1. TITLE: AIR FORCE CONSTRUCTION IDIQ
2. PROJECT DESCRIPTION:
2.1 The beneficiaries of this contract are the 435th Civil Engineer Group (435th CEG), located on Ramstein Air Base and the 52 Civil Engineer Squadron, located on Spangdahlem Air Base. The responsible agencies for performance are the SABER Office (435th CES/CEPM) and the SABER Office (52 CES/CEPM).
2.2 All work shall be in conformance with the drawings and specifications provided by the 435th Civil Engineer Squadron or 52 Civil Engineer Squadron to include the furnishing of all materials, labor, plant, tools, equipment, transportation, and services (including engineering/ technical design support) and incidentals thereto.
2.3. The contract is for a broad range of sustainment, maintenance, repair, alteration, and minor construction projects to include residential, and commercial work for the Kaiserslautern Military Community (KMC) and Spangdahlem Air Base areas. The primary bases/geographically separated units (GSU) are Ramstein Air Base, Spangdahlem Air Base, Sembach Air Base, Einsiedlerhof Air Station, Kapaun Air Station, Landstuhl and Vogelweh Military Family Housing, Bitburg Annex, Oberkail and Buechel. The maximum radius for this contract will be the borders of Germany. The work is required in support of the 435th Civil Engineer Group and 52 Civil Engineer Squadron. The contract is a multiple-award, indefinite delivery-indefinite quantity (IDIQ) contract and shall encompass a wide variety of individual construction tasks as listed in the Unit Price Book (UPB).
2.4. Performance of services will be accomplished by the Contractor through individual task orders. The project scope on each task order will be identified by the Government. Task orders will be awarded in accordance with (IAW) section H of this contract.
2.5. All work, specifications, Statements of Work (SOW), drawings, and other contract requirements shall be performed in strict accordance with the most current edition of the "Verdingungsordnung fuer Bauleistungen, Part C (VOB Part C).
2.6. The contract will encompass a 5-year ordering period.
2.7. The work shall include tasks in a variety of 30 different trades (see UPB) such as carpentry, pavement repair, roofing, excavation, interior/exterior electrical, steam fitting, plumbing, sheet metal, painting, asbestos abatement/removal, lead abatement/removal/encapsulation, demolition, concrete, masonry, welding, etc.
2.8. Examples of maintenance, repair and construction work, which may be required under this contract may include, but are not necessary limited to:
· Construct/repair/renovate restrooms, work, and office areas.
· Paint interior and exterior areas.
· Install/replace/repair electric, water and gas systems.
· Install/replace/repair storm and sewer lines, valves and distribution systems.
· Install/replace/repair built-up and shingle roofs.
· Install/replace/repair steam and HVAC parts, units and duct work.
· Install/replace/repair chain link and masonry fencing.
· Install/replace/repair curbs, gutters, sidewalks, and pavements.
· Abate asbestos containing material (ACM) or lead base paint material.
· Complete building renovations and/or additions.
· Construct new buildings not to exceed a Minor Construction (MC) limit or $750,000.00.
3. QUALITY CONTROL:
3.1. The successful offeror for this project will be required to institute a comprehensive Quality Management Program (QMP) in order to assure himself and the Government that all materials and workmanship are in strict accordance with the provisions of the specifications. The Contractor shall provide a resolution of any problems to the Contracting Officer (CO) in writing immediately but not later than 5 workdays after receipt of notification by the CO. The Contractor shall use Trend Analysis to identify poor performing subcontractors and the program manager shall review such analysis on a weekly basis. The Contractor shall inspect and document projects on a daily basis.
3.2. The Contractor shall submit a QMP within 30 calendar days after award that shall be approved by the Government. This QCP shall include all phases of the construction process to ensure all components of construction meet industry standards.
3.3. The QMP specifically and exclusively relates to the acceptable completion of work and subsequent Government inspections and approval. It is the Contractor's responsibility to ensure, inspect, and document that the level of quality established by the minimum standards of the Statement of Work are met.
3.4. Quality Control Manager: The Quality Control Manager (QCM) shall direct the execution of the Contractor's approved QCP and is responsible for administration of the plan and inspection of work. The QCM shall be available during normal duty hours and within one hour after notification to meet with the CO or a representative from the using agency.
3.5. Government Inspection: When the Contractor considers that the work is acceptable to the Government and is complete, he shall inform the CO at least five workdays in advance of the final inspection that the work is complete and ready for inspection. The CO (or authorized representative) will inspect the work on site. In the event that the work is not acceptable, the Contractor shall record a list of items noted by the Government to be corrected. A subsequent inspection may take place in order to review the corrected items.
3.6. Government Approval of Work: The Government will notify the Contractor that work for a specific task order is or is not acceptable. Invoices for a specific job order shall not be permitted until the Government has accepted the work. The Contractor shall clean up prior to Government acceptance.
4. SECURITY REQUIREMENTS:
4.1. The Contractor shall comply with security regulations imposed by the Base Commander and/or the agency occupying the space where the work is to be performed, including adhering to or obtaining any security clearances.
