Areas 14, 52, 21, 22, 41, and 43.

53. Please confirm utility connections are brought to the property line by others and not by the contractor. Will the contractor be allowed to indentify where the connection should be brought to, or will the Government select location? If Government selects, when will this info be made available?

http://www.pendleton.usmc.mil/base/environmental/inrmp.asp

Page 12 of14

Stormwater tie-ins must be connected to the existing base stormwater network in a way that will prevent erosion, scour, flooding, and/or discharge of pollutants.

Property lines will be referred to as EA boundaries should encompass locations for connections by contractor.

Contractor can determine where the connection should be brought to.

54. On 22 Area there is an existing large propane tank on the property. Is the contractor going to be responsible for removing it or is the base going to move it? If the contractor is responsible for moving it, is it going to be removed and disposed of or is it going to be removed and replaced at another location?

If relocated, what is the projected new location?

The propane tank is not within the boundary of the footprint.

55. What wage rate is the construction contractor required to pay construction employees, commercial wages or Davis Bacon Wages?

This procurement falls under the Service Contract Act, not the Davis Bacon Act.

56. On 21 Area there is an existing fueling rack. Who is removing it, the contractor or the base? If the contractor is removing it, when can it be removed?

DESC has a demolition project in the system to remove those racks. The work should be done prior to the contract award. An exact date is not known at this time.

57. Who demolishes Area 21 and 22 facilities? DESC via their SRM-E program will program demo projects for the existing facilities once the new COCOs are fully operational.

58. Please provide copies of the Base Underground Storage Tank Management Policies and Procedures and the Base Above Ground Storage Tank Management Policies and procedures.

These will be posted to FBO.

59. What type of internet connectivity is available to the general site locations for BSM-E use?

It is up to the contractor to determine this.

60. What is the involvement of the offeror/leasee with the current environmental issues on sites with previous findings? Will any action be required of the offeror for on- going remediation of those areas?

None. The fuel facilities at CPEN were not capitalized until last year, therefore, anything having to do with existing contamination will be the base's responsibility.

61. Does the base have a landfill/recycling facility that will take spoils, construction debris, yard waste for disposal at no costs?

The contractor is responsible for removing all spoils from the base.

62. Is the contractor responsible for all utility taps and connections?

Yes.

63. What are the security setbacks from the perimeter fencing to lease lines, roads, and structures?

ATFP setbacks are 82’ from buildings to roads or parking areas, 20’ separation for Fire, and 33’ between buildings.

64. What are the setbacks for structures near underground utilities?

Must follow all IBC requirements.
