About this file

This is a Conflict of Interest Reporting Notice issued by the City of Midland, Texas, regarding compliance requirements under Texas Local Government Code Title 5, Chapter 176. The notice establishes mandatory disclosure obligations for vendors seeking to conduct business with the City of Midland who have or may have conflicts of interest as defined by state statute. Bidders responding to the related Jal Draw Excavation drainage project—which involves improvements to Jal Draw from Barton Creek to SH 158 with an additive alternate for a shared use trail—must comply with these conflict of interest reporting requirements. Vendors must file Form CIQ with the City of Midland's records administrator no later than the seventh business day after becoming aware of facts requiring disclosure. The notice clarifies that form submission is required only when a conflict of interest exists; however, vendors represent compliance with Chapter 176 requirements by submitting a bid response.

Violation of conflict of interest reporting requirements constitutes a Class C Misdemeanor under Texas law, and contracts or purchase orders awarded to non-compliant vendors are subject to termination with no recourse to the City of Midland. Vendors found in violation will be removed from the bidders list for a minimum of one year. The completed Form CIQ must be submitted with the bid or mailed to the City of Midland's City Secretary office. Current information regarding local government officers can be accessed at http://www.midlandtexas.gov/, and vendors are responsible for ensuring awareness of all officers listed to properly complete conflict of interest disclosures.