4.2 CONTRACTOR ACCESS TO US INSTALLATIONS
4.2.1 The Contractor shall obtain temporary installation passes for all Contractor/ subcontractor personnel who visit or perform work on the KMC Installations or Spangdahlem Air Base and geographically separated units cited in the contract. At least 30 calendar days before start working, the Contractor shall provide the following documentation to the 435 CES/CEPM or 52 CES/CEPM Manager:
1. A signed Personnel Data Sheet, containing personnel data and data of vehicle used.
2. Access roster containing personnel data of all employees working at site.
3. A legible copy of employees’ Personnel Identification Card or Passport.
4. A Police of Good Conduct (not older than three months). Should the Police of Good Conduct contain entries, the US side will decide in each case if access is granted.
5. Copy of Residence and Work Permit. (For non-EU-citizens)
6. A completed and signed Security Check Questionnaire. (AE Form 604-1B)
7. A signed Rules of the Road Sheet.
4.2.2 The US side reserves the right in case of heightened security to limit or deny access.
4.2.3 The US side may deny access to KMC Installations or Spangdahlem Air Base and associated geographically separated units for individuals who have not completed and signed the AE Form 604-1B, whose results have returned unfavorable/adverse, or for individuals whose results have not returned.
4.2.4 During the contract period, additional access conditions might arise, like for example taking of finger prints.
4.2.5 The Contractor is responsible for returning installation passes in case their employees don’t need to access KMC Installations or Spangdahlem Air Base and associated geographically separated units anymore (terminated employment, expired expiration date of installation passes etc). In case that a contractor employee will change to another contractor and an installation pass will also be needed for this contractor, a new installation pass has to be requested. The same applies for subcontractors and the subcontractor’s employees.
4.2.6 Contractor personnel are required to wear or prominently display Contractor furnished badges while visiting or performing work on the installation.
Temporary Installation Passes (TIP): Because of security issues, there is currently a interim policy in effect for temporary passes on Air Force installations.
Future security policies are expected to eliminate TIPs completely. It is the Contractor’s responsibility to take this impending policy change into account when submitting their proposal, including, but not limited to, proposed price and performance times.
Here are the known phase-in periods:
· Phase one (effective 16 Jan 2009) - May be issued up to 60 days on a non-renewable basis.
· Phase two (effective 01 Jun 2009) - May be issued up to 30 days on a non-renewable basis.
· Phase three (effective date unknown) – TIPs eliminated completely
4.3. MATERIAL DELIVERIES
Trucks are controlled separately when entering US installations. Waiting periods of up to two hours shall be included into the prices for this.
4.4. WORK PERFORMED IN SECURED AREAS
Projects in secured areas may require a local agency check of Contractor personnel and all sub-contractors prior to commencement of work. If a check is required, the Contractor should allocate time in the work schedule to accomplish this check. The Contractor shall price work performed in secured areas according to standard work hour rates unless prior approval to use non-standard work hour rates is obtained from the CO.
4.5. ESCORT IN RESTRICTED AREAS
Contractor personnel must be escorted at all times in a controlled/restricted area by a Government escort. Escorts for secured areas will be scheduled by the Contractor at least 10 workdays prior to start of work. The Contractor needs to provide a list including the personnel who will be working in this area. The Government will provide an escort as quickly as possible, but the Contractor should expect delays due to the sensitive nature of secured areas.
4.6. UNAUTHORIZED RECONNAISSANCE
The Contractor shall inform all personnel working under his/her jurisdiction (including subcontractor and visiting supplier personnel) that access to areas outside the immediate work area (excluding cafeterias and rest rooms near the work site, direct haul and access routes, contracting and 435 CES/CEPM or 52 CES/CEPM, and points of supply and storage) is strictly prohibited. Circulation of the above personnel shall be limited to official business only. Personnel engaged in unauthorized reconnaissance of other Contractor or Government activity will be referred to the CO for disposition. Infractions involving possible compromise of national security will be turned over to the Office of Special Investigations (OSI) or Criminal Investigation Department (CID) for disposition. The determination of which agency will be made based on the location of the work being performed. The OSI is the lead agency for USAF installation and the CID has jurisdiction on US Army installations.
4.7. INFORMATION SECURITY
All paperwork, printed e-mails, drawings and plans should be shredded in the appropriate level medium, IAW AFI 10-701.
4.8. TAKING PICTURES
Prior to taking pictures on the military installation, the contractor shall check with the CO, 435 CES SABER Office or the 52 CES SABER office if and to what extent this is permitted.
The following may apply to different areas:
· A general prohibition to take pictures.
· Permission to take pictures after obtaining a permit/with restrictions.
· Permission to take pictures without having to obtain a permit/without restrictions.
4.9. CLOSURE OF OPENINGS
The Contractor shall close every exterior wall and roof opening resulting from work in order to prevent outside intrusion at the end of each workday. Closure(s) shall remain in place when Contractor is not actively engaged in working on the site(s), including each and every day, night, weekends, and holidays, to reduce wind and weather intrusion. Closure(s) shall be constructed of 1/2" minimum thickness plywood anchored in place to stud framing if necessary, or similar construction as approved by the 435 CES/CEPM or 52 CES/CEPM through the CO.
