About this file
This document provides a solicitation notice for a 47-foot Motor Lifeboat Service Life Extension Program.
The Coast Guard is seeking proposals to extend the service life of 107, 47-foot Motor Lifeboats. The work includes detailed design, production, transportation, discovered items, training, interim logistics support, and system insurance stock. Proposals are due on March 15, 2019. The base period consists of ordering years 1 through 5, with an option for years 6 through 10.
The solicitation uses firm-fixed-price contract line item numbers to cover the various requirements. Detailed design includes mockups and technical data deliverables. Production applies to first article, low rate initial production, and full rate production boats. Transportation involves moving boats between storage, production sites, and inventory control locations. Interim logistics support and discovered items are also line items.
The notice provides summary information on a Coast Guard opportunity to extend the service life of over 100 motor lifeboats. Proposals are due in mid-March 2019.

SECTION M 1 of 5
TABLE OF CONTENTS
M.1 PROCEDURES FOR AWARD
M.2 BASIS FOR AWARD
M.3 SOURCE SELECTION PROCESS
M.4 EVALUATION
M.5 TECHNICAL EVALUATION
M.6 PRICE EVALUATION
M.7 PAST PERFORMANCE
M.1 PROCEDURES FOR AWARD
(a) Proposals shall be submitted in accordance with the instructions in Section L. Proposals will be reviewed for compliance with the solicitation requirements. In addition, proposals will also be evaluated for unique and innovative methods, processes, and/or solutions that are beneficial to the Government.
(b) Because the Government intends to award without discussions, the Offeror is responsible for providing its best submission in its initial proposal.
(c) A proposal may be rejected as deficient if the Contracting Officer determines that the proposal does not materially comply with the solicitation requirements.
M.2 BASIS FOR AWARD
(a) In order to be eligible for award, the Offeror's proposal must comply in all material respects with the requirements of law, regulation, and the terms and conditions set forth in the solicitation; and the Offeror must be determined responsible according to the standards set forth in FAR Subpart 9.1. Each response will be evaluated strictly in accordance with its content and the Government will not assume that performance will include areas not specified in the
Offeror’s proposal.
(b) The contract award decision will be based on the evaluation of the Offeror’s proposal as set forth in the solicitation. This assessment will determine which proposal is the best value to the
Government in terms of the established evaluation factors.
(c) The contract award decision will be based on the proposal that represents the best value to the Government through the application of the trade-off process and the established evaluation factors.
(d) The Source Selection Authority is the selection official for award.
SECTION M 2 of 5
(e) An Offeror’s proposal that takes exception to any of the terms and conditions of this solicitation shall be submitted in accordance with Section L. As noted in Section L, Offerors are cautioned that exceptions to the requirements may result in the rejection of the proposal.
M.3 SOURCE SELECTION PROCESS
(a) The Government will conduct a formal source selection in accordance with FAR Part 15 procedures.
(b) A tradeoff process will be employed in the source selection approach. The Technical factors are in descending order of importance. In this process, Technical is more important than Past
Performance and Past Performance is more important than Price. When combined, Technical and Past Performance are significantly more important than the Price.
M.4 EVALUATION
(a) Proposals shall be submitted in accordance with the instructions in Section L. A proposal may be rejected if the Contracting Officer determines that the Proposal does not comply with the solicitation requirements.
(1) For the objective and threshold values listed in Section L, the threshold values represent the minimum requirements as noted in the current solicitation.
(2) Proposed attributes that exceed threshold requirements will favorably influence rating.
(b) Each proposal that complies with the solicitation requirements will be evaluated to assess the Offeror's ability to perform the Service Life Extension Program (SLEP) in accordance with the solicitation requirements. Proposals will be evaluated on the basis of the following factors:
(1) Technical (listed in descending order of importance)
(i) Performance, Supportability, and Maintainability of the Proposed 47 MLB
(ii) Management, Production, and Logistics Capabilities
(iii) Systems Engineering and Design Approach
(iv) Configuration Management and Quality Assurance
(2) Price
(3) Past Performance
SECTION M 3 of 5
M.5 TECHNICAL EVALUATION
(a) The Technical factors will consist of an evaluation of the following, and each Technical factor will be assigned both a technical rating and a risk rating:
(b) Performance, Maintainability, and Supportability of the Proposed 47 MLB: This factor will assess the Offeror’s proposed solution in meeting the:
(1) Systems and Equipment Selection,
(2) Weight and Center of Gravity Estimates,
(3) Underway Performance Estimates,
(4) Bridge and Console Designs, and
(5) Access for Maintenance and Repair.
(c) Management, Production, and Logistics Capabilities: This factor will assess the Offeror’s ability to complete the SLEP based on their:
(1) Organization, Production Planning and Scheduling, and Transportation Planning,
(2) Production Capability and Facilities, and Labor Force, and
(3) Post-Delivery and Warranty Support.
(d) Systems Engineering and Design Approach: This factor will assess the Offeror’s ability to complete the SLEP based on their approach to completing the technical design work required for the 47 MLB SLEP including:
(1) Technical Resources and Integrated Systems Approach,
(2) Reliability and Sustainability, and
(3) Weight and Center of Gravity Control Program.
(e) Configuration Management and Quality Assurance: This factor will assess the Offeror's ability to complete the SLEP based on their approach to
(1) Configuration Management,
(2) Quality Assurance (QA), Testing and Validation, and
(3) Information Management/Technical Data Management.
(i) Data Rights: The Government will evaluate the extent to which:
(A) The Offeror proposes in Section J-1 rights in data that satisfy the
Government’s asserted and/or desired rights as described in this RFP. The degree to which the proposal provides the asserted or desired level of technical data rights (and rights in computer software) that will enable the
Government to cost effectively and adequately sustain the boats over their lifecycle to include maintainability and reparability.
(B) Where there are valid reasons why an Offeror must develop entirely at private expense or provide previously developed technical data under this contract, the Offeror may not be required, either as a condition of being responsive to this RFP or as a condition for award, to sell or otherwise relinquish to the Government any proprietary right in technical data developed at private expense except for the items identified at FAR
27.404-1(a) through (d).
SECTION M 4 of 5
(C) The Government will not assign a strength to an Offeror’s proposal that proposes to deliver rights in data greater than the minimum specified in this RFP.
M.6 PRICE EVALUATION
(a) Price will be evaluated for completeness, reasonableness, and unbalanced pricing. Proposals will not be scored, ranked, nor rated.
(b) Total Evaluated Price (TEP): TEP is defined as the sum of all proposed CLINs. The
Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) Completeness. Completeness is compliance with the price proposal instructions in Section
L.
(d) Reasonableness. Per FAR 15.404-1(a), the evaluation team will complete a proposal analysis to ensure that the final agreed to price is fair and reasonable. The Government will evaluate the proposed prices for price reasonableness.
(e) Unbalanced Pricing. The Government may reject a proposal if the prices proposed are materially unbalanced between line items or sub-line items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the KO determines that the lack of balance poses an unacceptable risk to the Government.
(f) The estimated production schedule by ordering period and CLINs for planning and evaluation purposes is located in Section J, Attachment 2, 47 MLB SLEP IDIQ Pricing
Worksheet.
(g) The contract ceiling amount is the total sum of all extended pricing CLINs from the pricing worksheet in Section J, Attachment J-2.
M.7 PAST PERFORMANCE
Past Performance ratings will be applied to the Offeror’s stated performance record as delineated by the Offeror in response to requirements stated in Section L of the RFP and independently substantiated by the Government. The recentness, relevancy, source of the information, context of the data, and general trends in the Offeror’s performance will be considered in evaluating past performance. Offerors lacking a relevant past performance record or for whom information on past performance is not available or cannot be determined will not be evaluated favorably or unfavorably on past performance. The Government will contact references submitted by the
SECTION M 5 of 5
Offerors and may use information available to the Government (e.g., CPARS, PPIRS) to verify information provided with the Offeror’s proposal, as well as information obtained from other customers known to the Government, consumer protection organizations, and others who may have relevant and useful information. Information may also be considered regarding any significant subcontractors.

