About this file
This is a mandatory compliance affidavit required by Hillsborough County Public Schools (HCPS) for all proposers responding to Request for Proposals (RFP 26028-MST) for fencing services. The affidavit, mandated by Florida Statutes 287.138, must be completed and executed by an authorized representative of the proposer and submitted with the bid or proposal. HCPS will not accept any bid, proposal, quote, or response without this completed affidavit. The fencing services RFP encompasses new installations and repairs/maintenance for multiple fencing types across 270+ school sites, with response times categorized as Priority 1 (emergency response within four hours), Priority 2 (restoration within 10 business days), and Priority 3 (completion within 15 business days). Questions regarding the procurement are due by February 12, 2026, at 5:00 PM ET, and proposals must be submitted electronically via VendorLink by February 26, 2026, at 5:00 PM ET. The initial contract term begins upon School Board approval and automatically renews for up to four additional one-year periods, contingent on appropriations, performance, continued need, and mutual agreement.
The affidavit requires proposers to attest under penalties of perjury that their legal entity does not meet any of the criteria prohibiting contracting with entities of foreign countries of concern as defined in Florida Statutes 287.138. Specifically, the proposer must confirm that their entity is not owned by the government of a foreign country of concern (including the People's Republic of China, Russian Federation, Islamic Republic of Iran, Democratic People's Republic of Korea, Republic of Cuba, Venezuelan regime of Nicolas Maduro, or Syrian Arab Republic), does not have such a government holding controlling interest, and is not organized under the laws of or principally located in such a foreign country of concern. "Controlling interest" is defined as possessing the power to direct management or policies through ownership of securities, contract, or otherwise, with a presumption of controlling interest at 25 percent or more of voting interests or profits. Completion and submission of this affidavit is a mandatory prerequisite for bid acceptance.