4.10. WORK AT SECURITY FENCES
Work at security fences shall be coordinated with the 435 CES/CEPM or 52 CES/CEPM prior to start of work. If necessary, a Government escort will be required, who will oversee the area while the fence is open. Fences shall be restored at the end of each work day or shall be secured by suitable measures. Under no circumstances shall work at security fences be started without prior coordination.
5. ENVIRONMENTAL CONCERNS, SAFETY AND OTHER APPLICABLE STANDARDS:
Both, US and German regulations apply in conjunction with this contract. In case United States and German regulations differ, the more stringent regulation shall apply. The following paragraphs list the most important regulations, but make no claim to be complete.
5.1. Safety: Contractor must work in compliance with the most current German Federal Safety Laws and Regulations, especially the Unfall-Verhuetungsvorschriften (UVV), the Berufsgenossenschaftliche Vorschriften (BG-Vorschriften) and the Baustellenverordnung (Baustell V).
5.2. Energy Conservation: The Contractor shall comply with the mandatory standards and policies relating to energy efficiency contained in the most current edition of the Waermeschutzverordnung / Energieeinsparverordnung.
5.3. Environmental Laws and Regulations: The Contractor shall comply with the following: Gewaesserschutzbestimmung, Wasserhaushaltsgesetz (WHG), Gesetz ueber Abgabe von Abwasser in Gewaesser (AbwAG), LAGA-Richtlinien, Bundes-Immissionsschutzgestz (BimSchG), Bundesbodenschutzgesetz (BBodSchG), Landeswassergesetz (LWG)
5.4. The use of materials which have been identified by Governmental agencies as being hazardous or creating potentially hazardous conditions will not be allowed on any project. Specifically, products containing lead, asbestos, polychlorinated biphenyl (PCB), and ozone-depleting chemicals are prohibited. The Contractor shall assume a strict and cautious position when dealing with questionable materials.
5.5. POLYCHLORINATED BIPHENYLS (PCBs)
5.5.1. New electrical equipment shall not contain PCBs, shall be certified to this effect, and shall be stamped or labeled “NO PCB”.
5.5.2. If any material originally specified or approved for use in the work should become listed as suspected or verified, the Contractor shall immediately notify the CO and initiate efforts to postpone the installation until the matter can be investigated.
5.5.3. Additionally, all requirements of laws and ordinances concerning “right to know” of the general public, as well as work personnel who perform work on the project, shall be adhered to by all parties and shall be so specified.
5.6. ASBESTOS REMOVAL
The Contractor or subcontractor performing asbestos removal must be in strict compliance with TRGS-519. A work plan shall be submitted to the Environmental Management Flight, 435 CES/CEV or the Environmental Management section 52 CES/CEA not later than ten workdays before start of work for their review and coordination.
5.7. FIRE PROTECTION REQUIREMENTS
5.7.1. All US and German fire and safety regulations are to be followed stringently. In case United States and German regulations differ, the more stringent regulation shall apply.
5.7.2. Inspection: Construction sites will be inspected periodically by the Fire and Emergency
Services Office for compliance with all fire codes and standards listed or referenced in the contract documents.
5.7.3. Codes and Standards: If the listed or referenced fire code or standard requires any equipment or material items not specified or shown in the contract documents, the Contractor shall not be relieved of the responsibility of providing the items and requesting installation instructions from the Fire Prevention Office through the CO.
5.7.4. Fire Extinguishers: Extinguishers of a type and quantity acceptable to the Chief, Fire and Emergency Services office, shall be provided by the Contractor and maintained in the construction area, Contractor’s temporary buildings, and at the storage piles of flammable materials. These extinguishers shall be of the type conforming to the most recent editions of the National Fire Protection Association (NFPA) standards and shall remain the property and responsibility of the Contractor.
5.7.5 Flame Cutting, Welding, and Soldering: (see Para 9.1) The Contractor shall observe all precautions in use of flame cutting, welding, and soldering equipment as no flame-cutting, welding, or soldering of any description shall be permitted until the work site has been inspected and the operation approved by the 435 CES or 52 CES Fire Prevention Inspector. A copy of the 435 CEG/52 CES installation policy will be provided with instructions on the permit required. The Contractor will place flame cutting, welding, and/or soldering caution signs on site and shall ensure these signs are obvious to Government and Contract personnel while work is in progress.
5.7.6 Fire Rating: Where specifications or work descriptions require the Contractor to submit proof that the material to be furnished conforms to DIN 4102, a written certificate from any testing agency satisfactory to the CO in coordination with the Chief, Fire and Emergency Services Office, materials shall be furnished with labels attached (when fire labeling is specified). No exceptions are allowed.
5.8. NOISE CONTROL
Comply with all applicable US and German laws and regulations relative to noise control.
5.9. DEMOLITION
Removed or demolished material will become property of the Contractor and must be disposed in accordance with the local laws and regulations, unless specified otherwise in the respective SOW.
5.10. EXPLOSIVE OPERATED HAND TOOLS
The Contractor shall comply with Unfallverhuetungsvorschriften (UVV) when utilizing explosive operated hand-tools. Storage of explosive cartridges on the installation will be in metal containers and limited to one days supply. The Contractor will provide adequate controls to prevent loss/theft of cartridges used and stored on the installation.
