The following have been added by full text:
AMENDMENT #5 CONTINUATION
As previously addressed during the Pre-Proposal Conference on 01 July 2009, the Government holds all interested parties involved in the procurement process to the highest ethical standards. FAR Part 3 states that the expenditure of public funds requires the highest degree of public trust and an impeccable standard of conduct. Any conflict of interest, whether actual or even the mere perception thereof, must be strictly avoided in the Government-Contractor relationship. The following misconduct shall not be tolerated:
a. The offer or acceptance of a bribe or gratuity;
b. The disclosing or obtaining of proposal or source selection information, to include information provided by current or former employees;
c. The compensating of former employees within the one year ban period, or scenarios referred to commonly as “switching sides” during the procurement process; and,
d. Any other misconduct that violates applicable regulations or laws governing the procurement process.
The Government shall respond appropriately to a violation of the above whether through administrative, civil or criminal action. The Government reserves the right to rescind a contract, and/or suspend/debar a contractor for up to three years for a violation of ethical principles or law.
