697DCK-22-R-00001, Amendment 0003

1. Question: Will the roofing sub-contractors be required to provide bonding for this project or just the prime contractor?

Response: Yes, bonding is required. Please refer to 3.4.1-4 PERFORMANCE BOND

REQUIREMENTS (JAN 2017), 3.4.1-5 PAYMENT BOND REQUIREMENTS (JAN 2018),

3.4.1-6 ADDITIONAL BOND SECURITY (APR 1996) & 3.4.1-2 DEPOSIT OF ASSETS

REQUIREMENTS (JAN 2017).

2. Question: Once COVID vaccinations are required, what specific additional requirements will exist for workers that have medical and religious exemptions?

Response: It has not yet been determined whether masks and/or daily testing will be an allowable accommodation. For bidding purposes, Offerors should anticipate that masking and/or daily testing will not be offered as a reasonable accommodation.

3. Question: Implementation of the COVID-19 protocol results in the Contractor assuming the risk of negative side effects/events from the COVID-19 vaccine through worker's compensation claims. Typically the Government will cover Contractors when there is a significant and unknown liability for a risk that is part of the performance of the contract. Will the Government accept the risk of Contractor employees that are vaccinated and incur negative side effects/events?

Response: The SIR requires the Offerors to identify a qualified workforce; in this case, the qualification requirement is vaccination of all of its employees unless there is a legal reasonable accommodation identified. If the Offeror is unable to provide a qualified workforce, the Offeror has the option of not participating in the procurement. The FAA will not consider health/labor costs associated with vaccines as a request for equitable adjustment during the course of performance.

4. Question: we understand that the response to question no. 10 implies that no price schedule form will be provided / requested by the FAA. Is there a preferred format / level of detail for the cost breakouts, including unit rates and quantity / hours, materials, and other direct costs, overhead and profit for labor that are requested by the FAA and referenced in Sections B, L & M?

Response: Please submit a price proposal in Excel format in accordance with M.3 in 697DCK- 22-R-00001.

5. Question: Will the FAA be issuing a specific bid sheet to be completed with a breakdown to show pricing, to be included in the proposal?

Response: No the FAA will not issue a bid sheet. Please submit a price proposal in Excel format in accordance with M.3 in 697DCK-22-R-00001.

697DCK-22-R-00001, Amendment 0003

6. Question: Will the FAA be issued any more information or requirement in addition to what has been issued for the current Vaccine Mandates?

Response: For the latest guidance on vaccination requirements for visitors at covered contractor workplaces, please refer to the Safer Federal Workforce site located at https://www.saferfederalworkforce.gov/.

7. Question: On the Solicitation section 13: Additional Solicitation Requirements: D. Offers providing less than_____0____calendar days for Contract Authority acceptance after the date offers are due will not be considered and will be rejected.

Response: The solicitation is revised to read 60 days for acceptance and AMS - 3.2.2.3-2 - Minimum Offer Acceptance Period (JUL 2004) has been added to the terms and conditions.

Clause 3.2.2.3-2 - Minimum Offer Acceptance Period (JUL 2004)

Minimum Offer Acceptance Period (JUL 2004)

(a) 'Acceptance period,' as used in this provision, means the number of calendar days the FAA (we, us) has to award a contract from the date the SIR specifies for receiving offers.

(b) This provision supersedes any language about the acceptance period appearing elsewhere in this SIR.

(c) We require a minimum acceptance period 60 calendar days.

(d) The offeror (you) may specify a longer acceptance period than the period shown in paragraph (c). To specify a longer period, fill in the blank: The offeror allows the following acceptance period: _____ calendar days.

(e) We may reject an offer allowing less than the FAA's minimum acceptance period.

(f) You agree to fulfill your offer completely if the FAA accepts your offer in writing within:

(1) The acceptance period stated in paragraph (c) of this provision; or

(2) Any longer acceptance period stated in paragraph (d) of this provision.
