Questions and Answers # 4
ADVERTISEMENT NUMBER: DOT-RFP-25-5002-TIML SunRail DESCRIPTION: Central Florida Rail Corridor (CFRC) Track Improvements - Multiple Locations
DATE: 9/25/2024
1. In reference to Section 2, Proposer's Management Plan, subsection b. Identification of Key Personnel, would the Department limit resumes to 1-page and exclude resumes from the overall page count?
Answer: In reference to Section 22.212.b. Identification of Key Personnel, The Vendor may provide one (1) page per resume and shall exclude resumes from the overall page count.
2. Given that key personnel must be included in our proposal response, could the Department specify the key personnel roles or positions that proposers must include in their technical proposal? This clarification would help ensure consistency in how each team staffs the project and prices their proposals.
Answer: The Vendor shall specify the roles, functions and responsibilities of the following personnel:
Project Manager
Track Superintendent
Field Track Foreman
3. With the work to be performed for each work package, is one RWIC provided by Alstom sufficient to cover the working limits? If the Department requires a Point of Contact (POC) in addition to the RWIC, would the POC be provided by the Department?
Answer: Each project is required to have an RWIC. The Vendor shall provide an estimate of the project’s needs and the locations. One RWIC may cover up to five (5) continuous miles with appropriate Point-of-Contacts (up to five (5)). No more than five (5) RWICs may be deployed within the CFRC at any one time.
Alstom would provide the POC if required. The Vendor shall include POC hours and use a daily rate of $1,000.00 up to and including a 10-hour day and an overtime rate of $100.00 per hour after 10 hours.
4. Since the RFP requires a detailed proposal outlining the approach, experience, and qualifications of teams, would the Department consider using a best value selection process instead of a low-bid approach? This would allow for a more balanced evaluation that considers both the cost and quality of the proposed solutions, ensuring that FDOT and the project benefits from the most effective combination of price, experience, and performance capabilities.
Answer: The Department will continue with the RFP approach as advertised.
5. The RFP Checklist does not reference Form No. 3 (Vendor Data Sheet) or Form No.
10 (E-Verify). Can you confirm whether these forms are required? If so, could you indicate which volume they should be submitted in—the Technical Proposal or the Price Proposal?
Answer: Form No. 3 and Form No. 10 are required and should be included in the Price Proposal file.
6. Scope of work section 2.1.10, states that the vendor shall supply and use a dynamic track stabilizer to minimize slow orders. Section 5.0, timber crossties, states "following tie or ballast installation, track stabilization is to be achieved using a stabilizer or slow order and tonnage before returning the track over to dispatch." Please confirm the vendor has the option to utilize a stabilizer or slow order and tonnage at the vendor’s discretion.
Answer: The Vendor has the option to utilize a stabilizer or slow order and tonnage at the Vendor’s discretion.
7. Exhibit A (Scope of Services), Section 3 indicates a track outage period of 9 hours for weeknights, rather than 91/2 hours indicated by the 1900-0430 time period.
Please clarify. The same section also indicates a track outage period of 17 hours for weekends (0600-2300). Please confirm that this outage is available for both weekend days, Saturday and Sunday.
Answer: The correct weeknight outage duration is 9 ½ hours. The weekend outage period of 17 hours is available for both Saturday and Sunday.
8. Exhibit A (Scope of Services) in Appendix 4 (page A-3) states that track joints in the #15 turnout are not to be thermite welded. Please clarify.
Answer: Track Joints in the No 15 Turnout shall be thermite welded in accordance with CFRC MWIs.
9. Exhibit A (Scope of Services), Appendix 4 (MOW Siding)
Section 3 (page A-2) states that the Vendor shall furnish ties, rail, ballast, IJ’s, OTM and a switch stand & throw rod. Section 5.0 (page A-5) states that the Department will furnish the turnout, rail, ties, OTM and ballast. Please clarify the extent of
Vendor furnished material for the MOW Siding project.
Answer:
Exhibit A, Appendix 4, Section 5.0 Services/Materials Provided by the Department, revised as follows:
“5.1 The Department shall provide the one partly worn No. 15 turnout (all components assumed to be in a state of good repair), all required partly worn 115 RE rail, all required new timber track ties and new track tie plates, switch stand material, and headblock ties as owner furnished inventory.
Exhibit A, Appendix 4, Section 3.1 revised as follows:
3.1.1 The Vendor shall distribute and install the No. 15 turnout, all track ties, track tie plates, switch stand, head block ties and derail. The Vendor shall refer to the CFRC MOW

The Vendor shall furnish, deliver, and install all remaining OTM, welding, etc., necessary to complete the work.
3.1.2 No change.
3.1.3 The Vendor shall coordinate with the Department’s Signal Maintenance Contractor to ensure the proper throw rods are furnished.
