Wage Determination (WDs) and Collective Bargaining Agreement (CBA)
Questions:
1) WD/CBA. So as to accurately price Paid Time Off in accordance with the applicable CBA(s), will the Government provide all current CBA Seniority Roster(s)?
Although Amendment #2, page 56, made a revision to rectify this situation. It will be changed again in the next Amendment and additional information for bidding purposes will be provided (Amendment 0007).
UPDATE: After review and researching, we will not be providing offerors with a detailed seniority roster for bidding purposes; this seniority list will only be given to the awardee within thirty (30) days prior to the contract start date in accordance with FAR 52.222-17.
However, in order to give offerors as much information as possible to create an accurate proposal, please see the attached “Seniority List Averages - Amend 8” file which gives the offeror averages for current employees based on years of service and laborer category as of 30-August-2016.
2) WD/CBA. Wage Determination with CBA, page 17, Article 2 Seniority, 3.07
Severance Pay. The cost of severance pay cannot be estimated based solely on the information provided. Would the government supply a seniority list without names to assist in estimating the cost over the life of the contract?
Although Amendment #2, page 56, made a revision to rectify this situation. It will be
UPDATE: Please see WDs and CBA Questions #1 for the answer to this question.
5) WD/CBA. FAR 52.222‐17, Nondisplacement of Qualified Workers (May 2014) (E.O. 13495). Flow down required in accordance with paragraph (1) of FAR clause
52.222‐17. "Nondisplacement of Qualified Workers Under Service Contracts; The regulations require that workers on a federal service contract, who may otherwise lose their jobs as a result of the completion or expiration of a contract, be given the right of first refusal for employment with the successor contractor.
Since the Federal Government’s procurement interests in economy and efficiency are served when the successor contractor hires the predecessor’s employees – as their studies have shown that a carryover work force reduces disruption to the delivery of services during the period of transition between contractors and provides the Federal Government with experienced and a trained work force that is familiar with the Federal Governments personnel, facilities and requirements, they (the Government) benefit – all offerors should be provided with the list of the CBA’s certified service employees during the solicitation phase of this procurement.
Since all Offers will see immediate reductions in the cost of hiring new workers due to this regulation, all Offers will need to be provided the same information about the current incumbent work force. The incumbent (and those offerors they team or collaborate with) have an unfair competitive advantage over other offerors without this cost saving information. If the union will not provide the current seniority list to all Bidders and thus giving the incumbent a significant competitive advantage over all other bidders (since they would be the only one to know actual employee seniorities), the government will not have the benefit of an offerors best industry practices and efficiencies thus causing the price to the government to be higher than it might be otherwise.
As these are the major direct costs bid to the government, please provide all Offerors the following:
The number of incumbent employees (from the list the contractor is required to provide the government upon request);
The current position these employees are qualified for;
The employee wages and benefits; and
A copy of the current contractor's seniority list.
Although Amendment #2, page 56, made a revision to rectify this situation. It will be will be provided (Amendment 0007).
UPDATE: Please see WDs and CBA Questions #1 for the answer to this question.
As for wage and benefit information, these can be found in the respective CBA or wage determination files.
7) WD/CBA. CBA Letter of Agreement # 6 & 7. Please provide letter of agreement #6 & 7 that states the current pay scale for Laborer, Grounds Maintenance, Comms Lead and
Apprenticeships.
This information will be provided in the next amendment (Amendment 0007).
UPDATE: These Letters of Agreement #6 and #7 are now part of the Wage
Determination with CBA documents (pages 51-52). Please see the revised attachment.
8) WD/CBA. Demographic of workforce. Please provide the CBA demographics by shop so offerors can age the workforce appropriately.
UPDATE: Please see WDs and CBA Questions #1 for this question. Though this file does not contain a breakdown of employee ages, this attached should be able to provide enough valid information to propose on.
10) WD/CBA. 4.17 Response Premium. The CBA states all designated response positions shall receive $1.80 for all compensable hours (2080 hours per year) plus if that positions is in a shop that has 3 or less employees in a standby rotation will receive $1.00 additional dollar per hour. Since numerous requirements in the PWS will require response positions (fuel operations, booming, emergency service calls, snow removal, ice control, etc.) will the government please provide the historical percentage of the workforce that receives response premium pay?
UPDATE: Please see the following information for the response:
Those that receive the three (3) person shop premium of an additional $1/hr = 7%
Those that receive response premium (This one varies, as Snow Removal callout is only part of the year) = Varies from 25% to 30%
Those that are on the Second Shift that receive shift 2 pay = 11%
Those that are on Third Shift that receive shift 3 pay = 1%
CLIN Schedule of Prices Questions:
29) CLIN Schedule of Prices: During the site visit, seniority of the existing contract staff was discussed. To eliminate a competitive advantage known only to the current contractor, will the Government consider instructing all Offerors to price labor based on zero seniority?
Although Amendment #2, page 56, made a revision to rectify this situation. It will be
