Question # Question Answer
There is a FAR Incorporated 52.204-4 under “CLAUSES INCORPORATED BY
REFERENCE” does the government require the offerors submission to comply with this FAR?
Yes. Offerors should comply with all provisions and clauses included in the solicitation.
In the Solicitation there are many references incorporated that can be found in the NAVAIR Clausebook. AerSale requests access to the NAVAIR
Clausebook to ensure we remain compliant with all regulations and clauses mentioned in the Solicitation.
NAVAIR will not provide a copy of the clausebook. All applicable Local (NAVAIR)Cclauses are included by full text. There is no need to provide the clausebook
"The current quantities listed per CLIN in Section B do not currently match all quantities listed in Attachment L-5. These CLINs include 1019, 2013, 2019, 3013, 3019, 4019, 5041, and 6041. In addition, CLINs 0019 and 5035 are listed in Attachment L-5, but they are not listed in Section B.
Is it the Government's intent to revise Section B quantities to match the quantities in L-5 and to add CLINs 0019, and 5035, or should offerors provide different pricing in Section B and in L-5?"
Both Section B and the L-5 attachment have been corrected in amendment 0003. All items now have matching quantities.
Pricing in Section B and L-5 for all CLINS should match and the pricing submitted by the offero should be the same .
"There is not currently a location in the Solicitation Model Contract to individually list the price of each FFP Technical Directive. The Government answered question 188 on 11/7/2016 that "" the Government does not intend for the Offerors to insert SLINs for the price of each TD. The Offerors should price at the CLIN level on the IDIQ. The Contractors shall break out pricing into subline items at the task order level.""
Is it the Government's intent to include Attachment L-9 as an attachment to the awarded contract as a price list per TD, or should industry include
Attachment L-9 into the Model Contract under Section B as an Appendix? Is it also the Government's intent for Offerors to have a ""Max Amount"" but no Unit Price on each TD FFP CLIN, with a note on the CLIN that ""Pricing in accordance with Attachment L-9""?"
Yes, it is the Government's intent that Attachment L-9 is intended to be attached to the Contract as a price list per TD. Yes, it is the Government's intent for the Offerors to have a MAX Amount but no Unit Price on each TD FFP CLIN with a note on the
CLIN that "Pricing in accordance with Attachment L-9".
"The current Solicitation Model Contract has a Max Quantity of 2 each CLIN
0001, but per Clause H-1 Note (b):
""During the Base award of CLIN 0001 (Airframe) one each to the two respective Basic IDIQ contract holders and CLIN 0080 (Engine) one each to the two respective Basic IDIQ contract holders are minimum guarantees.""
Is it the Government's intent for each offeror to only price 1 ea CLIN 0001 in Section B, or is it the Government's intent for offeror's to provide a max amount for 2 ea. CLIN 0001 in Section B?"
Each offeror should price a qty of 1 each for CLIN 0001.
With the Government’s desire of awarding against the model contract, would it be correct for offerors to assume that they should provide a conformed and corrected copy of the model contract, inclusive of corrections to quantities (i.e. CLIN 0001, qty: 2each), and changes in
Amendment (1), (2) and any subsequent amendments? Or alternately, is it the Government’s intent for contractors to provide a model contract based only on the base solicitation contract, provided on 22 September 2016?
Offerors should provide a conformed and corrected copy of the model contract inclusive of corrections to quantities and the changes made in all amendments.
Paragraph 1.1 of the Statement of work states that, "The Contractor shall ensure deliverable data, developed for the International Cooperative
Program, is exportable, in accordance with the existing Technical Assistance
Agreements or subsequent export authorizations, all other International
Traffic in Arms Regulations (ITAR), and Export Administration Regulations
(EAR) requirements." Emphasis added.
1. Please clarify whether “the existing Technical Assistance Agreements” refers to a) Technical Assistance Agreements and other export authorizations that the offerors may have already obtained in connection with the P-8A Aircraft Depot procurement, or b) something else.
2. If the Navy has obtained its own Technical Assistance Agreements for the program, please provide a copy to the offerors.
We have no specific technical agreement other than an MOU with Australia which is now posted to FBO. the language is intended to notify the contractor that P-8 is a Cooperative Program with Australia and as a result, a requirement for export is associated with the contract. This requires the appropriate export authorization.
Previously in Q&A #266, TD 737-SL-32-168 was removed. However in reviewing the new L-9 the USG has added back the TD.
Please confirm TD 737-SL-32-168 is still removed and a new L-9 will be provided removing that requirement.
Yes. TD 737-SL-32-168 is still removed but marked as reserved. Amendment 0003 will be issued providing updates to the quantities in L-9
Would it be possible for NAVAIR to provide the Weight and Balance Manual to accurately estimate the hours need to prepare the aircraft for proper configuration prior to weighing the aircraft.
The AMM Task 08-11-00-580-801, Subtask 08-11-00-580-001 refers you to the Weight and Balance Manual.
