About this file

This is Amendment 004 to RFP 00027451 for Civil and Structural Engineering Services issued by the State of Maryland. The amendment modifies the original indefinite delivery contract (IDC) solicitation for civil and structural engineering services with a contract term of two (2) years. The amendment document serves to clarify, modify, or update specific requirements, terms, or conditions from the original RFP and any previous amendments.

The specific modifications contained within Amendment 004 should be reviewed in conjunction with the base RFP documents and previous amendments (001, 002, and 003) to understand the complete and current solicitation requirements. Interested contractors should ensure they incorporate all amendments into their response and comply with all updated terms, conditions, specifications, and deadlines established through this amendment process.

Amendment No. 004

RFP NO. 00027451

Civil/Structural IDC

1. Q: Since we are a small MBE firm specializing in water resources and civil site design, we rely on our subcontractors to support us with other engineering services. Would the University consider allowing our subcontractors’ experience and expertise to be included in the technical proposal for evaluation? A: The proposing team must meet all of the qualifications in the RFP. Clarification from Amendment No. 003: Also, previously addressed in Amendment Number Three (3) as follows: Principal, Project Manager and civil Engineer cannot be subconsultants. Subconsultants included as Key Personnel are required to submit SF 330.

2. Q: Will you accept exceptions to the terms and conditions that align more with professional services? The current indemnification language is non-insurable. If so, do exceptions need to be approved by UMD prior to selecting consultants or can they be negotiated post-selection? A: To the fullest extent permitted by law, the Consultant shall indemnify and hold harmless the University of Maryland College Park (UMCP), the State of Maryland, University System of Maryland ("USM"), and their respective agents, servants and employees, from and against all claims, damages, losses and expenses, including but not limited to attorney's fees, arising out of or resulting from the performance of the Project work by the Consultant, provided that such claim, damage, loss, or expense is caused in whole or in part by any negligent or willful act or omission of the Consultant or any employee, agent or subcontractor of the Consultant. This obligation is not intended to be or to imply a waiver of the sovereign immunity of UMCP, USM or the State of Maryland. The University does not assume any obligation to indemnify, hold harmless, or pay attorney’s fees that may arise from or in any way be associated with the performance or operation of this Master Agreement. In addition:

There will be no exception to T’s & C’s.
