About this file

This is an Attestation of Compliance form issued by the San Francisco Municipal Transit Agency (SFMTA) as Attachment 5 to Invitation for Bids No. SFMTA-2027-01-FTA for the procurement of Precast ADA Platforms. The IFB seeks qualified bidders to provide precast ADA platforms to multiple Muni line locations throughout San Francisco. All proposing firms and individual subcontractors are required to complete and submit this attestation form as part of their bid response. Failure to include the executed attestation will render a bid non-responsive and ineligible for evaluation. The form requires signatories to certify compliance with communications restrictions that prohibit bidders from contacting SFMTA staff members, other than designated procurement contacts, for the purpose of influencing the contractor selection process or contract award from the date the procurement is issued through final approval by the SFMTA Board of Directors and, if required, the San Francisco Board of Supervisors.

The attestation prohibits all responding firms, subcontractors, lobbyists, and agents from providing gifts, meals, transportation, materials, supplies, or items of value to SFMTA staff during the procurement period. Bidders are permitted to contact city elected officials and the SFMTA Director of Transportation if unable to reach designated staff contacts or to raise concerns about the solicitation itself. Any bidder found in violation of these communication restrictions, whether directly or through agents, lobbyists, or subcontractors, will be disqualified from the selection process. The attestation requires the completing individual to provide their name, the firm name, and the IFB number, followed by signature and date certification that all firm members have complied with the communication limitations.

IFB No. SFMTA-2027-01-FTA

ATTESTATION OF COMPLIANCE

To be completed by all Proposing Firms and All Individual Subcontractors

Limitation on Communications prior to contract award:

It is the policy of the SFMTA that only employees identified in the procurement as contacts for this solicitation are authorized to respond to comments or inquiries from bidders or potential bidders seeking to influence the contractor selection process or the award of the contract. This prohibition extends from the date the procurement is issued until the date when the contractor selection is finally approved by the SFMTA Board of Directors and, if required, by the San Francisco board of supervisors.

All firms and subcontractor(s) responding to this procurement are hereby notified that they may not contact any SFMTA staff member, other than a person with whom contact is expressly authorized by this procurement for the purpose of influencing the contractor selection process or the award of the contract from the date the procurement is issued to the date when the contract award is approved by the board of directors of SFMTA and, if required, by the San Francisco board of supervisors. This prohibition does not apply to communications with SFMTA staff members regarding normal city business not regarding or related to this procurement.

All firms and subcontractor(s) responding to this procurement are notified that any written communications sent to one or more members of the SFMTA Board of Directors concerning a pending contract solicitation shall be distributed by the SFMTA to all members of the SFMTA board of directors and the designated staff contact person(s) identified in the procurement.

Except as expressly authorized in the procurement, where any person representing a bidder or potential bidder contacts any SFMTA staff for the purpose of influencing the content of the competitive solicitation or the award of the contract between the date when the procurement is issued and the date when the final selection is approved by the SFMTA Board of Directors, and, if required, by the San Francisco Board of Supervisors, the bidder or potential bidder shall be disqualified from the selection process. However, a person who represents a bidder or potential bidder may contact city elected officials and may contact the director of transportation of the SFMTA if s/he is unable to reach the designated staff contact person(s) identified in the procurement or wishes to raise concerns about the competitive solicitation.

Additionally, the firms and subcontractor(s) responding to this procurement will not provide any gifts, meals, transportation, materials or supplies or any items of value or donations to or on behalf of any SFMTA staff member from the date the procurement is issued to the date when the contract award is approved by the Board of Directors of SFMTA and if required, by the San Francisco Board of Supervisors.

An executed attestation of compliance certifying compliance with this section of the procurement will be required to be submitted signed by all firms and named subcontractor(s) as part of the response to this procurement. Any bid that does not include the executed attestation of compliance as required by this section will be deemed non-responsive and will not be evaluated.
