About this file
This document is Amendment No. 9 to DEP Agency Term Contract No. GC832, a rate adjustment amendment executed between the Florida Department of Environmental Protection (FDEP) and WES Environmental, LLC. The contract, originally executed on February 25, 2014, provides petroleum contamination site response action services in Florida's North Region. The amendment was signed on May 22, 2020, by David Ellion (President of WES Environmental, LLC) and John Truitt (Deputy Secretary of FDEP).
Amendment No. 9 modifies rates for 275 pay items contained in the contractor's Rate Schedule, effective for new work assignments issued on or after June 19, 2020 (the Rate Change Date). The majority of rate adjustments are increases, ranging from +0.93% to +5.00%, with increases applied to drilling and boring services, well installation and abandonment, sample collection, laboratory analysis, soil source removal, debris and waste disposal, remedial action construction, system operation and maintenance, reporting, and professional services. A limited number of items experienced rate decreases, including three petroleum storage tank removal items (ranging from -5.03% to -5.17%) and two water analysis items (-7.14% and -8.42%). The new rates supersede the previous Version 3.1 schedule, with Version 3.2 now governing all work assignments offered after the effective date. All pre-Rate Change Date work assignments continue to use the prior rate schedule. The contractor justified rate increases per contract provision 11.B, with all requested increases remaining within the allowable 5% maximum threshold.
