Multiple Award Construction Contract (MACC)

Question #1: “Does our bonafide Louisville, KY office meet their requirements for location for the 8A program?”
Government Response: No. Block 10 of the SF 1442 states: This acquisition is a set aside 8(a) competition limited to 8(a) firms located within the geographical area of the state of Ohio and other 8(a) firms with bona fide place of business within the geographical competitive area, and assigned NAICS code. All other 8(a) business development participants are deemed ineligible to submit offers.
“Bona fide place of business”, for purposes of 8(a) construction procurements, means a location where a participant regularly maintains an office that employs at least one full-time individual within the appropriate geographical boundary. The term does not include construction trailers or other temporary construction sites. See 13 CFR 124.3.
A participant’s principal place of business is always a bona fide place of business for purposes of 8(a) construction requirements. A participant may have bona fide place of business in more than one location.
This bona fide office must be requested through the participant’s home SBA office and approved by the local SBA District office where the bona fide office is located. A review of required documentation and the participant’s location must be performed and a letter of approval issued.
Firms who are eligible for this requirement must be an active member of either the Columbus or Cleveland district or have an approved bona fide office in either district.
