Final Questions and Answers to

RFP HDTRA2-08-R-0002

“Technical Evaluation Assessment Evaluation Site (TEAMS)” 30 September 2009 Question 1. The SOW Section 5.0 MINIMUM PERSONNEL QUALIFICATIONS FOR LABOR CATEGORIES, paragraph 5.1 Senior Technician/Program Coordinator, says the qualifications for the "Senior Technician/Program Coordinator shall be Radiation Worker 1 certified, knowledgeable with requirements to the Department of Defense (DOD), As Low As Reasonably Allowable (ALARA) philosophy, wear a thermo-luminescent dosimeter (TLD) when working with radiation sources and be qualified for and maintain a secret level clearance. The Senior Technician/Program Coordinator shall be able to determine whether a potential customer or program can be supported by the TEAMS’ facility and the impact to TEAMS infrastructure and resources." Then, Attachment 3, Sample Task Order 1 lists "tasks in accomplishing the requirements of this TO over a five- (5) year period." However, the requirement "shall be able to determine whether a potential customer or program can be supported by the TEAMS’ facility and the impact to TEAMS infrastructure and resources." is not specifically listed in Sample Task Order 1. Is the requirement for the Senior Technician/Program Coordinator "shall be able to determine whether a potential customer or program can be supported by the TEAMS’ facility and the impact to TEAMS infrastructure and resources" a more detailed requirement which is included in the more general list of tasks in Sample Task Order 1?

Answer: Personnel proposed in the Sample Task Orders shall meet the minimum personnel qualifications and the minimum personnel responsibilities as defined in the RFP Statement of Work, attachment 1.

Question 2. At the Preproposal Meeting at DTRA TEAMS on September 4, 2009, there seemed to be several companies attending which produce hardware, software, and/or services which are involved in the radiation detection testing for the government and which potentially could be involved in testing at TEAMS. In the RFP Section H1. ORGANIZATIONAL CONFLICTS OF INTEREST, paragraph H1 a Purpose, it says, "primary purpose of this Clause is to aid in ensuring that: (1) the Contractor's objectivity and judgment are not biased because of its past, present, or currently planned interests (financial, contractual, organizational, or otherwise) which relate to work under this Contract, ..." Because the "Senior Technician/Program Coordinator shall be able to determine whether a potential customer or program can be supported by the TEAMS’ facility and the impact to TEAMS infrastructure and resources", we believe the Senior Technician/Program Coordinator's company would by OCI definition not be allowed to be a "client" at TEAMS which would have to be "supported" nor would be allowed to have hardware, software, or services which would be part of a test being conducted at/by TEAMS. Do you concur?

Answer: Without knowing successful offeror we cannot answer this question completely. However, offeror’s are required to submit an OCI mitigation plan, if applicable, which will be reviewed by DTRA. The Senior Technician/Program Coordinator will not be the final decision maker on who is supported at TEAMS. This decision will be made by the Government.

Question 3. Because the prime contractor has privity of relationship with all their subcontractors, and not the government, don’t they have the authority to designate which NAICS code is appropriate for the type of work they specifically are contracting out to another contractor?

Answer: No. Reference Questions and Answers # 19 on RFP amendment 2 and question # 7 below.

Question 4. The Statement of Work paragraph 7.1 Information Security says "The contractor’s personnel shall have and maintain SECRET security clearances during the term of this effort." However, the RFP Attachment 7, DD Form 254 Block 1a shows a Top Secret Facility Clearance is required. Do the contractors performing the work for the four listed labor categories in SOW paragraph 5 and 6 require Secret or Top Secret clearances?

Answer: Facility Clearance remains Top Secret. Personnel clearances are Secret.

Question 5. Will the work performed on this contract be subject to New Mexico Gross Receipts Tax?

Answer: Yes, at NMGRT rate of 6.875%.

Question 6. Page 42 of the RFP, Paragraph 4.1, says "For each relevant and present and past performance reference, the offeror shall provide a narrative and a Present and Past Performance Form (Attachment L1). Each offeror is requested to submit the narrative and the information shown in Attachment L1 for each relevant contract. The narrative shall describe the effort and the result of the offeror’s performance." Then in the answer to Question 22, it says "Page limit for Past Performance Narrative is 2 pages." We read this to mean that each Past Performance Reference (up to three per prime and per sub) may have its own narrative which may be up to two pages long in addition to the pages of each Attachment L1. Do you agree that each reference may have its own narrative up to two pages each in addition to the pages of the multiple Attachments 1s? If this is not correct, then is the narrative supposed to describe in two pages all the past performance references for multiple Attachment 1s for the prime and all subs?

Answer: Each reference may have its own narrative up to two pages each in addition to the pages of the multiple Attachments L1.

Question 7. The RFP says the offerer must identify all contractors and specify their Socio-Economic Status, and RFP page 38 Section L, paragraph 2.3.6 says "DTRA will use the Central Contractor Registration (CCR) website data to verify proposed small business entities meet the assigned RFP NAICS (541380-Testing Laboratories), small business size standard ($12.0 million)." Also, the Q&As published with Amendment 2 state in the answer to Question 19 that NAICS 541380 is required for the prime and all subcontractors. We always use local small businesses for our subcontracting plan as much as possible to benefit the local small businesses, and we notice there are no businesses listed in CCR in Albuquerque, NM, that are Service Disabled Veteran-Owned Small Businesses (SDVOSBs) with NAICS 541380. CCR only lists three in New Mexico. However, we have worked with many other SDVOSBs in Albuquerque and NM which are qualified under other NAICS. The SOW requirements for Source Handlers or Vehicle Operator could easily be met by SDVOSBs under other NAICS codes, thus satisfying the ultimate objective of providing subcontracting work to SDVOSBs, especially local SDVOSBs. The FAR does not require that the NAICS must be flowed down to all subs, and requiring that all SDVOSBs must be qualified in NAICS 541380 will mean that SDVOSB contractors will have to be brought in from outside Albuquerque, probably resulting in an increased travel cost to the government. Will you please allow the SDVOSB portion of the subcontractors to be qualified under other NAICS codes?

Answer: Offerors may propose subcontractors with any NAICS code as long as they do not exceed the small business size standard for NAICS code 541380 of $12,000,000.