5.11. COMMUNICATIONS INSTALLATION IN NEW AND RENOVATED FACILITIES
Communications conduit, pre-wiring, and equipment shall be installed in accordance with Verband Deutscher Elektrotechniker (VDE) standards, the ICDS-CDS-and FO-regulations, the EIA/TIA-568, the Technical System Bulletins TSB 36 and TSB 40, DIN EN 50173 and ISO/EIC/DIS 11801.
5.12. TREE CUTTING
If tree cutting is required, or if any construction is closer than 3m to a tree, all actions will only be performed after obtaining permission from the Forestry Department through the 435 CES/CEV or 52 CES/CEA prior to construction, renovation, installation, demolition, trenching etc. The permission shall be submitted as early as possible. However, all debris clean-up, such as branches, stumps, etc. must be disposed of by the contractor as part of the project.
5.13. HISTORIC LANDMARKS
In the event there are historical and/or archeological resources in a project, the Contractor shall comply with Denkmalschutz- und Denkmalpflegesetz Rheinland-Pfalz regulations.
5.14. OTHER APPLICABLE REGULATIONS
5.14.1. Antiterrorism/Force Protection (AT/FP)
All construction work shall be performed in compliance with the Antiterrorism/Force Protection Regulations. In order to ensure this, design documents shall be presented to the 435 ABW or 52 FW ATFP representatives for review. The regulations presently applicable are, among others, UFC 4-010-01 DoD Minimum Antiterrorism Standards for Buildings, UFC 4-021-01 Mass Notification Systems.
5.14.2 Architectural Compatibility
All respective construction measures shall be performed in compliance with the applicable publications in regard to their design and/or shall be coordinated with the 435 CES/52 CES architectural representative. The regulation presently applicable is the Architectural Compatibility Guide (ACS Edition 2008) for Ramstein Air Base and the Architectural Compatibility Guide (ACG) for Spangdahlem Air Base.
5.14.3 Green Procurement
In order to comply with the affirmative procurement requirements of Section 6007 of the Resource Conservation and Recovery Act (RCRA) and Executive Orders 13101 and 13148 (Green Procurement Program (GPP)), the Contractor shall use recycled and recovered materials and products identified in the USEPA's Comprehensive Procurement Guidelines (CPG).
5.14.3.1 The latest CPG product list, and the specific recycled content requirements for each product, can be found on the USEPA’s website (www.epa.gov/cpg).
5.14.3.2 The Contractor shall provide EPA designated products containing recovered material unless the item cannot be acquired:
a.
Competitively within a reasonable time frame.
b.
Meeting the appropriate performance standards.
c.
At a reasonable price.
5.14.3.3 Items identified in the USEPA's CPG shall be viewed as the minimum that can be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the government, shall also be considered.
5.14.3.4 Material and product submittals for all recycled content items shall list the recycled and recovered materials used and the percentage content listed.
6. CONSTRUCTION SITE MAINTENANCE:
All construction sites shall meet the actual requirements of OSHA CFR 1910, CFR 1926, and Base Appearance Specifications. These guidelines will be provided by the government upon request.
6.1. The Contractor shall maintain each site in a neat and orderly manner. All supplies and equipment on the project site shall be stored to preclude mechanical and climatic damage. All grass, weeds, etc. shall be cut as necessary to prevent any fire/safety hazards and shall be no higher than five cm at any one time or as directed by the CO. All trash, debris, paper etc. shall be picked up immediately and placed in proper containers.
6.2. CONTRACTOR PARKING
The Contractor shall inform his employees, suppliers, and subcontractors that their vehicles shall not be parked on grass, in Fire Lanes or other restricted areas, parking spaces marked as “Handicapped” or “Government”, at any time. In addition, vehicles may not be driven over grass surfaces, unless indicated during a site visit or pre-construction conference. Any damage done to lawns, shrubs, sidewalks etc. shall be repaired or replaced by the Contractor at no additional cost to the Government.
6.3. CLEAN-UP OF INSTALLATION ACCESS ROUTES OUTSIDE OF THE CONSTRUCTION LIMITS AND STAGING AREAS
All mud, dirt, debris, foreign objects, or spills of any kind from the Contractor's operations (including subcontractors and suppliers) on (a) streets and parking lots, used as access to the work or staging areas, shall be cleaned up not less than daily, or as requested by the CO, and (b)parking aprons and hard surfaces used as access to the work or staging areas, shall be kept clean at all times.
6.4. CONTRACTOR GENERATED REFUSE
6.4.1. All Contractor generated refuse and waste shall be hauled from the construction site daily, or placed in a dumpster, or as otherwise approved by the CO, to a disposal area to be selected by the Contractor and shall be located outside the physical boundaries of the installation. All dumpsters shall be emptied before the debris gets higher than the top of the dumpster. This refuse and waste material shall be hauled in trucks with tight fitting covers to prevent spillage on roadways. The Construction site shall be kept neat, orderly, and safe for workmen at all times. The Contractor shall take positive action to prevent work-generated refuse from entering the sanitary and storm sewer systems. The CO may instruct the Contractor to remove the dumpster, or replace the existing dumpster with an empty one. The Contractor shall comply within four hours.
