About this file
This Conflict of Interest Affidavit is a required disclosure document for the State of Maryland's Multi-Step Invitation for Bids (MS-IFB) for Materials Laboratory Testing Services for the State Highway Administration (SHA). The affidavit, effective July 2024, requires offerors, contractors, consultants, subcontractors, and their employees or agents with authority to control or supervise contract work to disclose any actual or potential conflicts of interest that could impair their objectivity or provide unfair competitive advantage. Offerors must warrant that no relevant facts or circumstances exist that would create a conflict of interest, except as specifically disclosed in the affidavit document. The form provides space for detailed explanation of any conflicts and requires attachment of additional sheets if necessary to fully describe the nature and scope of potential conflicts.
The affidavit further obligates the offeror to immediately disclose in writing to the procurement officer any actual or potential conflicts of interest that arise after the affidavit date, including a description of actions taken or proposed to mitigate or neutralize the conflict. If the contract has been awarded and performance has commenced, the contractor must continue performance until receiving contrary instructions from the procurement officer. The document requires execution under penalty of perjury by an authorized representative and must be submitted with the bid or proposal. This affidavit serves as a binding certification of the offeror's conflict-free status and commitment to transparency throughout the procurement and contract performance process.