10. Please confirm the stationing & location of the southern-most crossover on Project
Answer: Mileposts are approximate, point of switch would be MP 789.72. Please refer to the stationing for the correct location.
11. Please provide shop drawings for all special trackwork in possession of FDOT, that
12. Please verify that "The Vendor shall furnish, distribute, and install all other materials (OTM, welds, etc.) as necessary to complete the work.", on Project 1.
Answer: Yes, see Exhibit A, Appendix 1, Section 3.1.1.
13. Please verify that "The Vendor shall furnish, distribute, and install all other materials (OTM, tie plugs, etc.) as necessary to complete the work. ", on Project 2.
Answer: Yes, see Exhibit A, Appendix 2, Section 2.1.4.3.
14. Please verify that "The Vendor shall furnish, distribute, and install all other materials (asphalt, ties, ballast, insulated joints, OTM, welds, etc.) as necessary to complete the work. ", on Project 3.
Answer: Yes, see Exhibit A, Appendix 3, Section 3.1.1.
15. Please verify that "The Vendor shall furnish, distribute, and install all other materials (ties (including switch ties), rail, ballast, insulated joints, OTM, welds, etc. as necessary to complete the work.. ", on Project 4.
Answer: See response to Question 9.
16. Proposer requests the start of the Contract Time to be tied to the Notice to Proceed.
As drafted, it reads that it will be the earlier of 30 days after Notice to Proceed or the commencement of work, whichever is earlier. This creates confusion as it can be difficult to determine what constitutes the “commencement of work”. For example, would preconstruction work be considered the “commencement of work”. So as to avoid ambiguity in the contract, Proposer recommends subclause (2) be struck.
will be installed by the contractor.
Answer: Shop drawings are included with Addendum 5, as Exhibit "P" .
Answer: Commencement of work would take place when any services related to each project are performed.
17. Proposer recommends a cap on liquidated damages not to exceed twenty-five percent (25%) of the Contract Price or in the alternative a different amount that can be negotiated between the parties. Uncapped liquidated damages create a great risk to Proposers and for a project of this size, may be unacceptable. This will further allow a Proposer to quantify its damages and reduce the risk allocation necessary for the project.
Answer: Exhibit B, Method of Compensation shall be revised to state that Liquidated
Damages will be applied up to a limit of 25% of each project cost. See Addendum 5.
18. As drafted this clause, appears to make it seem as though the Contractor is waiving all of its rights it may have under any statute, rule, or even case law which is extremely harsh. Is this meant to apply to laws related to venue? If so, will FDOT agree to revise as follows: “In any legal action related to this Agreement, instituted by either party, the Contractor hereby waives any and all privileges and rights it may have under Chapter 47 and Section 337.19, Florida Statutes, relating to venue, as it now exists or may hereafter be amended, and any and all such privileges and rights related to venue it may have under any other statute, rule, or case law, including, but not limited to those grounded on convenience.”
Answer: No, the contract remains as written.
19. I noticed on the Price Proposal Form top right there is line for FOB. I haven’t seen this before and wondered what they are looking to be submitted there. Could tell me what they are looking for here?
Answer: “FOB” line deleted in Price Proposal Form. See Addendum 5.
20. Exhibit A Scope of Services: 11.Warranty
This states that "Any item or material furnished and/or installed under this contract found to be defective within two years after final acceptance, shall be repaired, remedied or replaced by the Vendor..." Since almost all of the permanent materials are being provided by FDOT, this statement should be revised to limit this to materials supplied by Vendor, or for FDOT supplied materials damaged by Vendor during installation. Industry standard is 1 year warranty on Vendor supplied materials.
Answer: No, the warranty period remains as written. Department furnished material shall be inspected by the Vendor and any deficiencies identified will be discussed and mitigated with the Department before installation.
21. Exhibit A Scope of Services: Appendix 1 Section 5.0 Services/Materials Provided By the Department
In regards to Q&A #3, Question 2 response states that the material to be provided by the Vendor is limited to spikes and anchors. Can you confirm the anchors needed are to fully box anchor the track leading up to and departing from the special trackwork? Are the spikes needed due to miscellaneous replacement in the area of the additional anchors? Please confirm that the Insulated Joint Plugs required are to be FDOT supplied.
Answer:
Yes, the anchors shall be box anchored in accordance with CFRC MWIs.
Yes, spikes needed due to miscellaneous replacements in the area of the additional anchors in accordance with CFRC MWIs.
Yes, Insulated Joint Plugs will be supplied by the Department.
22. Exhibit A Scope of Services: Appendix 2 Section 3.3

Please confirm that there are no impacted IJs, or if there are impacted IJs, then please provide locations/quantities as well as who is to provide.
