About this file

This document is Amendment No. 1 to Professional Services Agreement No. CN 300 between the Florida Department of Environmental Protection and Bergmann Associates, Architects, Engineers, Landscape Architects & Surveyors, D.P.C, P.A., a foreign corporation headquartered at 8653 Baypine Road, Suite 100, Jacksonville, Florida 32256. The amendment was executed in early 2021 to renew and modify the original agreement that became effective May 11, 2016.

The amendment renews the agreement for a five-year period commencing May 11, 2021, and concluding May 11, 2026, under the same terms and conditions as the original agreement. The amendment incorporates updated public records requirements as Attachment J and replaces Section 20 with new scrutinized companies provisions that require the consultant to certify it is not on various boycott or sanctions lists related to Israel, Sudan, Iran's petroleum energy sector, Cuba, or Syria, with immediate termination rights granted to the Department upon false certification or placement on such lists. The public records requirements stipulate that if the agreement exceeds $35,000, the consultant must allow public access to all documents created in conjunction with the agreement unless exempt under Florida law, and upon completion must transfer all public records to the Department at no cost or maintain them according to applicable retention requirements.