6.4.2. Management of Liquid Wastes: The Contractor shall not dispose of any excess waste or residual material on the ground or any storm sewer or drainage system. This includes, but is not limited to paints, coatings, solvents, petroleum products, etc. Discharge of any material or diluted material into sanitary or industrial sewer systems shall be coordinated with the 435 CES/52 CES Environmental Flight Coordinator through the CO, and shall be approved by the 435 CES/52 CES Environmental Flight Coordinator. Waste material for disposal shall be disposed in accordance with US and German waste regulations and with local Installation policies. If in doubt, consult with the 435 CES/52 CES Environmental Flight Coordinator through the CO.
6.4.3. Hazardous Chemical and Liquid Petroleum Products Spill Prevention: The Contractor shall handle and store hazardous liquid materials in approved areas, and shall comply with the spill prevention and response requirements of regulations and laws mentioned under section 7 “Environmental Laws and Regulations.”
6.4.4. Organic Solvents: The Contractor shall limit emissions of organic solvents into the atmosphere. This rule applies to use, clean up, and disposal of organic, photo chemically reactive and non-photo chemically-reactive solvents and materials containing those solvents.
6.4.5. Architectural Coatings: The Contractor shall limit the quantity of volatile organic compounds in architectural coatings. This applies to any coatings applied to stationary structures and their appurtenances.
6.4.6. Lead Containing Materials: The Contractor shall not use paints or coatings containing lead in excess of 0.06 percent by weight of total nonvolatile content in accordance with Title 16 of the Code of Federal Regulations Part 1303. Paints or coatings within reach of children in recreation, and public areas, shall have a zero lead content.
6.5. TRUCKING
Loose debris on trucks leaving the site shall be loaded in a manner that will prevent dropping of materials on streets and conform to local ordinances and laws. Fasten suitable cover, such as a tarpaulin, over the load before entering surrounding streets. The Contractor shall be responsible for immediately cleaning up any materials that fall from trucks.
6.6. FENCING OF CONSTRUCTION SITE
Fences will be used to isolate construction sites as per instructions by the CO, per recommendations of the 435 ABW/52 FW Safety Office, IAW OSHA CFR 1910, CFR 1926, and Base Appearance Specifications.
6.7. BARRICADES
6.7.1. The Contractor shall barricade access to all construction sites (interior and exterior). Barricading shall be used to isolate areas from access. The barricades shall be maintained in good condition, and be installed such that people approaching from the predominant direction can clearly read the warning. Barricades on streets shall have battery-powered flashers for night use. Construction fencing shall be used to isolate exterior areas from pedestrian access, and shall be maintained in good condition. Cones shall only be used to temporarily block pedestrian traffic. Extended pedestrian blockages or road traffic shall use rigid barrels/barricades. All barricades, barrels, cones, etc., are included in the Contractor’s supplied equipment/supplies and therefore shall not be a direct cost to any task order unless the CO deems the individual task order requirements so extensive as to warrant payment.
6.7.2. All projects involving excavation shall be secured with flashing lights on all sides and have construction fencing completely surrounding the site at a minimum of five feet from the hole.
6.8. OCCUPANCY
6.8.1. The buildings in this contract include multiple-use type facilities. They may or may not be occupied when work is going on in them. It shall be the Contractor's responsibility to take whatever measures are necessary to assure the protection of occupant's assets, furnishings, equipment, etc, and to perform the work so as to cause minimal disruption of ongoing activities in occupied areas.
6.8.2. Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel.
6.8.3. The Contractor shall provide non-combustible or self-extinguishing material drop cloths to isolate areas exposed to debris or noise, or to cover material storage during construction in building interiors.
6.8.4. Any temporary construction for facilities used by the Contractor in order to prevent interruption of normal work activity or loss of utility services shall be subject to approval of the 435 CES/CEPM or 52 CES/CEPM Project Manager through the CO.
6.9. IDENTIFICATION, DAILY SIGN-IN, AND LEAVING THE WORK AREA
When not actively working in the task order work area, the Contractor shall post signage clearly labeled “WORK IN PROGRESS.” The sign shall include point of contact names (Contractor, 435 CES/CEPM POC or 52 CES/CEPM representative, and Contracting POC) and phone numbers. The Contractor shall provide construction tape, safety cones and other materials or equipment to provide a safe and clean environment.
7. DRAWING REQUIREMENTS:
7.1. EXISTING CONDITION DRAWINGS AND AS-BUILT DRAWINGS (INCLUDING UTILITIES)
7.1.1. Existing condition drawings showing existing underground utilities are available upon request. The Contractor shall be responsible for availing him/her self of the drawings. Any utility line shown on the record drawings (or made known to the Contractor) and damaged during construction work shall be repaired immediately by the Contractor at no additional cost to the Government.
7.1.2. The Government does not guarantee the accuracy or adequacy of existing record drawings. It shall be the Contractor's responsibility to verify all existing conditions prior to starting work on each task order.
7.1.3. During the progress of the job, the Contractor shall keep a careful record at the job site of all work accomplished from the layouts shown on the drawings. Annotated working drawings shall be available on-site for inspection by the CO at any time. The Contractor shall provide documents (drawings or sketches) to describe all of the work accomplished, and enter changes and corrections on contract or record drawings promptly.
