About this file

This is a Task Assignment Change Order Form (CN300-TA02-CO2) issued by the Florida Department of Environmental Protection (FDEP) to Bergmann Associates for services related to the C.H. Corn Hydroelectric Generating Station. The change order modifies an existing contract to add Federal Energy Regulatory Commission (FERC) licensing services for the facility, which is owned by the State of Florida and currently operated by the City of Tallahassee as an 11 MW hydroelectric generating power plant. The project involves preparing documentation required to meet a June 30, 2017 FERC deadline for notification regarding license transfer, relicensing, or surrender.

The change order adds services valued at $42,945.84, consisting of $39,995.00 in fixed price costs and $2,950.84 in reimbursable expenses. Bergmann Associates will prepare a Draft Pre-Application Document (PAD) and Notice of Intent (NOI) to File Application For (Re)License with FERC, conduct one site visit to the facility and Lake Talquin area, address FDEP comments, and deliver final bound copies and PDF versions of all documents plus proof of FERC submission prior to June 30, 2017. The fixed price costs cover labor by a Contract/Project Manager, Senior Planner, Project Engineer, and Engineering Technician; reimbursable costs include travel expenses, printing, postage, and mileage. The project schedule runs from April 1, 2017 through June 8, 2017, with the total task amount including all previous change orders reaching $125,359.64. Payment is contingent upon FDEP approval of deliverables.

RE: (FDEP CN300-TA02-CO2)

(FEE PROPOSAL C.H. CORN HYDROELECTRIC GENERATING STATION

PREAPPLICATION DOCUMENT AND NOTICE OF INTENT PREPARATION)

Dear Ms. Carron, Bergmann Associates is pleased to submit this proposal to Florida Department of Environmental Protection (FDEP) to provide services associated with the transfer of operations of the C.H. Corn Hydroelectric Generating Station (the “Facility”) from the City of Tallahassee (the “City”) to a new Operator.

We understand the State of Florida owns the Facility and leases it to the City of Tallahassee to operate it as an 11 MW hydroelectric generating power plant. The Facility is operated in accordance with a license granted by the Federal Energy Regulatory Commission (FERC). The license expires in 2022 and FERC must be informed by June 30, 2017 with a formal Notice of Intent to surrender or relicense or transfer the license.

Since the City has decided that it does not want to relicense the Facility, the State of Florida is exploring the option to transfer the license to an independent Operator. The State of Florida would lease the Facility to the new Operator who would assume the same responsibilities for operating the Facility as the City.

However, the terms and conditions of the current lease with the City as well as the current operating requirements may change as the lease with the new Operator is negotiated.

As the license transfer process continues, FDEP has requested Bergmann to provide a scope and fee to prepare the Draft Pre-Application Document (PAD) and Notice of Intent (NOI) to File Application For (Re)License with the Federal Energy Regulatory Commission (FERC).

A Scope of Work, Rate Schedule and Fee are attached for your approval. Thank you for the opportunity to provide this proposal.

Respectfully, Donald P. Nims, Jr., P.E.

Project Manager Bergmann Associates

Contract Number, CN300-TA02-C02

Subtask 4: Complete PAD and NOI for Submission to FERC Description: In order for the State of Florida to meet a June 30, 2017 deadline imposed by FERC for the submission of a Notice of Intent to relicense the C.H. Corn Hydroelectric Generating Station (facility), the preparation of a Notice of Intent (NOI) and its supporting Pre-Application Document (PAD) are required.

Subtask 1: Complete PAD and NOI for Submission to FERC

Description:

Bergmann will conduct one (1) site visit to the C.H. Corn Hydroelectric Facility and the Lake Talquin area for the purpose of meeting with the existing facility engineer on-site and to tour the hydroelectric facility. Bergmann will generally survey the Lake Talquin area for the purpose of obtaining field reconnaissance helpful in completing the “Existing Environmental and Resource Impacts” portion of the PAD.

Bergmann will prepare a Draft PAD for review and comment by the FDEP. As required, the PAD will meet requirements of 18 CFR § 5.6 and will contain the following:

o A description of the project's facilities and operation;

o A description of the existing environment and any known and potential project effects on specific resources including: geology and soils; water resources; fish and aquatic resources; wildlife and botanical resources; wetlands, riparian, and littoral habitats;

rare, threatened, and endangered species; recreation and land use; aesthetic resources;

cultural resources; socioeconomic resources; tribal resources; and a description of the river basin;

o A list of preliminary issues and studies that may be needed at the project;

o An appendix summarizing contacts with stakeholders sufficient to enable the Commission to determine if due diligence has been exercised in obtaining relevant information;

o A process plan and schedule for consulting stakeholders, gathering information, developing and conducting studies, obtaining permits and completing all pre-filing licensing activities; and o If applicable, a statement of whether or not the applicant will seek benefits under

Section 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA).

Bergmann will address FDEP comments on the Draft PAD and provide the Final PAD to FDEP for submission.

Bergmann will prepare a Draft NOI meeting requirements of 18 CFR § 5.5 for review and comment by the FDEP. Bergmann will address FDEP comments and provide the Final NOI to FDEP for “Certificate of Service” signature and submission to FERC.

Deliverable:

A Pre Application Document (2 bound copies of the Final Report and a PDF of the Draft and Final Reports)

Notice of Intent (NOI) to File Application For (Re)License (2 hard copies of the Final Report and a PDF of the Draft and Final Reports)

Copy of the FERC date of submittal proof (receipt, email, screen-shot, or letter) dated prior to June 30, 2017.

A compact disk containing scans of final documents, back-up documents and discovery items will be provided to the State.
