Answer to OCI Questions
The SENSOR contract (and likely the future SORS contract) provides sustainment modifications, upgrades, and modernization efforts for GEODSS. In these situations, the
SENSOR team provides sustaining engineering and modification projects, developing, integrating, and assembling the modifications for GEODSS.
Essentially, a potential OCI could be one company recommending changes, testing, and providing technical evaluations on upgrades and modifications (O&M contractor) that the same company designed, developed, tested and integrated (SENSOR contractor) into the GEODSS system. An OCI includes possible testing, evaluation and acceptance by the O&M contractor of system upgrades, modernization and integration of sustainment solutions by the SENSOR contractor.
The Government has conducted its own OCI analysis which did not identify OCIs and concluded that the risk of a significant OCI on this effort is low. However, offerors may be aware of potential OCIs the Government did not contemplate. Therefore, in considering whether an OCI exists, offerors are encouraged to examine the following questions to aid in determining if a potential OCI exists-
1) Does the offeror/sub provide any systems engineering and technical direction on the current
GEODSS system through the SENSOR contract or any other means IAW FAR 9.505-1?
2) Does the offeror/sub prepare specifications or work statements on the current GEODSS system through the SENSOR contract or any other means IAW FAR 9.505-2?
3) Does the offeror/sub provide evaluation services on the current GEODSS system through the
SENSOR contract or any other means IAW FAR 9.505-3?
4) Does the offeror/sub obtain access to proprietary information on the current GEODSS system through the SENSOR contract or any other means IAW FAR 9.505-4?
If the offeror concludes that a potential/actual OCI exists for their company on this acquisition, IAW RFP Section L-3, AFFARS 5352.209-9001, provide with the proposal pertinent information regarding the OCI including any proposed mitigation plan. Note that if award is made to an offeror with an OCI, the resulting contract may include an organization conflict of interest limitation applicable to subsequent Government work, at either a prime contract level, at any subcontract tier, or both. During evaluation of proposals, the Government may, after discussions with the offeror and consideration of ways to avoid the conflict of interest, insert a special provision in the resulting contract which shall disqualify the offeror from further consideration for award of future contracts.
The solicitation contains an OCI clause in Section I that may be modified or deleted during discussions/negotiations. Currently the Government anticipates deleting the clause.