7.2. AS-BUILT DRAWINGS
7.2.1. The Contractor shall include as-builts as a work element on the AF Form 3064, Contract Progress Schedule, when requested. The total effort (labor, admin, etc.) for as-builts shall not exceed 3% of the total task order value. Not more than 97% of the total task order value will be paid until as-builts are submitted and approved by the Government.
7.2.2.
The following requirements apply for as-built drawings:
· The as-built drawings shall be turned over to the CO within 21 calendar days of final inspection.
· The as-built drawings shall indicate, in addition to all changes and corrections, the actual as-built condition. In order that the location of sub-surface utility lines and appurtenances may be determined in the event the surface openings or indicators become covered over or obscured, utility record drawings shall show by offset dimensions to two permanently fixed surfaced features, the end of each run including each change in direction. Valve, splice boxes, connections, changes in dimensions and similar appurtenances shall be located by dimensioning along the utility run from a reference point. The average depth below the surface of each run shall also be recorded.
· All as-built drawings must be submitted in electronic format using AutoCAD 2005 or above (*.dwg). Files in DXF format (.dxf) will be accepted too. This format is to be used for all engineering drawings. All layers and naming of must be in compliance with A/E/C standards from the CADD/GIS Technology Center.
· All as-builts must be in above mentioned format and delivered on CD-ROM with appropriate labeling showing the project number, project title, facility numbers and installation name. In addition, 3 sets of drawings (print out) shall be delivered.
· All Civil type work that deal with any utility or pavements or groundwork must be submitted in Geographic Information Systems (GIS). This dataset must be usable with ESRI Arcview 9.2 software.
· The GIS data set shall be delivered in a File Geodatabase (FGDB) or a Personnel Geodatabase (PGDB).
· All GIS data and drawings must be in compliance with the Spatial Data Standards for Facilities, Infrastructure and Environment (SDSFIE). These standards can be given to the Contractor upon request to the GeoBase office located in Bldg 507 on Ramstein AB, or the GeoBase office located in Bldg 119 on Spangdahlem AB.
· All GIS data and drawings must be submitted in UTM Zone 32N meters; World Geodetic System 1984 (WGS1984); Geoid Model EDM 96.
· All GIS data and drawings will be delivered on CD-ROM with appropriate labeling showing facility numbers and installation name
· All electronic as-builts either AutoCAD or GIS files and data must be named in the English language.
· Drawings shall include a schematic of the system with the design conditions listed at major points (temperature, flow rate, etc…).
8. UNIT PRICE BOOK COMPUTER PROGRAM

9. PERMITS:
9.1. WELDING PERMIT
No welding shall be started without first obtaining a permit issued by the 435 CES/CEFP or 52 CES/CEF. Delay in obtaining a welding permit shall not be reasonable for time extension to the task order performance period.
9.2. WORK CLEARANCE REQUEST (DIGGING PERMIT)
The Contractor shall obtain an approved Work Clearance Request (AF Form 103 / Digging Permit) prior to any excavation. The 435 CES/CEPM or 52 CES/CEPM shall assist the Contractor in obtaining the excavation permits and site drawings will be provided together with the AF Form 103. Should damage occur to any of the items indicated in the AF Form 103, the Contractor shall be responsible for prompt repair of the damage to return the item to its original workable condition at no additional cost to the Government.
9.3. TEMPORARY AIRFIELD CONSTRUCTION WAIVERS
All construction measures on Ramstein Air Base or Spangdahlem Air Base shall be analyzed prior to start of work in regard to a possible interference with air traffic. All planned structural modifications outside of buildings, as well as the job site plant (particularly construction cranes, mobile cranes, derricks) shall be presented as early as possible. Coordination will be done via the 435 CES/CEPM or 52 CES/CEPM.
10. PROGRESS REPORTS:
The reports mentioned in FAR clause 52.236-15, "Schedules for Construction Contracts" shall be accomplished on AF Form 3064, Contracts Progress Schedule, and AF Form 3065, Contract Progress Report. Progress Schedules will be required for all projects regardless of cost or performance time. NOTE: All forms submitted shall be typewritten and the contract administrator must be identified on the form.
11. MATERIAL SUBMITTAL AND APPROVAL FORM:
In accordance with FAR clause 52.236-5, “Materials and Workmanship,” all material requiring approval shall be submitted by the Contractor to the CO for approval on an AF Form 3000 within 10 calendar days after award of task order (or as other-wise established by the CO).
12. UNIQUE PROJECT REQUIREMENTS:
12.1. ROOFING PROJECTS
The Contractor may not leave equipment or materials on any roof or tower unless prior approval has been obtained from the CO.
12.2. PAVING, FENCING, AND EXCAVATION PROJECTS
12.2.1. Prior to start of any paving, fencing, exterior painting and excavation under this contract, the Contractor shall coordinate start and completion dates in writing with the CO (or authorized representative), ten workdays prior to the scheduled start date. If traffic patterns change due to work under this contract, a plan showing all barricades, temporary traffic lights, detour signs etc. shall be submitted at least ten workdays prior to the scheduled start date.