Answer: The Vendor shall assume that there are no impacted IJs for Project 2.
23. Exhibit A Scope of Services: Appendix 2 Section 2.1.10
States "The Vendor shall supply and use a dynamic track stabilizer to minimize slow orders." Section 5.0, clause 5.1 Timber Ties bullet 5 states "Following tie or ballast installation, track stabilization is to be achieved using a stabilizer or slow order and tonnage..". As a dynamic stabilizer is can be a large cost, please clarify if dynamic stabilization is required, or if slow order and tonnage will be allowed.
Answer: See response to Question 6.
24. Exhibit A Scope of Services: Appendix 3 Section 6
Is the Vendor responsible for coordinating delivery of the Department furnished materials (ties, crossing panels, ballast) to the jobsite or are they responsible for picking up from a Department yard and transported to the jobsite?
Answer: The Department will deliver the owner furnished inventory to a location near the jobsites in Project 3.

This directs you to CFRC MWI-602-03 for the details of the derail to be furnished by the Department's Signal Maintenance Contractor, but we do not see this drawing in the RFP Package. Please provide that detail and details for the switch stand and throw rods to be furnished by the Vendor.
Answer: Switch stand and throw rods will be furnished by the Department. The Vendor shall refer to the MOW Standard Section 2.5.10 Switches.
31. Exhibit E, Insurance
Exhibit “E” Insurance Requirements, (5) requires the Department and Utility
Company to be Additional Named Insured a General Comprehensive Liability
Insurance policy with limits of $1,000,000 for bodily injury or death and $300,000 property damage. Additionally, eight other specified entities require additional insured status. Contractor cannot include non-related entities as Named Insureds on its corporate program but could procure an Owner and Contractors Protective
(OCP) liability policy in the name of Owner and Utility Company to meet this requirement. However, OCP policies do not allow additional insureds. Please confirm that Contractor can meet this requirement by obtaining an OCP policy to cover the Owner and Utility Company as Named Insureds, and separately including the other required additional insureds (Amtrack, Florida Central Railroad, etc.) as additional insureds on Contractor’s corporate Commercial General Liability policy.
Answer: Yes
32. Exhibit E, Insurance
Exhibit “E” Insurance Requirements, (6) Insurance by Others requires the
Contractor to require every Subcontractor or other third party who may have a contract with Contractor and who may require access on or to State Property or the
Sun Rail Corridor or the FCEN Corridor to obtain and maintain for the duration of such access insurance which satisfies the conditions stated in this section 4. B.
paragraphs (1), (2), (3), (4), and (5). Firstly, there seems to be a drafting error regarding the previous paragraph references. Please confirm that you mean in paragraphs (1), (2), (3), (4), and (5) of this Exhibit since there is no 4. B (1), (2) or (3).
Secondly, it is duplicative and not industry standard to require subcontractors, in addition to Contractor, to provide insurance per paragraphs (4), Railroad Protective
Liability (RPL), and (5) Owner and Contractors Protective Liability (OCP). Insurers will not agree to write multiple RPL and OCP policies on the same project for the same Named Insureds because these policies already cover all operations of the
Contractor and all subcontractors related to the covered Project. Please consider the following amendment:
(6) Insurance by Others: Contractor shall require every subcontractor or other third party who may have a contract with Contractor and who may require access on or to State Property or the Corridor or the Sun Rail Corridor or the FCEN Corridor to obtain and maintain for the duration of such access an insurance policy or policies with coverage that satisfies the conditions stated in this section 4. B. paragraphs
(1), (2), and (3), (4), and (5), and including causing each of the Named Insureds and the additional insureds stated in those paragraphs to be Named Insureds and additional insureds on such subcontractor or third party policy or policies.
Answer: Insurance requirements remain as written.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage https://sam.gov/wage-determination/FL20240128/2 3/6 determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
State Adopted Rate Identifiers https://sam.gov/wage-determination/FL20240128/2 4/6
Classifications listed under the ""SA"" identifier indicate that the prevailing wage rate set by a state (or local) government was adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
01/03/2024 reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210 https://sam.gov/wage-determination/FL20240128/2 5/6
4.) All decisions by the Administrative Review Board are final.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($17.20) or 13658 ($12.90). Please see the Note at the top of the wage determination for more information. Please also note that the minimum wage requirements of Executive Order 14026 are not currently being enforced as to any contract or subcontract to which the states of Texas, Louisiana, or Mississippi, including their agencies, are a party.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
https://sam.gov/wage-determination/FL20240129/1 3/6
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current https://sam.gov/wage-determination/FL20240129/1 4/6 negotiated/CBA rate of the union locals from which the rate is based.
