Summary of RFP No. 00027451 - Civil and Structural Engineering Services
This document is Amendment No. 003 to RFP No. 00027451 issued by the University of Maryland, College Park for Civil and Structural Engineering Services under an Indefinite Delivery Contract (IDC). The contract is for a two-year term and will provide engineering services to support university projects on an as-needed basis through individual task orders. The University anticipates utilizing services across multiple campuses within the University System of Maryland, with task orders potentially encompassing civil engineering, structural engineering, site design, environmental engineering, survey work, project management, and ancillary services such as cost estimating and value engineering. Example project types listed in the solicitation include campus improvements, stormwater management, parking lot reconfiguration, landscape improvements, condition assessments, feasibility studies, and design analyses. Five firms were previously awarded under the prior contract cycle.
The total spending under the previous contract cycle was approximately $2.8 million over five years, distributed among the five incumbent firms: Rummel, Klepper & Kahl; Morton Thomas & Associates; AECOM Technical; Whitman Requardt Associates, LLC; and TranSystems Corporation. The annual contract maximum per firm is $2,000,000, with MBE participation goals established for task orders exceeding $100,000. Proposals must be submitted electronically via Box Link and must include completed SF 330 forms, required attachments, and key personnel resumes. For task orders exceeding $200,000, MBE sub-goal participation will be established, with prime MBE-certified firms permitted to perform up to 50 percent of the overall MBE participation goal using their own workforce. Key personnel, including the Principal, Project Manager, and Lead Civil Engineer, must be employees of the prime firm and located in the proposed office, with availability for in-person meetings and campus visits. Example projects must demonstrate substantial completion within seven years and should best illustrate the team's qualifications for the contract.

Amendment No. 003
RFP NO. 00027451
Civil/Structural IDC
1: Q: Will the sub-consultant be able to get a waiver for the insurance coverage?
At this moment our coverage is half of the request amounts. Please see below requirements in the RFP.
Commercial General Liability ("CGL"): Coverage for general liability claims arising from operations of the AE, subconsultants and suppliers, with terms and conditions of the CGL coverage to be provided through the use of ISO Coverage Form CG-00-01- 1001 or its equivalent, and shall include at minimum the following:
1. $2,000,000 Per Occurrence Limit;
2. $4,000,000 General Aggregate Limit;
3. $4,000,000 Products/Completed Operations Limit;
4. Additional Insureds endorsement ISO CG 20 10 and CG 20 37, etc?
A: The Prime is responsible for the coverage – it is up to the Prime as to the coverages they require for their subconsultants.
2. Q: Under Section I.M: “For task orders exceeding $100,000.00, an MBE subcontract participation goal and/or sub-goals will be established for each task order, including any future contract modifications.” Can the MBE participation goal be satisfied by a prime MBE firm, or must it be met solely through MBE subcontractors? If subcontracting is required, what is the applicable sub-goal? A: The sub-goal will be determined for Task orders expecting to exceed $200,000.00. If the Prime is a certified MDOT firm they are permitted to perform with its own workforce toward fulling up to, but no more than fifty-percent (50%) of the overall MBE participation goal, including up to one hundred percent 9100%) of not more than one of the MBE participation subgoals if any, established for the Contract. This is identified in the MBE forms provided in Amendment Number One (1)
3. Q: Section III.E.1.5.c states : “The proposed key personnel shall be located in the office proposed to perform the work”. Would the University consider allowing key personnel to work remotely? A: Proposed key personnel shall be based out of the office proposed to perform the work and be available for in-person meetings and campus visits as necessary.
4. Q: With reference to Attachment M – Project Experience Matrix, would the University consider modifying the requirements to allow site development and park facility projects as acceptable examples of relevant experience in lieu of university campus projects and outdoor athletic facilities? Additionally, in place of direct experience with a university approval process, would the University consider experience with MDE, DNR/DGS, and other Maryland state or local agency approval and permitting processes to be acceptable? A: Example projects should best illustrate the team’s qualifications for the contract. The University approval process includes permitting from all applicable authorities having jurisdiction.
5. Q: Since we are a small MBE firm specializing in water resources and civil site design, we rely on our subcontractors to support us with other engineering services. Would the University consider allowing our subcontractors’ experience and expertise to be included in the technical proposal for evaluation? A: The proposing firm must meet all of the qualifications in the RFP.
6. Q:How many contracts were awarded in the previous solicitation? A: Five (5)
7. Q: Who is the incumbent firm? A: There were five (5) firms as follows:
Rummel, Klepper & Kahl A Morton Thomas & Associates AECOM Technical Whitman Requardt Associates, LLC TranSystems Corporation (prior named: Whitney, Bailey, Cox & Magnani)
8. Q: What is the total amount of spending through this contract for last round please? A:
Approximately $2.8M over a five (5) year period.
