About this file

This is a Maryland Living Wage Requirements Affidavit of Agreement form associated with a Multi-Step Invitation for Bids (MS-IFB) issued by the State of Maryland for Materials Laboratory Testing Services for the State Highway Administration (SHA). The affidavit serves as a compliance document that bidders must submit with their proposals to confirm their status regarding Maryland's Living Wage Law requirements. Bidders must certify either that their contract is exempt from living wage requirements based on specific criteria, or that they commit to comply with Title 18 of the State Finance and Procurement Article of the Maryland Annotated Code by paying covered employees the established living wage rate for all hours spent on state contract activities.

Exemptions from living wage requirements apply to nonprofit organizations, public service companies, bidders employing 10 or fewer employees with proposed contract values under $500,000, or bidders employing more than 10 employees with proposed contract values under $100,000. For contracts subject to living wage obligations, contractors must ensure subcontractors also comply with wage rate requirements throughout the initial contract term and all renewal periods, including automatic adjustments when the Commissioner of Labor and Industry establishes revised wage rates. Bidders may affirm they have no covered employees if those employees will work less than half-time on the contract, are 17 years of age or younger, or will work fewer than 13 consecutive weeks. The affidavit requires authorization by a company representative's signature and must be submitted with the bid proposal; the Commissioner of Labor and Industry retains the right to request payroll records and supporting documentation to verify affirmations.