12.3. SPECIAL REQUIREMENTS FOR EXCAVATING AROUND OR LOCATING EXISTING UTILITIES
Excavations for street and utility outages will also include the following requirements unless waived by the CO. Prior to the start of work, all valve locations will be identified/located so the utility can be shut off in the event of accidental damage. To preclude accidental damage, the Contractor shall locate the exact location of all known utilities by hand digging within 1m in each direction of the marked utility prior to any excavation with power equipment. Any utilities discovered during excavations that are not shown on the drawings will be marked on the contract drawings and will be identified on the Contractor's as-built drawings.
13. AVAILABILITY/UNAVAILABILITY OF UTILITIES SERVICES:
13.1. All reasonable required amounts of water, electricity, etc., essential to contract performance, will be made available at no cost to the Contractor from existing systems, outlets and supplies. All temporary connections, outlets and distribution lines, as may be required, shall be installed by the Contractor at his own expense.
13.2. Water Supply: The Contractor shall coordinate the procedure to get water supplied with 435 CES/CEPM or 52 CES/CEPM. Furnishing water supply from a fire hydrant requires the approval from the 435 CES/CEFP (Fire Prevention Office) or 52 CES/CEF. Exceptions will be made in the case of a significant drop in water pressure on the system degrading the protection of facilities and/or lives. It might be necessary to install mobile water meters when connecting to un-metered connection points (the Contractor does not need to pay for the water). The mobile water meters will be provided by the 735 CES/CEOMW (Ramstein Air Base Water Plant) or coordinated with the Spangdahlem Air Base Water Plant (52 CES/CEOI).
13.3. When connecting to fire hydrants, the Contractor shall install a contractor-supplied gate valve with backflow preventer. Government personnel will open the hydrant valve, leaving it open for the Contractor’s operation through his gate valve. Only Government personnel shall operate the fire hydrant valve. If the Contractor attempts to operate the hydrant valve, the contractor shall be held liable for all damages to the hydrant casing, valve stem, and/or lug.
13.4. UNAVAILABLE TOILET FACILITIES
The Contractor shall provide his own chemical sanitary toilets at work sites. Chemical toilets must be serviced regularly and may be inspected by the Government. Sanitary deficiencies shall be corrected within 24 hours after a deficiency is made known to the Contractor.
14. COORDINATION OF PROJECT START / COMPLETION:
14.1. Written notice on construction start shall be given at least six workdays prior to start of work (letter or e-mail is acceptable). In some cases, the notification must be given two weeks prior to start of work (i.e. on projects within MFH area).
14.2. A pre-construction meeting might be requested prior to start of work for some projects. If this is required, the Contractor will be informed by the CO and/or the Chief of the 435 CES/CEPM or 52 CES/CEPM. The topic of this meeting might be the job site plan, the time schedule, parking, access to the construction site, etc.
14.3. The Contractor shall request the final acceptance of a project not later than five workdays prior to the CO and the 435 CES/CEPM Chief or 52 CES/CEPM SABER project managers. The CO (or authorized representative), the 435 CES/CEPM Project Manager or 52 CES/CEPM project manager and (if applicable) other sources (the user, Maintenance Engineering etc.) will inspect the work on site. In the event that the work is not acceptable, the Contractor shall record a list of items noted by the Government to be corrected. A subsequent inspection may take place in order to review the corrected items.
14.4. For critical structural components, which are completed and which will not be accessible after further work progress, the 435 CES/CEPM or 52 CES/CEPM reserves the right to inspect / accept these structural components. The Contractor shall inform the 435 CES/CEPM or 52 CES/CEPM at least two workdays before subject structural components are no longer accessible. The Contractor shall clarify with the respective 435 CES/CEPM or 52 CES/CEPM Project Inspector if and for which structural components of a project this will apply. For example: Sealing of structural components which are in contact with the ground prior to backfilling, wiring prior to installation of a suspended ceiling, etc
14.5. The CO and/or 435 CES/CEPM or 52 CES/CEPM may request a pre-final acceptance before the final acceptance will be accomplished.
14.6. The Contractor shall provide any technical documentation (i.e. fire alarm testing documentation, lightning protection testing documentation, manuals etc.) at the pre-final but not later than the day of final acceptance. If requested, the Contractor shall provide user training (e.g. for technical system). This training can take place during final acceptance or at another date, as desired by the 435 CES/CEPM or 52 CES/CEPM.
14.7. Project Phasing: Some projects require performance in phases. For these phases, paragraphs 14.1 thru 14.6 shall apply accordingly. Separate acceptance inspections will be held for these phases. It shall be possible to determine the performance time for each phase separately and this shall be binding for the Contractor.
14.8. Upon completion and acceptance of each task order, the Contractor shall, as required, submit any data necessary to complete a DD Form 1354 Checklist and DD Form 1354 (“TRANSFER AND ACCEPTANCE OF MILITARY REAL PROPERTY”) to the CO.
15. COORDINATION WITH GOVERNMENT ACTIVITIES:
15.1. If it becomes necessary to interrupt work activities in buildings and/or areas for construction purposes, permission to do so must be requested in writing to the CO not later than 10 workdays in advance.