9. Q:The RFP states that Mechanical and Electrical Engineer qualifications are not part of this evaluation. One of the example projects mentioned describes a design study of existing parking garage lighting systems. What lighting components are you looking for:
lighting design, including photometric calculations, or lighting support structure design, or
A: Mechanical and Electrical Engineer qualifications are not part of this evaluation.
Mechanical and Electrical Engineer services may be sub-contracted as required by individual task orders and are dependent on the specific scope requested.
10. Q: For the insurance policy, please advise if excess liability/umbrella liability is needed for consulting and engineering services and should apply to this contract. Given that the total contract value will not exceed $2 million, a $5 million per-occurrence limit appears excessive. Would the University consider reducing or excluding this liability insurance requirement? A: The $5 million per-occurrence limit is correct and will apply to this Procurement
ADD THE FOLLOWING LANGUAGE: The contract is governed in all respects by the laws of the State of Maryland without reference to its conflicts of laws principles.
All policies for liability protection, bodily injury, builder’s Risk or property damage must specifically name on its face, the State of Maryland, the University System of Maryland, the University of Maryland, College Park, and the Client institution (if applicable) as an additionally named insured as respects to operations under the contract and premises occupied by the Contractor provide, however, with respect to the Contractor’s liability for bodily injury or property damage, such insurance shall cover and not exclude Contractor’s liability for injury to the property of the University System and to the persons or property of employees, students, faculty members, agents, officers, regents, invitees or guests of the University System.
11. Q: Please confirm whether bridge structural engineering is required for this contract. If so, please advise whether a bridge engineer resume is required. Would you consider allowing a structural engineer and a bridge engineer resumes? A: Structural Engineer is required for this contract. 29. Q: Do you have a preferred section that you want the required forms? A: Please put in order of criteria per RFP or attach them at the very end of your submittal.
30. Q: For attachment I, Professional Liability Insurance Form, will a copy of our COI suffice for evidence of liability insurance? If so, does the COI need to be submitted with this solicitation or after selection? A: The form needs to be filled out and submitted with the proposal. If one of the selected firm(s) an actual certificate would be requested at that time.
31. Q: Section III.E.1.6(a) states “Submit projects whose construction is substantially complete within the last 5 years” but the evaluation criteria emphasizes concept studies, condition assessments, analyses, and reports which do not have construction involved. Are non-construction projects (studies, assessments, etc.) acceptable as example projects even without a substantial completion date? A: Substantially complete non-construction projects are acceptable examples within the last seven(7) years.
32. Q: Will you accept exceptions to the terms and conditions that align more with professional services? The current indemnification language is non-insurable. If so, do exceptions need to be approved by UMD prior to selecting consultants or can they be negotiated post-selection? A:
Working on response and will issue with next Amendment.
33. Q: Under Require Forms, it lists Attachments I-M, but the RFP contains additional attachments N-R. Can you confirm attachments N-R are not required as part of this submission? A: The items listed as Attachments I – M are the correct ones to be submitted with the proposal.
34. Q: Will you consider an extension for the proposal, as the structure of the proposal is dependent upon the answers we receive in the addendum? A: This has already occurred as part of Amendment Number Two (2)
35. Q: Section F Example projects list asks that firms include the following in their write-ups:
1) Project name and location.
2) Owner’s name, contact person and phone number.
3) Names of the prime firm and consultants, and the submitting firm’s role on the project.
4) Type of project (new, addition, renovation, etc.).
5) Project delivery method.
6) Construction start and completion dates.
7) Construction cost.
8) Disturbed area.

Attachment M summarizes all the project examples Section F in table format.
36.Q: May the University provide Attachment D1-A (MBE Form) mentioned in the RFP? A: This was provided with Amendment Number One (1)
37.Q: Is a degree in landscape architecture considered a similar field for the Environmental Engineer/Scientist role? A: Yes; however, work experience and responsibilities must demonstrate Environmental Engineer/Scientist qualification requirements.
38. Q: Section III.C.2 of the RFP provides instructions on information to be written on a sealed envelope. May you confirm if hard copies are required for this submission in addition to uploading an electronic version to the box link provided in the RFP? A: No paper copies are needed.
39. Q: Section 1.6.d of the RFP instructs Offerors to provide a summary of submitted SF330 projects on Attachment M, Project Experience Matrix. Please confirm that Attachment M should be included in the “Required Forms” section of the proposal and not after Section F (SF330) project sheets. A: Confirmed.
40. Q: Will future task order assignments be similar in project type, scope, and size as the sample past projects included in Section I.A.3 of the RFP? If not, what type of task assignments are anticipated for this contract? A: Task orders may or may not be similar to example projects. The purpose of this contract is to be able to respond quickly and efficiently to whatever assignments that may be needed to support the University.
41. Q: Are copies of licensing and/or registration required as part of the proposal submission? If so, what section of the proposal should they be included? A: The information is to be provided on Attachment I.
