Justification and Approval for Other than Full and Open Competition Justification

1. Contracting Activity: Colorado Air/Army National Guard, 660 S. Aspen St. Aurora, CO 80011

2. Description of Action: A new sole source firm fixed price construction contract which includes “Brand name only” components listed below, which will be awarded using MILCON funding.

3. Description of Supplies/Services: CONSTRUCT SPACE CONTROL FACILITY (Project No. TDKA 16-9004) in support of the Colorado Air National Guard (COANG) at Peterson Air Force Base, Colorado that includes the six (6) “Brand Name” components below:

a. Best Lock Cores (Best Access System CORMAX patented keyway with interchangeable core type operating cylinders). These are the door hardware lock cores required to be utilized on all facilities on Peterson Air Force Base in order to comply and integrate with the current system utilized by the 21st Space Wing on Peterson Air Force Base. The use of a single lock core enables the systematic management of the lock system on the host base facilities. Providing a single lock core for all installation buildings allows for single keying a tracking mechanism, an emergency response master key to work properly in emergency situations for both security forces and fire department and reduced maintenance and training costs for the Air Force over the lifecycle of the building.

b. Knox Box (Rapid Entry Lock Box). These are key storage lock boxes used by the fire department for quick access to buildings in case of an emergency. The fire department on Peterson Air Force Base utilizes this box on all facilities at the installation. Providing a single lock box vendor for all the buildings allows for a single keying and tracking mechanism, an emergency response master key to work properly in an emergency for the security forces and the fire department, simplified system maintenance and upkeep, and single system training for the base.

c. Johnson Controls Metasys (EMCS). This is an integrated base wide mechanical controls system required by the installation to control services, monitor performance and energy use. This system enables the project facility controls system to interface with the existing EMCS on the base via fiber connection to the project facility. A single controls vendor for Peterson Air Force Base allows for the seamless integration between all facilities, simplified and reduced training costs for end users, reduced maintenance costs over the lifecycle of the building, reduced cost of spare parts and service maintenance contract costs, and in the event of a system failure reduced downtime for the unit. Due to the proprietary nature of the software and this requirement, soliciting other contractors is not conducive to this effort. Furthermore, due to the size and complexity of the Building Automation System (METASY) system, changing the entire system would not be cost effective to the Government.

d. Edwards Systems Technology (Fire Alarm System). The system is currently utilized by the 21st Space Wing, Peterson Air Force Base, on all facilities located at the installation. The system is required to communicate with the established base wide fire alarm system currently installed and utilized at Peterson Air Force Base and to communicate with the Base Fire Control Room thus assuring immediate fire rescue response time to the facility and users when triggered. Providing a single Fire Alarm network allows for the seamless integration between all installation facilities reduced maintenance costs over the lifecycle of the building, reduced cost of spare parts and reduced service maintenance contract costs.

e. Lifepak CR-Plus (AED Cabinet). These items are currently utilized by the 21st Space Wing at Peterson Air Force Base. This is the infrastructure standard currently installed and familiar with first responders at the installation. The system is required to communicate with the established base wide fire alarm system currently installed and utilized at Peterson Air Force Base and to communicate with the Base Fire Control Room thus assuring immediate emergency response time to the facility and users when triggered.

f. Vindicator (Access Control System). This is the access control system utilized by the 21st Space Wing, Peterson Air Force Base on all facilities located on the installation. Brand name components are essential, as this equipment must be fully compatible with the existing Vindicator systems located throughout the installation.

Providing a single access control system allows for system compatibility, reduced training, reduced maintenance costs over the lifecycle of the building, and reduced cost of spare parts.

4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements – it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: Maintenance and repair training for these systems is brand name specific, and it is necessary to integrate the facility and facilitate the seamless communication between this COANG facility and Peterson Air Force Base host facilities as well as allow for spare parts compatibility and reduce storage and efficient training requirements.

With multiple brand names, the end user of the facility would need to be trained on how to utilize, maintain, and repair all the different systems. The costs over the lifecycle of the facility would also be increased for service and annual maintenance.

The Base Civil Engineer spare parts inventory will remain manageable with all systems of the same brand name. Also for every brand name specified, a different software system is required;

resulting in additional costs to the government for the purchase and maintenance of each system.

By using the aforementioned systems listed in this document, communication and compatibility issues will be alleviated and result in a fully integrated and functioning base wide system.

Having the same brand name on all required systems would be the most cost effective solution for the government.

6. Efforts to Obtain Competition: The brand name components represent a small portion (<1%) of the overall construction project that is being competed. Market research has identified multiple vendors capable of installing the systems identified above, which will provide price competition.

7. Actions to Increase Competition: No action taken at this time.

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 12 months:

a. Contacted knowledgeable individuals in the Government, including the COANG Base Civil Engineer and Deputy Base Civil Engineer, and industry regarding the market capabilities to meet the requirements.

b. Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies that provide information relevant to agency acquisitions. Search of https://beta.sam.gov indicated within the last 24 months that other agencies, such as Department of the Air Force and Army have also posted similar justifications for brand name requirements for their applicable construction contracts.

c. Posted the list of brand name items with synopsis, prior to to solicitation.

There are no know alternative systems that are fully compatible with the systems based on lessons learned from previous similar construction projects and expert judgement by subject matter experts and the experience of the COANG and Air Force.

10. Other Facts: The selection of these systems have been used on previous construction contracts accomplished at Peterson Air Force Base, and are specifically identified in their design guide. Consistency of the systems is required to:

a. Ensure facility security on the installation

b. Ensure seamless integration and communication of this facility to Peterson AFB host systems

c. Reduce maintenance costs over the lifecycle of the facility

d. Reduce training costs and requirements for end users

e. Reduce response time in emergency situations

f. Reduce spare parts stock costs for the Air Force.

This justification will be posted with the solicitation of the construction project.