15.2. The Contractor shall request street closings, both partial and/or total, 10 workdays prior to the closing.
15.3. Work in conjunction with this contract which requires utility outages which will affect (as determined by the CO) normal activities in the building, construction area, or other work areas, shall be performed by the Contractor at a time other than regular work periods of the organization occupying the facility or area.
15.4. Temporary construction for facilities used by the Contractor for preventing interruption of normal work activity or loss of utilities shall be subject to approval of 435 CES/CEPM or 52 CES/CEPM through the CO.
15.5. UTILITY OUTAGES
15.5.1. Notice on Construction Start shall be given six workdays in advance prior to start of work (letter or e-mail).
15.5.2. The Contractor shall coordinate all utility outages with the using agency through the CO (or authorized representative) prior to the outage. Services shall not be interrupted until receipt of approval of proposed hours and dates from the 435 CES/CEPM or 52 CES/CEPM through the CO. All work shall be arranged to ensure that the outage will be of minimum duration. The Contractor will provide notice to the CO, in writing, not less than 10 workdays prior to the required outage or as determined by the CO. No response to the outage/interruption request shall be considered as disapproval for the outage/interruption. In the event a scheduled utility outage is canceled by the Government, notification shall be given to the Contractor at least 24 hours in advance of the time for the outage to start and the Contractor waives his right to any claim for equitable adjustment or increased cost of performance under this contract as a result of this cancellation. Once a utility outage is arranged and work has begun, work must go on continuously until the affected utilities are restored to the affected facility.
Interruption of Energy Monitoring and Control System (EMCS), fire detection/protection systems, and evacuation alarms are considered “utilities” for the purposes of this contract and require approved outage requests as stated above, prior to the interruption.
15.5.3. The Contractor’s Interruption and Outage Requests shall include specific location of interruption/outage, hours and dates of interruption/outage, services affected by the outage /interruption.
15.5.4. Water Mains: Operation of valves on water mains will be by Government personnel only. Where shut-off of water lines interrupts service to fire hydrants or fire sprinkler systems, the Contractor shall contact the CO and arrange his operations to have sufficient personnel available to restore service without delay in the event of an emergency as determined by the 435 CES/CEFP or 52 CES/CEF and 52 CES/CEPM.
15.5.5. Fire Protection System: Where interruption of electrical power affects a fire protection system service, the Contractor shall notify the CO not later than 10 workdays before making such interruptions and shall restore service prior to leaving the job site each day.
16. GOVERNMENT FURNISHED EQUIPMENT AND MATERIALS:
16.1. Government Furnished Materials (GFM) will not be furnished to the Contractor as a general rule, however, the Government reserves the right to provide GFM and/or Government Furnished Equipment (GFE) to be used on any task order. In such cases, these materials will be receipted for by the Contractor and excluded from the price of the task order.
16.2. The Contractor, with his own forces, shall transport all GFE/GFM, if any, described on the task order from the Government storage area to the work site indicated on the task order. The contractor may propose the cost using the Lump-Sum Ordering Method CLIN.
16.3. The Contractor assumes the risk and responsibility for the loss or damage to Government-furnished property.
16.4. The Contractor shall follow the instructions of the CO (or authorized representative) regarding the disposition of all Government-furnished property not consumed in performance of a task order.
17. REMOVAL AND REPLACEMENT RESPONSIBILITY:
The Contractor shall be responsible for the replacement or repair of all existing finished surfaces, utilities, equipment, landscapes, grounds, and structures or parts thereof that he/she has damaged, removed, or cut into in order to perform work specified. Removed items to be reinstalled shall be stored by the Contractor, free from damage, until reinstalled at no additional cost to the Government.
18. PROVISION OF MAINTENANCE DATA:
If applicable, the Contractor shall provide a list including the following data on each task order:
· Equipment requiring maintenance.
· Short description of maintenance work and reference to manuals.
· Maintenance manuals/documents for all equipment, etc.
· Maintenance periods.
This list should be provided not later than 10 workdays after determination of the equipment on a task order.
19. CONSTRUCTION INSPECTION REPORTS:
The Contractor shall maintain a construction inspection report on each task order. Entries shall be made on every day work is being accomplished and as accurately as possible. The report shall include the following items (if applicable): progress of the job, problems, agreements made, weather conditions, unforeseen occurrences etc. This inspection report shall be submitted on a weekly basis to the 435th CES/CEPM or 52 CES/CEPM, unless no work has been performed during this period.
20. LIQUIDATED DAMAGES:
The 435th CES/CEPM or 52 CES/CEPM may request payment of liquidated damages if the Contractor fails to complete the work within the time specified in the contract, without an excusable delay. The amount to be paid will be determined by the CO and the Civil Engineering for each task order.
21. SAFETY PLAN:
The Contractor shall submit a safety plan and procedure to the CO for review and approval within 21 calendar days of contract award. This plan shall be prepared by a safety and health protection coordinator (SIGEKO), if required according to the Baustell V. The SIGEKO shall be provided by the Contractor.
22. CERTIFICATION:
Certified tests on materials and/or equipment to be incorporated into this project will be acceptable provided they are conducted in accordance with the standards established by the authority cited in the referenced specifications and the tested materials or equipment meet the specified requirements. Preprinted certifications are not acceptable.