Rating Definition Justification Exceptional Performance meets contractual requirements and exceeds many to the Government’s benefit. The contractual performance of the element or sub-element being evaluated was accomplished with few minor problems for which corrective actions taken by the contractor were highly effective
To justify an Exceptional rating, identify multiple significant events and state how they were of benefit to the Government. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.
Also, there should have been NO significant weaknesses identified.
Very Good Performance meets contractual requirements and exceeds some to the Government’s benefit. The contractual performance of the element or sub-element being evaluated was accomplished with some minor problems for which corrective actions taken by the contractor was effective.
To justify a Very Good rating, identify a significant event and state how it was a benefit to the Government. There should have been no significant weaknesses identified.
Satisfactory Performance meets contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
To justify a Satisfactory rating, there should have been only minor problems, or major problems the contractor recovered from without impact to the contract/order. There should have been NO significant weaknesses identified. A fundamental principle of assigning ratings is that contractors will not be evaluated with a rating lower than Satisfactory solely for not performing beyond the requirements of the contract/order.
Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being evaluated reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
To justify Marginal performance, identify a significant event in each category that the contractor had trouble overcoming and state how it impacted the Government. A Marginal rating should be supported by referencing the management tool that notified the contractor of the contractual deficiency (e.g., management, quality, safety, or environmental deficiency report or letter).
Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains a serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
To justify an Unsatisfactory rating, identify multiple significant events in each category that the contractor had trouble overcoming and state how it impacted the Government. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating. An Unsatisfactory rating should be supported by referencing the management tools used to notify the contractor of the contractual deficiencies (e.g., management, quality, safety, or environmental deficiency reports, or letters).
Category and Description Rating (drop down) Justification Quality of Product or Service Contractor’s conformance to contract/order requirements, specifications and standards of good workmanship.
Choose a Rating
Schedule. Assess the timeliness of the contractor against the completion of the contract, task orders, milestones, delivery schedules, and administrative requirements.
Management. Assess the integration and coordination of all activity needed to execute the contract/order, specifically the timeliness, completeness and quality of problem identification, corrective action plans, proposal submittals, the contractor’s history of reasonable and cooperative behavior (to include timely identification of issues in controversy), customer satisfaction, timely award and management of subcontracts.
Regulatory Compliance Consider failure to report in accordance with contract terms and conditions, late or nonpayment to subcontractors, trafficking violations, tax delinquency, defective cost or pricing data, terminations, suspension and debarments.
Assess compliance with all terms and conditions in the contract/order relating to applicable regulations and codes, Consider aspects of performance such as compliance with financial, environmental, safety, and labor regulations as well as any other reporting requirements in the contract terms and conditions.

NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.
Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.
The Ombudsman Hotline telephone number is 202.372.3695.
