RE: Contract Number: CN330, Change Order No. 1 Marine Engineering and Environmental Consulting Services for the John Pennekamp State Park Dock and Boat Ramp Replacement in Key Largo, Monroe County, Florida
Dear Mr. Hewitt:
Cummins Cederberg, Inc. (Cummins Cederberg) respectfully submits this contract change order for engineering and environmental services for the revised plans to replace one boat ramp at John Pennekamp State Park located at 102601 Overseas Highway, Key Largo, Florida. The Project includes replacing a portion of the existing dock located behind the Park dive shop and now replacing only the south adjacent boat ramp with a Tedder Concrete Boat Ramp System. This change order replaces the work previously approved for the proposed boat ramps repairs with work for the proposed boat ramp replacement.
For your review, Cummins Cederberg, Inc. (Cummins Cederberg) has prepared the attached revised summary and man-hour documentation for the service tasks identified below:
Subtask 2 – Engineering – 60% Documents Subtask 3 – Environmental Permitting
We appreciate consideration of this change order and look forward to continuing to work together.
Please review the attached change order summary and deliverables and provide authorization to proceed.
Sincerely, CUMMINS CEDERBERG, INC.

Contract: CN330 Task Assignment No: 03 Subtasks: 2 and 3 Change Order: 1
Subtask 2 – Engineering – 60% Documents
Description: Cummins Cederberg will design a new dock structure, in the exact same footprint, for approximately 2,600 sq. ft. fronting the Dive Shop. The design is anticipated to consist of timber dock piles, along with timber framing and composite decking. Replacement of the south boat ramp consisting of a Tedder Concrete Boat Ramp System will be included in the design. Electrical service and plumbing for the proposed dock replacement will consist of the criteria listed below:
- (2) Existing pedestals (existing 50-amp service)
- (1) Existing pedestal (upgrade 30-amp to 50-amp service)
- (3) Water hose connections (1 at each pedestal)
- Wiring, grounding, and conduit for each pedestal
- Pressure conduit for water hose feeds to extend to all docks to service each pedestal
- Verify/Upgrade panel capacity for service to each pedestal
Cummins Cederberg will prepare preliminary drawings for the dock replacement, Tedder
Concrete Boat Ramp Systems boat ramp replacement, and electrical, at approximately 60% completion level, inclusive of specifications, in sufficient detail for submittal to the regulatory agencies as ‘permit sketches’. The existing conditions, and geotechnical data from Subtask 1 will be included. The plans will be prepared in CAD format.
Deliverable: 60% construction documents (11x17) in PDF format and construction cost estimate.
Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, accurate, and timely.

Subtask 3 – Environmental Permitting – Dock and Boat Ramps Replacement
Description:
Subtask 3A - FDEP SWERP Application and Processing: Cummins Cederberg will prepare and process a Statewide Environmental Resource Permit (SWERP) Exemption
Application through the South Florida Water Management District (SFWMD), requesting an exemption for the proposed dock and boat ramp replacement Project, pursuant to Chapter
62-330, F.A.C. Cummins Cederberg will maintain contact with FDEP to review plans and provide additional information. The Client will provide Cummins Cederberg with a signed exemption verification request and a processing fee of $100.00.
Subtask 3B - USACE Application and Processing: Cummins Cederberg will prepare and process a Department of the Army Application through the U.S. Army Corps of Engineers
(USACE) requesting verification of a Nationwide 3 Permit (NW-3) for the proposed dock and boat ramp replacement Project. Cummins Cederberg will maintain contact with the USACE staff to review plans and provide additional information. The Client will provide Cummins
Cederberg with a signed application form.
Subtask 3C - Marine Resources Survey: Only if the SFWMD and/or the USACE send a request for additional information which requests that a marine resources survey be conducted of the dock and/or boat ramps replacement areas, Cummins Cederberg biologists will perform a marine resources survey to identify the limits of important ecological resources on and adjacent to the existing dock and boat ramp. The limits of resources will be surveyed with a Global Positioning System. This information will be used to ensure that impacts to benthic resources are avoided and minimized to the maximum extent practicable in the design process and to support environmental permitting for the Project.

CONDITIONS/ASSUMPTIONS
Client shall notify Cummins Cederberg of any known conditions related to the Project that may affect the above-described scope of services.
Client shall provide safe access to the Project site as needed by Cummins Cederberg to complete the above-described scope of services.
Based upon the benthic resources survey (only if required by the permitting agencies) the
Project will be designed to avoid and minimize impacts to marine resources to the maximum extent practicable, and compensatory mitigation is not anticipated. If benthic
October 5, 2021 Page 6 of 6 resources impacts cannot be avoided or adequately minimized and compensatory mitigation is required to offset loss of ecological functions and values, or if coral relocation is required, agency negotiations and compensatory mitigation (including coral relocation) will be addressed under an addendum scope.
This scope assumes that the Florida Keys National Marine Sanctuary (FKNMS) will comment on the USACE permit and a separate FKNMS permit will not be required.