42. Q: For example projects requested in Section F of the SF330, would the University consider expanding the substantial completion date to 8 or 10 years? A: Example projects must have substantial completion within seven (7) years.
43. Q: For example projects requested in Section F of the SF330F, Section III.E.1.6.a states that the project’s construction must be substantially completed within five (5) years, however, Section III.E.1.6.c indicates studies and analysis. Would the University consider allowing the submission of projects that only involved studies or analysis in lieu of construction projects without a detriment to scoring or ranking? A: Substantially complete non-construction projects are acceptable examples.
44. Q: The contract is for Civil and Structural Engineering service, however, the example projects requested for Section F of the SF330, only appear to indicate a focus to civil engineering and/or site design. Would the University consider projects that have a structural engineering focus for either studies or construction without a detriment to scoring or ranking? A: Example projects should best illustrate the team’s qualifications for the contract, which may include a structural engineering focus.
45. Q: Would the University consider allowing the submission of a project example for structural engineering where the structural engineering firm served as the prime A/E or structural engineer of records without a detriment to scoring or ranking? A: Example projects should best illustrate the team’s qualifications for the contract.
46. Q: Section 1.A.5 on page 5 of the RFP lists potential scope of services for the projects within the term contract. Within this list includes cost estimates and cost analysis / value engineering. A cost estimator is not listed under the required disciplines outlined on page 4 Section 1.A.3 of the RFP. Would UMD like to see a cost estimator as part of the submitted project team for this RFP? A: A cost estimator is not required to be identified for this contract. Task orders requiring a cost estimate/value engineering may be sub-contracted, if necessary.
47. Q: Section III.C.2 notes that proposals must also be submitted via sealed envelope – can you confirm that both a digital copy of the technical proposal submitted via box AND a physical sealed copy of the proposal are required? A: See response to question 14.
48. Q: Under Section III.E.1.5.b on page 26 of the RFP the qualification requirements for each key personnel are outlined. Can the Project Manager be the same individual as the Lead Civil or Structural Engineer on the project? A: Yes, but must be identified when submitting your proposal.
49. Q: Page 29 Section III.E.1.5.c notes that the proposed key personnel should be located within the office which is proposed to perform the work. Does this mean that the key personnel must be within the Prime’s staff or could they be included within the project team as subconsultants to a different prime, as long as the individuals and their offices are outlined in the SF-330 Section D and Section E resumes are provided? A: Principal, Project Manager and Civil Engineer cannot be subconsultants. Subconsultants included as Key Personnel are required to submit SF 330.
50. Q: Will SF-330 Section F Project Examples be considered if photos of the completed projects are included? A: Project photos may be used to illustrate example projects.
51. Q: If SF-330 Section F Project Examples contain photos, will these be considered in the evaluation of the submissions? A: See response to question 50.
52. Q: Does this statement mean that MEP Engineer resumes should be included in our proposal. There may be other disciplines such as mechanical and Electrical Engineer that may be sub-contracted as required by individual task orders. Their qualifications are not part of this evaluation, but if required, qualifications of these individuals must be submitted and approve din writing by the University. A: See question #9 Mechanical and electrical Engineer qualifications are not part of this evaluation. MEP Engineer services may be subcontracted as required by individual task orders and are dependent on the specific scope request.
53. Q: Can an Engineering firm submit as a Prime and be a Sub to another Engineering firm? A. The University would prefer to not have this scenario.
54. Q: Who are the incumbents for this contract? A: This was already addressed in response to item 7.
55. Q: Please describe what exterior tasks were involved in this previous project: Exterior and site landscape improvements at Paint Branch Building. A: Included but not limited to: Survey, demolition, grading, parking lot reconfiguration, hardscape, planning, stormwater management, signage, lighting, pavement marking, permitting, etc.,
56. Q: For a project such as this, Campus steam pipe renewal, how would other necessary disciplines be procured? Should we include resumes for these disciplines in our proposal? A: See questions #9 MEP qualifications are not part of this evaluation. MEP services may be sub-contracted as required by individual task orders and are dependent on the specific scope requested.
57. Q: The evaluation order of importance of the requirements above is as follows (#4). Is there a percentage of importance. I.E is 4.1 Similar projects and summary of qualifications included in SF 330 Part I, team resumes, and past experience as prime or joint ventures have the greatest weight 50% or greater? A: The University will determine the values after the proposals are submitted, but before they are evaluated.
58. Q: As there was a slow-down in work due to the pandemic, is there consideration of modifying the completion date to 7 years instead of 5 years. A: Yes – change to 7 years.
59. Q: Which forms are required to be submitted with the Technical Proposal? The list in Section III page 8 of the RFP is different from the attachments outlined on the Solicitation Schedule. A: The forms listed in the Solicitation Schedule are correct with the exception of Attachment N Sample Master Contract and Attachment O – Sample Modification.
